PC-05-16-05CITY OF ROSEMEAD PLANNING COMMISSION REGULAR MEETING MINUTES May 16, 2005 CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order by Chairman Loi at 7:00 p.m. in the council chambers of the Rosemead City Hall at 8838 East Valley Boulevard, Rosemead. Commissioner Breen led the Pledge of Allegiance. Commissioner Lopez delivered the invocation. ROLL CALL: PRESENT: Chairman Loi, Vice - Chairman Lopez, Commissioners Breen, Herrera and Kelty ABSENT: None EX OFFICIO: Johnson, Price and Tone 1. APPROVAL OF MINUTES Minutes of May 2, 2005 MOTION BY COMMISSIONER KELTY, SECONDED BY COMMISSONER HERRERA, that the minutes of the City of Rosemead Regular Planning Commission Meeting of May 2, 2005, be APPROVED as submitted. Vote results: YES: HERRERA, KELTY, LOI and LOPEZ NO: NONE ABSTAIN: BREEN ABSENT: NONE Chairman Loi declared said motion duly carried and so ordered. 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS City Attorney Price explained the public hearing process and the right to appeal Planning Commission decisions to the City Council. 3. PUBLIC HEARING A. CONDITIONAL USE PERMIT 04 -988 — 9109 Guess Street. The applicants, Stephen and Robert Cantrell have submitted a Conditional Use Permit application to construct a new single - family residence, which includes 3,039 square feet of living area and a 504 square foot two -car garage. The single - family residence is located at 9109 Guess Street in the R -1 (Single - Family Residential) zone. Presentation: Planning Director Johnson presented the staff report. Staff Recommendation: APPROVE- subject to the conditions listed in "Exhibit A" for six (6) months. Chairman Loi called for questions from the Commissioners. Commissioner Loi asked if a three -car garage would be required because of the size of the house. Planning Director Johnson replied that according to code a three -car garage was not required. MOTION BY COMMISSIONER HERRERA, SECONDED BY COMMISSIONER LOPEZ to APPROVE Conditional Use Permit 04 -988, subject to conditions listed in "Exhibit A ". CONDITIONAL USE PERMIT 05 -1009 - 8800 Garvey Avenue. Jose Escobar of La Rumba Restaurant has submitted an application requesting approval for the transfer of an existing On -Sale (Type 47) ABC license in conjunction with a restaurant. The subject site is located at 8800 Garvey Avenue, in the M -1 (Light Manufacturing and Industrial) zone. Presentation: Planning Director Johnson presented the staff report Staff Recommendation: APPROVE- subject to the conditions listed in "Exhibit A" for six (6) months. Chairman Loi asked for questions from the Commissioners. Chairman Loi noted that the last Conditional Use Permit issued for this restaurant required the installation of security cameras and he asked if those cameras were still operational. Planning Director Johnson answered that the security cameras are still operational. Applicant(s): In the audience. Chairman Loi opened the public hearing to those IN FAVOR of this application. Jose Escobar, the new owner of La Rumba Restaurant, asked if he would be required to renew the application in six months. Planning Director Johnson explained that the application for dance and live entertainment permits still need to be heard by the City Council but the Conditional Use Permit for transfer of the ABC license will remain in effect as long as all conditions are met. TENTATIVE PARCEL MAP 062909 — 3342 Muscatel Avenue. Foothill Pacific Homes is proposing to subdivide one existing parcel into three parcels for the construction of three new single - family residences. The new residences will be designed in accordance with the City of Rosemead "Flag Lot" Ordinance. The proposed project is located at 3342 Muscatel Avenue in the R -1; Single - Family Residential zone. Presentation: Planning Director Johnson presented the staff report. Staff Recommendation: APPROVE- subject to the conditions listed in "Exhibit A" for two (2) years. Chairman Loi called for questions from the Commissioners. None. Applicant(s): hi the audience. Todd Bowden, Foothill Pacific Homes, Inc., representing the applicant, thanked the Commission for their work on the project and stated that the applicant is agreeable to all conditions of approval. CONSENT CALENDAR —These items are considered to be routine actions that may be considered in one motion by the Planning Commission. RESOLUTION 05 -14 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING CONDITIONAL USE PERMIT 04 -985, FOR THE OPERATION OF AN EDUCATIONAL TUTORING FACILITY, LOCATED AT 3301 SAN GABRIEL BOULEVARD, (APN: 5287- 028 -019). B. RESOLUTION 05 -15 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 05 -1003, APPROVING THE CONVERSION OF AN EXISTING GARAGE TO LIVING AREA AND CONSTRUCTION OF A NEW DETACHED TWO -CAR GARAGE, RESULTING IN A TOTAL LIVING AREA OF 2,666 SQUARE FEET, LOCATED AT 2522 PINE STREET IN THE R -2 (LIGHT MULTIPLE RESIDENTIAL) ZONE. (APN: 5284 -005- 023). C. RESOLUTION 05 -16 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 05 -1005, FOR AN ON- SALE BEER AND WINE (TYPE 41) ABC LICENSE IN CONJUNCTION WITH AN EATING ESTABLISHMENT, LOCATED AT 8450 VALLEY BOULEVARD, #103, IN THE C -31) (MEDIUM COMMERCIAL WITH A DESIGN OVERLAY) ZONE. (APN: 5371- 009 -040). D. RESOLUTION 05 -17 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING DESIGN REVIEW 05 -125, FOR THE INSTALLATION OF TWO INTERNALLY ILLUMINATED CHANNEL LETTER SIGNS LOCATED AT 9142 VALLEY BOULEVARD (APN: 8594- 002 -023). Chairman Loi presented the resolutions by title only. MOTION BY COMMISSIONER HERRERA, SECONDED BY COMMISSIONER LOPEZ, to waive further reading and adopt said resolutions. ORAL COMMUNICATION FROM THE AUDIENCE Barbara Delory, 4030 Bartlett Avenue, asked for a follow up report on the situation at the Valley Hotel. Planning Director Johnson said that a site inspection will be conducted within the next few weeks and a list of corrections compiled. The property owner will be required to make all corrections. 6. MATTERS FROM CITY OFFICIALS AND STAFF Commissioner Lopez asked if Caltrans had been notified about the overgrown vegetation on the west side of Walnut Grove. Planning Director Johnson said that he referred that situation to the City Engineer and that he would request a status report. Commissioner Kelty asked for an update on the Lee's Sandwich project. Planning Director Johnson stated that there had been some delays but that the project is now back on track and that there will be progress within the next week. Commissioner Loi asked about the ongoing graffiti problem. Planning Director Johnson stated that another person has been added to the project and that the city has asked for more emphasis on this situation from the Sheriff's Department.
