PC-01-03-05CITY OF ROSEMEAD PLANNING COMMISSION REGULAR MEETING MINUTES January 3, 2005 CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order by Chairman Kelty at 7:00 p.m. in the council chambers of the Rosemead City Hall at 8838 East Valley Boulevard, Rosemead. Commissioner Breen led the Pledge of Allegiance. Commissioner Kelly delivered the invocation. ROLL CALL: PRESENT: Chairman Kelly, Vice - Chairman Loi, Commissioner Breen, Commissioner Herrera, and Commissioner Lopez ABSENT: None EX OFFICIO: Johnson, Jones, Price, and Tone 1. APPROVAL OF MINUTES Minutes of December 6, 2004 MOTION BY COMMISSIONER BREEN, SECONDED BY COMMISSONER HERRERA, that the minutes of the City of Rosemead Regular Planning Commission Meeting of December 6, 2004, be APPROVED as submitted. Vote results: YES: BREEN, HERRERA, KELTY, LOI AND LOPEZ NO: NONE ABSTAIN: NONE ABSENT: NONE Chairman Kelly declared said motion duly carried and so ordered. 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS City Attorney Price explained the public hearing process and the right to appeal Planning Commission decisions to the City Council. 3. PUBLIC HEARING A. CONDITIONAL USE PERMIT 04 -967 — 3244 Eckhart Avenue. The applicant, Daniel Tai, is proposing a new 2 -story single - family residence with 3,103 +/- square feet of living area. The proposal, located in the R -2 (Light Multiple Residential) Zoning District, will include a new attached 3 -car garage. Presentation: Planning Director Johnson Staff Recommendation: APPROVE- subject to the conditions listed in "Exhibit A" for six (6) months Chairman Kelty called for questions from the Commissioners. Commissioner Breen pointed out that in the past, most Conditional Use Permits were approved for a period of one year, yet on this agenda the recommended approval period was six months. Planning Director Johnson explained that the applicant was only required to make progress toward initiation, not to complete the project, within the approval period. Applicant(s): In the audience. Chairperson Kelty opened the public hearing to those IN FAVOR of this application. Allan Vuu, 3031 Rosemead Place, Rosemead, the property owner, noted that the color of the stone had been changed from brown to gray. He gave a sample of the revised plans to the commissioners for review. Mr. Vuu said that he had worked with staff to meet all requirements. Juan Martinez, 3302 Eckhart Street, Rosemead, a neighbor, said that he was in favor of the project because it would increase property values in the area and beautify the street. Public hearing was opened to those who wished to OPPOSE the application: ILI"01- There being no one further wishing to address the Commission; Chairperson Kelty closed the public hearing segment for this project. MOTION BY COMMISSIONER LOI, SECONDED BY COMMISSIONER HERRERA to APPROVE Conditional Use Permit 04 -967 subject to conditions listed in "Exhibit A ". CONDITIONAL USE PERMIT 04 -977 — 3615 Brookline Avenue. The applicant, Kri sty Tran, is proposing a new 2 -story single - family residence with 4,088 +/- square feet of living area. The proposal, located in the R -1 (Single Family Residential) Zoning District, will include a new attached 3 -car garage. Presentation: Associate Planner Brandi Jones Staff Recommendation: APPROVE- subject to the conditions listed in "Exhibit A" for six (6) months Chairman Kelty called for questions from the Commissioners. None Applicant(s): In the audience. Chairperson Kelly opened the public hearing to those IN FAVOR of this application. Kamen Lai, 8748 East Valley Blvd., #K, Rosemead, represented the applicant. He said changes had been made on the project to meet all the city requirements. He noted that the owner had several children who would be visiting and that they planned to do some entertaining, thus the large size of the house. Mr. Lai said that he had noticed a trend toward larger houses and that he expected them to become more prevalent in the near future. Public hearing was opened to those who wished to OPPOSE the application: Mr. Gonzalez, 3609 Brookline Avenue said his objection was based on the concern that his family would no longer have privacy in their backyard because of the second story windows overlooking from the project. Mr. Loi asked if the size of the windows could be reduced. Planning Director Johnson said that staff would work with the applicant to find ways to mitigate the privacy issue. There being no one further wishing to address the Commission; Chairperson Kelty closed the public hearing segment for this project. The proposal, located in the R -1 (Single - Family Residential) Zoning District, will include a new attached 3 -car garage. He said that, working with staff, the applicant has met all zoning code requirements and is willing to accept all conditions of approval. RESOLUTION 04 -35 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 04 -981, FOR THE TRANSFER OF AN EXISTING ON -SALE GENERAL PUBLIC EATING (TYPE 47) ABC LICENSE IN CONJUNCTION WITH AN EXISTING RESTAURANT, LOCATED AT 8800 GARVEY AVENUE IN THE M -1 (LIGHT MANUFACTURING AND INDUSTRIAL) ZONE. (APN: 5282- 025 -002). B. RESOLUTION 04 -36 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING TENTATIVE TRACT MAP NO. 61208 FOR THE SUBDIVISION OF ONE PARCEL INTO SIX LOTS FOR THE DEVELOPMENT OF FIVE NEW SINGLE - FAMILY RESIENTIAL UNITS. ONE OF THE SIX LOTS WILL SERVE AS THE PRIVATE DRIVEWAY TO PROVIDE INGRESS /EGRESS TO THE DEVELOPMENT LOCATED ON THE 4000 BLOCK OF RIO HONDO AVENUE IN THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONE (APN: 8592- 009 -027). C. RESOLUTION 04 -37 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 04 -980, FOR THE TRANSFER OF AN EXISTING OFF -SALE GENERAL (TYPE 21) ABC LICENSE FOR A LIQUOR STORE, LOCATED AT 8817 VALLEY BOULEVARD IN THE CBD -D (CENTRAL BUSINESS DISTRICT WITH A DESIGN OVERLAY) ZONE. (APN: 5391- 009 -001). D. RESOLUTION 04 -38 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING DESIGN REVIEW 04 -119, FOR THE INSTALLATION OF TWO INTERNALLY ILLUMINATED `MOBIL' SIGNS AND AN INTERNALLY ILLUMINATED FASCIA ON THE EXISTING GAS STATION CANOPY LOCATED AT 8960 VALLEY BOULEVARD (APN: 5390- 012 -063). Chairman Kelty presented the resolution by title only. MOTION BY COMMISSIONER BREEN, SECONDED BY COMMISSIONER LOPEZ, to waive further reading and adopt said resolutions. ORAL COMMUNICATION FROM THE AUDIENCE None. MATTERS FROM CITY OFFICIALS AND STAFF Planning Director Johnson introduced Associate Planner Brandi Jones who was attending her first Planning Commission meeting since officially joining the staff. Planning Director Johnson briefly presented the current status of the Wal -Mart project. City Attorney Price noted that the time limit for challenges to the Wal -Mart project has expired.
