PC-06-06-05CITY OF ROSEMEAD PLANNING COMMISSION REGULAR MEETING MINUTES June 6, 2005 CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order by Chairman Loi at 7:00 p.m. in the council chambers of the Rosemead City Hall at 8838 East Valley Boulevard, Rosemead. Commissioner Kelty led the Pledge of Allegiance. Commissioner Herrera delivered the invocation. ROLL CALL: PRESENT: Chairman Loi, Vice - Chairman Lopez, Commissioners Breen, Herrera and Kelty ABSENT: None EX OFFICIO: Johnson, Price and Tone 1. APPROVAL OF MINUTES Minutes of May 16, 2005 MOTION BY COMMISSIONER BREEN, SECONDED BY COMMISSONER LOPEZ, that the minutes of the City of Rosemead Regular Planning Commission Meeting of May 16, 2005, be APPROVED as submitted. Vote results: YES: BREEN, HERRERA, KELTY, LOI and LOPEZ NO: NONE ABSTAIN: NONE ABSENT: NONE Chairman Loi declared said motion duly carried and so ordered. 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS City Attorney Price explained the public hearing process and the right to appeal Planning Commission decisions to the City Council. 3. PUBLIC HEARING A. DESIGN REVIEW 05 -124 — 3373 Rosemead Boulevard. Agnes Chin of the Rosemead Professional Group LLC, has submitted an application for the modification of an existing commercial building to extend the lobby area, enclose the existing stairways, remodel signage and install new landscaping located at 3733 Rosemead Boulevard in the PO -D (Professional Office with a Design Overlay) zone. Presentation: Planning Director, Johnson presented the staff report. Staff Recommendation: APPROVE- subject to the conditions listed in "Exhibit A" for one (1) year. Chairman Loi called for questions from the Commissioners. Chairman Loi asked for a verification of the number of parking spaces for the building. Planning Director Johnson said the number remains at thirty and that the staff report will be corrected to reflect this. Applicant(s): h1 the audience. Chairman Loi opened the public hearing to those IN FAVOR of this application. None. Public hearing was opened to those who wished to OPPOSE the application: None. There being no one further wishing to address the Conumssion; Chairman Loi closed the public hearing segment for this project. MOTION BY COMMISSIONER KELTY, SECONDED BY COMMISSIONER HERRERA to APPROVE Design Review 05 -124, subject to conditions listed in "Exhibit A ". Vote results: YES: BREEN, HERRERA, KELTY, LOPEZ AND LOI NO: NONE ABSTAIN: NONE ABSENT: NONE Chainnan Loi declared said motion duly tamed and so ordered. B. DESIGN REVIEW 05 -126 — Valley Boulevard. Bob Nguyen, representing Rosemead Supermarket has submitted an application for a Design Review for exterior fagade renovations, including construction of a new 3,638 square foot warehouse located at 8815 E. Valley Boulevard in the CBD -D (Central Business District with a Design Overlay) zone. Presentation: Planning Director Johnson presented the staff report and a letter from the attorney for DC Universal, LLC. Staff Recommendation: CONTINUE to the first meeting in July. Chairman Loi asked for questions from the Commissioners. Commissioner Kelty asked for clarification on Item 30 of the Conditions of Approval. Planning Director Johnson said that this issue will be addressed at a later date and recommended deletion of Item 30. Commissioner Kelty asked if there was a problem with unloading of trucks at this location. Planning Director Johnson said that only smaller trucks were used by this supermarket thereby reducing delivery related problems. Applicant(s): In the audience. Chairman Loi opened the public hearing to those IN FAVOR of this application. None. Public hearing was opened to those who wished to OPPOSE the application: Kevin Ennis, attorney representing Eric Lee and DC Universal, and the author of the letter Planning Director Johnson read after the staff report, expressed concern over the conflict on the easement agreement and the number of parking spaces required, elimination of the outdoor loading area and the applicability of the CEQA Categorical exemption. In light of these concerns, Mr. Ennis requested a continuance to allow his client to review the plans for this proj ect Daniel Spedaro, of 4113 Muscatel Avenue, expressed concern about trucks running during the night creating noise, trash, lack of parking on the street and general disorder behind the Supermarket. He suggested that adding a wall between the Supermarket parking lot and residences would alleviate some of these problems. Mr. Spedaro also noted that the trees that once lined the property have been removed. Chairman Loi recognized another person who wished to speak to those IN FAVOR of this application. Allen Vi, representing the applicant, said that Mr. Nguyen understands the concerns expressed and expects that implementing the changes proposed in this Design Review application would serve to reduce or eliminate the problems described. He also noted that Mr. Nguyen is willing to work with DC Universal to devise a mutually satisfactory plan for the parking lot and that the proposed changes will not cause the elimination of any parking spaces. There being no one further wishing to address the Commission; Chairman Loi closed the public hearing segment for this project. . Chairman Loi declared the item CONTINUED to the first meeting in July. 4. CONSENT CALENDAR —These items are considered to be routine actions that may be considered in one motion by the Planning Commission. Any interested party may request an item from the consent calendar to be discussed separately. A. RESOLUTION 05 -18 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 04 -988, APPROVING THE CONSTRUCTION OF A NEW SINGLE - FAMILY RESIDENCE WHICH INCLUDES 3,039 ( + / -) SQUARE FEET OF LIVING AREA AND A 504 SQUARE FOOT ( + / -) TWO - CAR GARAGE, LOCATED AT 9109 GUESS STREET IN THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONE. (APN: 8594- 008 -030). B. RESOLUTION 05 -19 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 05 -1009, FOR THE TRANSFER OF AN EXISTING ON -SALE GENERAL PUBLIC EATING (TYPE 47) ABC LICENSE IN CONJUNCTION WITH AN EXISTING RESTAURANT, LOCATED AT 8800 GARVEY AVENUE IN THE M -1 (LIGHT MANUFACTURING AND INDUSTRIAL) ZONE. (APN: 5282- 025 -002). C. RESOLUTION 05 -20 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING TENTATIVE PARCEL MAP NO. 62909, REQUESTING THE SUBDIVISION OF ONE PARCEL INTO THREE PARCELS FOR THE DEVELOPMENT OF THREE (3) NEW SINGLE FAMILY HOMES, TO BE LOCATED AT 3342 MUSCATEL AVENUE IN THE R -1; SINGLE - FAMILY ZONE (APN: 5289 -012 -040). Chairman Loi presented the resolutions by title only. MOTION BY COMMISSIONER HERRERA, SECONDED BY COMMISSIONER LOPEZ, to waive further reading and adopt said resolutions. Vote results: YES: BREEN, HERRERA, KELTY, LOPEZ AND LOI NO: NONE ABSTAIN: NONE ABSENT: NONE Chairman Loi declared said motion duly carried and so ordered. 5. ORAL COMMUNICATION FROM THE AUDIENCE None. 6. MATTERS FROM CITY OFFICIALS AND STAFF Commissioner Herrera reported overgrown weeds at 3940, 3939, 3937 and 3938 Delta Avenue and graffiti on Valley Boulevard at the vacant New Century property.
