PC-11-20-06CITY OF ROSEMEAD PLANNING COMMISSION REGULAR MEETING MINUTES November 20, 2006 CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order by Chairman Lopez at 7:00 p.m. in the Council Chambers of the Rosemead City Hall at 8838 East Valley Boulevard, Rosemead. Commissioner Loi led the Pledge of Allegiance. Commissioner Lopez delivered the invocation. ROLL CALL: PRESENT: Chairman Lopez, Vice - Chairman Kelty, Commissioners, Breen, Herrera, and Loi ABSENT: None EX OFFICIO: Bermejo, Johnson, Price, and Trinh 1. APPROVAL OF MINUTES Minutes of November 6, 2006 MOTION BY COMMISSIONER BREEN, SECONDED BY COMMISSONER HERRERA, that the minutes of the City of Rosemead Regular Planning Commission Meeting of November 6, 2006, be APPROVED as submitted. Vote results: YES: BREEN, HERRERA, KELTY, LOI, AND LOPEZ NO: NONE ABSENT: NONE ABSTAIN: NONE Chairman Lopez declared said motion duly carried and so ordered. 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS Chairman Lopez introduces City Attorney Stanton Price, and invites him to speak. City Attorney Price explained the public hearing process and the right to appeal Planning Commission decisions to the City Council Chairman Lopez asked if anyone would like to speak on any items not on the agenda, to step forward. None. 3. PUBLIC HEARING A. CONDITIONAL USE PERMIT 05 -1032 — 3715 Strang Avenue. Quan Chien Ma has submitted a Conditional Use Permit application to construct a new single - family residence, which will result in 2,975 square feet of living area and a detached three -car garage. The subject site is located at 3715 Strang Avenue in the R -1 (Single - Family Residential) zone. Presentation: Planning Director Brad Johnson Staff Recommendation: APPROVE — subject to the conditions, for six (6) months. Planning Director Johnson stated the applicant and designer were present and asked Commissioners if they had any questions. Chairman Lopez called for questions from the Commissioners. Commissioner Loi questioned if a rehab case is opened. Planning Director Johnson said he doesn't believe there is one, but staff noticed that it needs to be addressed during the last inspection on November 16, 2006. Commissioner Loi asked Planning Director Johnson if the home owner is responsible for the rehab expenses. Planning Director Johnson said it's more of accumulation of construction materials. Commissioner Loi questioned the interior condition of the house. Planning Director Johnson asked Associate Planner Sheri Bermejo if she had ever gone inside. Associate Planner Bermejo stated that she has only inspected the exterior part of the property, and have reviewed building permits. She said the only thing that needs to be addressed is the accumulation of materials. Chairman Lopez asked the Commissioners if they had any other questions. Commissioner Kelty questioned the number of conditions. Planning Director Johnson said there are 29; Commissioner Kelty then questioned whether the landscape plans will include fencing. Planning Director Johnson said they are usually on the same plan. Commissioner Kelly said he is worried about spiked fencing. He asked Planning Director Johnson if the City has any regulations. Planning Director Johnson said City regulations only address height, but Condition 419 and #20 addresses fencing. Chairman Lopez closed the hearing to the Commissioners and opened it to the public. TENTATIVE TRACT MAP 063609, PLANNED DEVELOPMENT REVIEW 05 -01 and ZONE VARIANCE 06 -342 — 8440 -8446 Dorothy Street. Anh L. Trieu, Hubert D. Trieu, Shawn H. Trieu, Thomas M. Trieu, Selso Ramos and Andrea M. Ramos have submitted a Tentative Tract Map application and a Planned Development Review application to subdivide three (3) existing parcels, totaling 42,736 t square feet of area, into seven (7) parcels for the development of a six (6) single - family homes with a common driveway. A Zone Variance application has also been submitted for less than the required total site area of 43,560 square feet for a P -D (Planned Development) zone. The project site is located at 8440 — 8446 Dorothy Street in the P -D (Planned Development) zone. Presentation: Associate Planner Sheri Bermejo Staff Recommendation: APPROVE — subject to the conditions, for two (2) years. Associate Planner Bermejo stated the applicant and architect were present and asked Commissioners if they had any questions. Chairman Lopez called for questions from the Commissioners. None. City Attorney Stanton Price questioned whether the applicants are six individuals or a partnership. He said that if it's a partnership, everything issued must be issued to the partnership. Associate Planner Bermejo stated that she's unsure, but the applicants are in the audience, so that question should be addressed to them. Chairman Lopez closed the hearing to the Commissioners and opened it to the public. Chairman Lopez opened the public hearing to those IN FAVOR of this application: Mr. Jimmy Lee of 13841 Roswell Avenue, Building 12, Suite A, Chino, California, the architect of the project, stood up and thanked Associate Planner Bermejo for her hard work. He clarified that the six individuals are forming a partnership. He said the applicants plan on selling each unit individually, but one of the six partners will be occupying the sixth unit. City Attorney Price stated that Tentative Tract Map, Planned Development Review and Zone Variance are issued to the partnership. Chairman Lopez opened the public hearing to those who wished to OPPOSE the application: None. CONSENT CALENDAR — These items are considered to be routine actions that may be considered in one motion by the Planning Commission. Resolution No. 06 -43 — A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, RECOMMENDING APPROVAL TO CITY COUNCIL OF ZONE CHANGE 04 -218, TO CHANGE THE CURRENT R -2 (LIGHT MULTIPLE RESIDENTIAL) ZONE TO THE P -D (PLANNED DEVELOPMENT) ZONE; AND PLANNED DEVELOPMENT REVIEW 04 -02 (CONCEPTUAL), FOR THE DEVELOPMENT OF EIGHT (8) SINGLE- FAMILY RESIDENCES WITH A PRIVATE STREET; AND THE ADOPTION OF A NEGATIVE DECLARATION FOR THE SUBJECT PROJECT, LOCATED AT 7621 -7637 GARVALIA AVENUE. (APN: 5285- 031 -005 AND 5285- 031 -022). B. Resolution No. 06 -44 — A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING TENTATIVE PARCEL MAP NO. 066501, REQUESTING THE SUBDIVISION OF TWO LOTS INTO A FLAG LOT DEVELOPMENT CONSISTING OF TWO PARCELS, ONE WITH AN EXISTING SINGLE - FAMILY RESIDENCE WHICH WILL BE MAINTAINED, AND ONE NEW SINGLE - FAMILY RESIDENCE, LOCATED AT 2512 EARLE AVENUE IN THE R -2 (LIGHT MULTIPLE RESIDENCIAL) ZONE (APN: 5283- 027 -011 AND 5283- 027 -012). Chairman Lopez asked the members of the Commission if there is any reason why Consent Calendar should not be accepted. None. MOTION BY COMMISSIONER BREEN, SECONDED BY COMMISSIONER HERRERA, to waive further reading and adopt said resolutions. MATTERS FROM THE CHAIRMAN AND COMMISSIONERS Commissioner Kelty conversed about Don Wagner's Retirement Party and how it was very nice. The Commissioners agreed. 6. MATTERS FROM THE PLANNING DIRECTOR AND STAFF Planning Director Johnson asked the Commissioners if they were interested in attending the Planning Commissioners Training Workshop. Commissioner Herrera, Kelty, Loi, and Lopez said they would be interested. Commissioner Breen said he is interested, but it may conflict with his schedule. Planning Director Johnson asked the Commissioners to inform Administrative Assistant Lily Trinh, whether they can attend the workshop or not. 7. ADJOURNMENT Chairman Lopez adjourned the Planning Commission Meeting at 7:32 p.m. B WJ/LT
