PLANNING COMMISSION REGULAR MEETING
MINUTES
June 7, 2004
CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order
by Chairman Kelty at 7:00 p.m. in the council chambers of the Rosemead City Hall at 8838 East Valley
Boulevard, Rosemead.
Commissioner Loi led the Pledge of Allegiance.
Commissioner Breen delivered the invocation.

1. APPROVAL OF MINUTES Minutes of May 5, 2004
MOTION BY COMMISSIONER BREEN, SECONDED BY COMMISSONER LOI, that the minutes
of the City of Rosemead Regular Planning Commission Meeting of May 5, 2004, be APPROVED
as submitted.

2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS
Planning Director Johnson explained the public hearing process and the right to appeal Planning
Commission decisions to the City Council.
3. ADMINISTRATION OF OATH
The planning secretary administered the oath to members of the audience wishing to speak before the
Planning Commission.
4. PUBLIC HEARING
A. DESIGN REVIEW 01 -89 & ZONE VARIANCE 01 -303 (EXTENSION — 8548 East Valley
Boulevard. Kenneth I. Gross has submitted a request for a one -year extension of Design Review
01 -89 and Zone Variance 01 -303 for the construction of a McDonald's Restaurant with drive -
through service and indoor Playplace located in the C3 -D (Medium Commercial District in a
Design Overlay) zone.
Continued to June 21, 2004.
B. CONDITIONAL USE PERMIT 03 -944 - 3809 Brookline Avenue. The applicant, Ka Wo Chan,
is proposing a 2 -story residential addition with 2,962 +/- square feet of living area. The proposal,
located in the R -1 (Single Family Residential) Zoning District, will include anew detached 2 -car
garage.
Continued to June 21, 2004.
C. PLANNED DEVELOPMENT REVIEW 94 -07 - 8451 Mission Drive, 8457 -8461 Mission Drive,
4703 -4717 Willard Avenue. The property owners have submitted an application to modify the
approval of Planned Development Review 94 -07. The property is located in the P -D (Planned
Development) zone.

Staff Recommendation: APPROVE -for one (1) year subject to the conditions listed
in "Exhibit A"
Chairman Kelty called for questions from the Commissioners.
Chairman Kelty noted that the plans showed the concrete stopping at the street and
said that he assumes it actually stops at the fence. Planning Director Johnson
confirmed this.

Chairperson Kelty opened the public hearing to those IN FAVOR of this application.
Mr. Tran, 8461 Mission Avenue, displayed photographs showing the improved
drainage as a result of the concrete yard. Mrs. Chu, 8451 Mission Avenue, noted that a
neighbor's large tree covers most of her yard and that nothing can grow under it.
Therefore, the yard was always covered in mud until she filled it in with concrete.
Planning Director Johnson explained that concrete yards are not permitted by the City
Code but exceptions have been made in some instances for recreational purposes.
Public hearing was opened to those who wished to OPPOSE the application:
Dolly Leong, 8455 Mission Avenue, introduced herself as the original owner and
developer of the homes in question. Mrs. Leong expressed her concern over the
potential for more serious drainage problems if the concrete yards are approved.
Chairman Kelty noted that the solution suggested in the Staff Report was to install
planters in the back yards. Mrs. Chu expressed her objections to this idea.
Commissioner Loi suggested that the case be continued to allow time for him to
inspect the properties.
There being no one further wishing to address the Commission; Chairperson Kelty closed
the public hearing segment for this project.
MOTION BY COMMISSIONER LOI, SECONDED BY COMMISSIONER BREEN to
CONTINUE Planned Development Review 04 -01 to June 21, 2004.

D. ZONE VARIANCE 97 -279 (MODIFICATION) - 2426 -2428 Denton Avenue. Wayne Wong has
submitted an application for a variance from Rosemead Municipal Code Section 17.20.070 to
construct two new residential units on a property with less than the required rear yard setback for
the rear unit. The subject property is located in the R -2 (Light Multi - Family Residential) zone.

Chairman Kelty called for questions from the Commissioners.
Chairman Kelty noted that the front house shows basically no backyard on the plans.
Project Architect Kaimen Kai, representing the applicant, explained that it was done this
way to provide more separation between the two houses. He also noted that the
applicant is willing to accept all conditions.

A RESOLUTION 04 -15 - A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA,
APPROVING CONDITIONAL USE PERMIT 04 -947, APPROVING THE
CONSTRUCTION OF A NEW SINGLE - FAMILY RESIDENCE WITH 3,559 ( + / -)
SQUARE FEET OF LIVING AREA, LOCATED AT 3238 MUSCATEL AVENUE IN
THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONE. (APN: 5289- 012 -050).
B. RESOLUTION 04 -16 - A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA,
APPROVING PLANNED DEVELOPMENT REVIEW 04 -01, APPROVING THE
CONSTRUCTION OF TWO ADDITIONAL CLASSROOMS, LOCATED AT 7600
GRAVES AVENUE IN THE P -D (PLANNED DEVELOPMENT) ZONE. (APN: 5285-
016 -020).
Chairman Kelty presented the resolutions by title only.
MOTION BY COMMISSIONER BREEN, SECONDED BY COMMISSIONER HERRERA, to waive
further reading and adopt said resolutions.

MATTERS FROM CITY OFFICIALS AND STAFF
Planning Director Johnson asked the Commissioners about vacation plans that might conflict with a
planned EIR Study Session on July 7 and a Planning Commission Meeting on August 16.
Commissioner Breen said that he would be leaving for vacation on July 7 and would be gone for two
weeks. It was agreed to reschedule the Study Session to July 19.
Chairman Kelty asked if City Hall would be closed on July 5 due to the July 4 holiday. Planning
Director Johnson explained that City Hall will be closed but the Planning Commission meeting will be
held on Tuesday, July 6.
Commissioner Herrera mentioned the weeds in the vacant lot on Delta Avenue and Planning Director
Johnson agreed to report it.
ADJOURNMENT
There being no other business to come before the commission, the meeting was adjourned at 7:55 p.m. The
next meeting will occur on Monday, June 21, 2004, at 7:00 P.M.
