MINUTES
February 2, 2004
CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order
by Chairperson Herrera at 7:00 p.m. in the council chambers of the Rosemead City Hall at 8838 East Valley
Boulevard, Rosemead.
Commissioner Lopez led the Pledge of Allegiance.
Commissioner Kelty delivered the invocation.

1. APPROVAL OF MINUTES Minutes of January 19, 2004
MOTION BY COMMISSIONER KELTY, SECONDED BY COMMISSONER LOPEZ, that the
minutes of the City of Rosemead Regular Planning Commission Meeting of January 19, 2004, be
APPROVED as submitted.

2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS
Deputy City Attorney Stanton Price explained the public hearing process and the right to appeal
Planning Commission decisions to the City Council.
3. ADMINISTRATION OF OATH
The planning secretary administered the oath to members of the audience wishing to speak before the
Planning Commission.
4. PUBLIC HEARING
A. CONDITIONAL USE PERMIT 04 -945 - 3356 Greendale Avenue. Gilbert Espinoza has
submitted an application for the construction of a 2,904± square foot, single - family
residence, located in the R -1 (Single Family Residential) zone.
Presentation: Assistant Planner Jaramillo
Recommendation: APPROVE for one (1) year, subject to the conditions listed
in "Exhibit A ".
Chairperson Herrera called for questions from the Commissioners.

B. TENTATIVE PARCEL MAP 060795 - 8828 Ramona Boulevard. A request by Charles D.
Lines to subdivide a single residential lot into two (2) parcels. This subdivision will create
two (2) parcels with the development of two (2) new single - family residences, located in
the R -1 (Single Family Residential) zone.

Staff Recommendation: APPROVE -for two (2) years subject to the conditions
listed in "Exhibit A"

C. CONDITIONAL USE PERMIT 03- 941/DESIGN REVIEW 03 -111 9400 -9412 E. Valley
Boulevard. A request by Paul Lee for the development of a 7,650± square foot two -story
office/ retail commercial building, located at 9400 -9412 E. Valley Blvd. in the C -31)
(Medium Commercial with a Design Overlay) zone.
Presentation: Planning Director Johnson
Staff Recommendation: APPROVE -for one (1) year subject to the conditions listed
in "Exhibit A"
Chairperson Herrera called for questions from the Commissioners.
Commissioner Kelty asked, in relation to Item 26 of the Conditions, to whom does the
alley belong and would it be necessary to go through the Traffic Commission to get a
stop sign placed there? Planning Director Johnson replied that the city could
authorize placement of a stop sign.
Commissioner Lopez asked if there would be any walkway in the alley or just an
unbroken wall? Planning Director Johnson replied that there will be a solid wall
except for the west end where there will be a gate area for access by trash handlers.
He also noted that the alley is 20 feet wide so the trash trucks back in and
out of the alley.

Chairperson Herrera opened the public hearing to those IN FAVOR of this application.
Mr. Kamen Lai, 8748 E. Valley Blvd., Suite K, Rosemead, the project architect, stated
that the property was very run down and yet had a high asking price which
discouraged developers. This project will improve the area and bring more business
in to the city. He said the applicant is willing to accept all conditions of
approval.
Public hearing was opened to those who wished to OPPOSE the application:
Mr. Giaitung Cong, 3954 Rio Hondo, said that he is a neighbor of this property. He has
been parking in this alley for a long time because there is restricted parking in front of
his house which is marked by a red curb. This project will interfere with his parking
arrangement.
Planning Director Johnson stated that Mr. Cong had come into city hall the previous
week and discussed this situation with him. Planning Director Johnson visited the
site and noted that the red curb, which has been there for many years, was to provide
visibility for motorists making left -hand turns but that perhaps a small segment of the
red curb could be removed.
Chairperson Herrera stated that there is definitely no parking in the alley and
suggested that Mr. Cong take his concerns to the Traffic Commission.
Planning Director Johnson explained the process for referring the issue to the
Traffic Commission.
Angel (no last name), Steele Street, stated his concern over the quality of water in the
area. He said that a well had been opened in front of his house and he was told that
the results of water testing would be posted regularly but these results had not been
posted for a long time. He asked how he could get access to this information.
Planning Director Johnson said that it depends on the type of data you are looking for,
i.e., soil contamination or ground water contamination. In any case, the property can
still be developed without interfering with the EPA monitoring. Director Johnson
offered to contact EPA and arrange posting of results.
Angel also pointed out that he has the same parking problem described by Mr. Cong.
Planning Director Johnson noted that the inoperable cars in the alley can be sited and
even towed away but that the red curb issue must be determined by the Traffic
Commission.
There being no one further wishing to address the Commission; Chairperson Herrera
closed the public hearing segment for this project.
Motion by Commissioner Lopez seconded by Commissioner Kelty to APPROVE
Conditional Use Permit 03 -941 and Design Review 03 -111 for one (1) year subject to
the conditions listed in "Exhibit A ".

D. CONDITIONAL USE PERMIT 99 -776 (MODIFICATION) - 2664 Stingle Avenue,
Unit B. A request by California Charter Academy to modify an existing permit for the
operation of an educational facility located in the M -1 (Light Manufacturing and
Industrial) zone.

Recommendation: APPROVE for one (1) year, subject to the conditions listed in
"Exhibit A ".

Mr. Pat Finari, 2649 Stingle Ave., stated that the street is very crowded and he
feels a traffic signal is required at this site.
Director Johnson stated that he had received a letter about this issue and it
would be referred to the Traffic Commission.

Conditional Use Permit 99 -776 (Modification) for one (1) year, subject to the conditions
listed in "Exhibit A

5. CONSENT CALENDAR —These items are considered to be routine actions that may be

A. RESOLUTION 04 -02 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, DENYING
CONDITIONAL USE PERMIT 03 -936 FOR THE CONSTRUCTION OF A NEW SINGLE
FAMILY RESIDENCE OVER 2,500 SQUARE FEET, LOCATED AT 8617 BLUE CIRCLE IN
THE R -1; LOW DENSITY RESIDENTIAL ZONE. (APN: 5391- 001 -046).
B. RESOLUTION 04 -03 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING
TENTATIVE PARCEL MAP 60159 AND ZONE VARIANCE 03 -324 ALLOWING THE
SUBDIVISION OF ONE PARCEL INTO TWO FOR THE CONSTRUCTION OF TWO SINGLE
FAMILY RESIDENCES WITH LESS THAN THE REQUIRED LOT AREA IN THE R -1; LOW
DENSITY RESIDENTIAL ZONE (APN: 5372- 013 -901).
Chairperson Herrera presented the resolutions by title only.
Motion by Commissioner Breen, seconded by Commissioner Lopez, to waive further reading
and adopt said resolution.
