CC - 09-14-82• 6 MINUTES OF THE REGULAR MEETING OF THE ROSEMEAD CITY COUNCIL, SEPTEMBER 14,-1982 AT 8:00 P.M. tkPP Z Ci'v E D Crry or ►zo_>-.N1LAD .)ATI. 9-8-~~- The Regular Meeting of the Rosemead City Council was called to order by Mayor Pro Tem Cleveland in the Council Chambers of City Hall, 8838 E. Valley Boulevard, Rosemead,,California.at 8:00 p. M. The Pledge to the Flag was led by Councilman Imperial. The Invocation was delivered by Rev. Tom Phillips. ROLL CALL OF OFFICERS: Present: Councilmembers Cichy, Imperial, Taylor and Mayor Pro Tem Cleveland Absent: Mayor Tury (Excused) APPROVAL OF MINUTES: August 24, 1982 - Regular Meeting Councilman Taylor requested that the approval of the minutes be deferred to the next Council Meeting as the first paragraph on page #5 needs additional clarification. There'being no objection, it was so ordered. ORAL COMMUNICATIONS A. Marshall Krupp, Willdan & Associates representative, indicated,that almost all of the funds.for the handyman program have been expended, including this first quarter of..this fiscal year. He commented on discussions with the staff and stated that other avenues are being researched for bringing funds into the program. He stated that there would be a.necesssity for his staff to continue to administer the program because some of these jobs will not be completed until probably the first of the year, but thereafter the administrative costs will be limited,if any, unless there are more funds incorporated into the program. PRESENTATIONS: Mayor Pro Tem Cleveland stated that there would be three presentations made this evening. A Resolution of. Commendation was presented to Deputy Michael Harroun, Sheriff's Department, for saving the life of a man in Beach's parking lot who was found unconscious. Deputy Harroun expressed his appreciation to the Council. A Resolution of Commendation was presented to Troy Holland for his heroic efforts in saving a neighbors home from being de- stroyed by fire. A Resolution proclaiming Constitution Week, September 12th to September 18, 19.82 in the City of Rosemead was presented to Carolyn Rapelje. Mrs. Rapelje expressed appreciation for the proclamation. Councilman Imperial commented on the fact that many people will talk.about police brutality, that kids today are not what they used to be, and statement that people just don't care about the Country any more. He felt that tonight that the people in Rosemead have stood up and can be counted since they have shown that they do care. CM 9-14-82 Page #1 s ~ II. PUBLIC HEARING A. PUBLIC HEARING TO CONSIDER REQUEST FOR AN APPEAL TO THE PLANNING COMMISSIONS DECISION REGARDING AN AMEND- MENT TO A CUP ON PROPERTY LOCATED AT 2451 GLADYS AND 2454 SAN GABRIEL BOULEVARD Mayor Pro Tem.Cleveland opened the Public Hearing and inquired if there was anyone in the audience who would care to speak regard- ing this matter. Don Hardy, 2451 Gladys Avenue, elder of the church, read a letter of. explanation of the modifications of.the plan for the church, and spoke in favor of the approval of.the modified design. Loretta Olea, 2449 N. Gladys, spoke against the approval of:. the modification of the plan. Mayor Pro Tem Cleveland inquired if there was anyone else who would care to speak. No one came forward and the Public Hearing was closed. . Councilman Taylor commented that the biggest issues seem to be the parking and the landscaping, and both are within our code requirements. He inquired about the provisions made for the childrens activities and how long are the services where the children will be.om the premises. Mr. Hardy stated that the children are taken to City.parks to play and the annex will be completely soundproofed and air con- ditioned_as well as the sanctuary, and the children will not come out of the classrooms until about 12:00 or 12:15. He stated that the changes are not outwardly but internally and everything inside will be soundproofed. The.services will start about.9:30 a.m., and another about 10:30a.m. and-,then quit about 12:15. Only on Sunday mornings do the numbers swell to 250. Councilman Imperial stated that he had _.no-problem with churches providing that they can provide enough area around them not to dis- turb anyone. He did not feel that this area could hold 250 partici- pants, and wondered what would happen if the parks in the area could not accomod'ate these children. Councilman Cichy stated their objectives are to.service more people and he did not.feel`that the Council should discourage their attempts to increase their population,.as long as they work within the confines of the City's code. The issue before the.Council is whether the plan is approved, disapproved or modified. He did feel that the parking could be split up and made more-attractive and they have offered to compromise and the compromise should be accepted and number of parking spaces should be decreased and additional landscap- ing be added. . Councilman Taylor suggested that the strip parking on the north side of the lot be divided into three sections with islands in between with.the elimination of one parking stall. Councilman Taylor made a motion to uphold the appeal of the Church with the elimination of a parking stall and divided into three sections with two islands of landscaping. Councilman Cichy felt that there should be additional landscap- ing and elimination of parking spaces on the back side of the lot, and requested additional input from the Planning Department or addi- tional recommendations from the Council to add more green space. Councilman Cichy stated that he would make a.second to the motion if modification could be made and the Planning Department could come.back with additional ideas on how to add a certain percentage in landscaping. . CM 9-14-82 Page #2 • i MOTION BY COUNCILMAN TAYLOR', SECONDED BY COUNCILMAN CICHY that the appeal of the Church be upheld, approve the amended plan date stamped, June 6, 1982, with the deletion of four park- ing spaces to be replaced for landscaping to the satisfaction of the Planning Director. Vote resulted: AYES: Councilmen Cichy, Taylor and Mayor Pro Tem Cleveland NAPES: Councilman Imperial ABSENT: Mayor Tury ABSTAIN: None Whereupon the Mayor declared said motion duly carried and so ordered. Councilman Taylor requested that the minutes reflect that this is an approval of the ;occupancy of 250 people. Councilman Imperial requested that the minutes show that his "no" was because he.was looking, down-the road from.one to five years. He stated that Amberwood was built as a giant condominium and where parking was required on Walnut Grove and San Gabriel, but at that time did not look down the road.- He.commented on the fact that a past Councilman stated that this should have been looked at, and we did not. Councilman Imperial stated that he hoped that this was looked at correctly:.because there have been enough problems engineered in this City and we don't need any more,and a big part of those are parking. B. PUBLIC HEARING TO CONSIDER.AN AMENDMENT TO THE ROSEMEAD .MUNICIPAL CODE RELATING TO REGULATIONS OF THE GARAGE/ YARD SALES IN RESIDENTIAL ZONES . Mayor Pro Tem Cleveland stated that the Public Hearing was open and inquired if there was anyone in the audience who would care to speak regarding this matter. . Juan Nunez, 2702 Del Mar, inquired about the responsibility of removing the signs advertising the Garage/Yard sales and he did not feel that it should be done by a City employee if it is not done by the applicant. Mayor Pro Tem Cleveland stated that this could'be handled at the time that the application is requested.. The applicant could be informed that it would be a violation of the law if signs are not removed in a timely manner. Mayor Pro Tem Cleveland inquired if there was anyone else who would care to speak.regarding this subject matter. No one came forward, and the Public Hearing was'closed. MOTION BY COUNCILMAN CICHY, SECONDED BY COUNCILMAN TAYLOR that the City Council accept and concur with the environmental declaration reached by the Planning Commission. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. The, following Ordinance was introduced on its first reading: ORDINANCE NO. 554 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD AMENDING THE MUNICIPAL CODE TO,PROVIDE FOR GARAGE/YARD . . . SALES IN RESIDENTIAL ZONES MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN CICHY that Ordinance No. 554 that be introduced on its first reading and the reading in full be waived. PUBLIC HEARING TO CONSIDER ADOPTION OF RESOLUTION OF NECESSITY FOR ACQUISITION OF RIGHT OF WAY FOR IMPROVEMENT FOR DEL MAR AVENUE, PUBLIC STREET Mayor Pro Tem Cleveland stated that.:the Public Hearing was open and inquired if there.was anyone in the audience who would care to speak regarding this subject.matter. Richard LeRoy, 3351 Del Mar Avenue,.stated that the red curb that is being considered in front of his place of business, would just close down his business. John Maulding., City Engineer, stated that there is a left-turn pocket planned and -it.can be designed without a red curb, however, this being a FAU project is subject to the approval of the State and Federal Government. He stated that there is a likelihood that they would require a red curb since there is a left-turn pocket. Richard LeRoy stated that he was told that his doors all have to be changed to all open in and none to open out. Councilman Taylor requested that staff report.as to what the requirement.is as to red curb. If this is not mandatory, he can agree with Mr. LeRoy and the detriment to his business,without access to the front. The street will be improved and needs to be improved, but if it doesn't have to.be red curbed he would try to keep it off of there. But if it needs to be there for .a safety purposes, then it may need.to be red. Richard LeRoy stated that they..are planning to leave the front of his building in place instead of taking the front of his build- ing in order to have a full amount for the sidewalk to be what it should be.then there would be no problem of how the doors open. Councilman Taylor inquired if that meant that his building would be setting in the right-of-way. Mr. LeRoy stated that was correct. Councilman Taylor inquired as to how many properties would be in that condition? John Maulding stated that there are four properties there. that are being utilized with encroachment permits, and this again is subject to review of the State and Federal Governments. Mr. LeRoy stated that this was not handled properly,and the property line should not be zig-zagged. Councilman Taylor requested that these four parcels that were mentioned and any,similar parcels be.brought back,to this Council with clarification of what is specifically going to be done, and also a reappraisal of the properties. Dorothy LeRoy stated that she had been told there was.going to be red curb on both sides of the street. Daniel Segura, 3322 N. Del Mar, public accountant, also ques- tioned the parking and the red curbs. Councilman Taylor stated that he felt that this Public Hearing should be continued as there have been items'brought out that he had not been aware of.such as these building being.randomly pro- jecting out. Mayor Pro.Tem Cleveland stated that this Hearing will be con- tinued to the next regular meeting. Mr. LeRoy stated he received a notice that the street was going to be closed down within about two days, and felt that he should have been notified more than a few days in advance." Councilman Taylor stated that was a valid point and staff should put in their memos that there should.be a two week notice. CM 9-14-82 Page #4 Mayor Pro Tem Cleveland stated that this Hearing will be continued to September 28, 1982 at 8:00,p. m. Councilman Taylor stated.that the cost of reappraisals should be authorized. There being no-objections, it was so ordered. D. PUBLIC HEARING FOR CONFIRMATION OF ASSESSMENTS ON JACKSON AVENUE (HELLMAN & GRAVES) Mayor Pro Tem Cleveland stated that the Public Hearing was open and inquired if there was anyone in the audience who would care to speak regarding this subject matter. There being no one,.the Public Hearing was closed. Robert Dickey, Assistant City Manager, stated that with re- spect to Exhibit A there are three properties in`which assessments should be modified and.has been determined from the records and checking of.photographs, these improvements were in place prior to construction, and therefore no assessments should be rendered. The properties 'are:.•Wing C'-and-Jung Guey Chong, 2463 Jackson and 2471 Jackson, and Bernard and Sally B. Ancheta at 3015 Jackson. He recommended-approval with those deletions. The following Resolution No. 82-41 be adopted: RESOLUTION NO. 82-41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD CALIFORNIA, CONFIRMING THE STREET SUPERINTENDENT'S REPORT AND ASSESSMENTS THEREIN . MOTION BY COUNCILMAN CICHY, SECONDED BY MAYOR PRO TEM CLEVELAND that Resolution No. 82-41 be adopted. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. Councilman Taylor_requested.a report.on-CC-G from staff on the billings that the City has had for the past two years from ACCO. CC-A MUSCATEL & GLENDON.WAY--ROADWAY & CURB REFLECTORS Councilman Imperial stated that he felt that this'was a dangerous street and that there should be a stop sign there, and he felt that curb reflectors are not adequate. MOTION BY COUNCILMAN TAYLOR, SECONDED BY.COUNCILMAN CICHY that roadway and curb reflectors.be installed at Muscatel and Glendon Way. Vote resulted: AYES: 'Councilmen Cichy, Taylor and Mayor Pro Tem Cleveland NAYES: Councilman Imperial ABSENT: Mayor Tury ABSTAIN: None Whereupon the Mayor declared said motion duly carried and so ordered. Councilman Imperial requested that. the record show that the reason for his "no" vote was because it doesn't go far enough. CC-H AUTHORIZATION TO MAKE PAYMENT FOR DELINQUENT'PREFUSE ACCOUNTS Councilman Taylor stated that there are City employees that have not paid their refuse bills and members of the Chamber of Commerce who have also not paid their refuse bills. He requested that staff check into this and find out what is going on. MOTION BY COUNCILMAN CICHY, SECONDED BY MAYOR PRO TEM CLEVELAND that the delinquent refuse accounts be paid. CC-I AUTHORIZATION TO ATTEND NATIONAL LEAGUE OF CITIES TELECOMMUNICATIONS SEMINAR SEPTEMBER 20-22, 1982 IN SEATTLE Councilman Taylor stated that he just intended to vote no on it because he could not see the need for staff to go to Seattle for a Cable TV or telecommunications seminar. Tripepi, City Manager, stated although he could not respond for the Councilmembers, but he stated that the only interest that has been indicated from the staff standpoint is the City Attorney who is interested in attending that. MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN CICHY that a member of the staff be authorized to attend the National League of Cities Telecommunications Seminar in Seattle from Septem- ber 20 to 22, 1982. V. MATTERS FOR DISCUSSION & ACTION A. Section 8110, Rosemead Municipal Code MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL that Section 8110-be amended as recommended to $10,000. Vote re- sulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared.said motion duly carried and so ordered. Robert Kress, City.Attorney, stated that an ordinance will be prepared for the next.Council Meeting. B. CABLE TV ENABLING ORDINANCE Councilman Imperial stated that he did not feel that, there was enough'information available to.vote on an ordinance at this time; and if staff brings back more information for a later date it would be more suitable, and he felt that there should be a full council to make the decision. Councilman Taylor agrees with Mr. Imperial and also to wait to see what is brought back from the seminar in Seattle. Robert Kress,. City Attorney, stated that he would be happy to further explain the portion of the proposed ordinance that may need clarification. He stated that he and the City Manager are checking into other alternatives as well. This item was deferred. VI. MATTERS FROM OFFICIALS A. Councilman Taylor stated that at the last meeting he had requested information regarding Newmark Street and Fern St.. A report was received on Jackson Street,.but he would like the staff to.review the drainage on 'Newmark and provide the report back on Newmark. Street, from.Jackson to Del Mar. B. Councilman Imperial stated that he had received a letter from the Department of.Veterans Affairs requested that all City Council's declare November as National Veterans.Recognition'Month. He requested a proclamation be prepared declaring the month of November as National Veterans Recognition Month. There being no objection, it was so ordered. C. Councilman Cichy requested a written report from staff on the three locations of abandoned vehicles and unsiteliness on Glendon Way. . There being no further business to handle the Council Meeting was adjourned to the next regular Meeting on September 28, 1982 at 8:00 p. m.
