PC-07-06-04CITY OF ROSEMEAD PLANNING COMMISSION REGULAR MEETING MINUTES July 6, 2004 CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order by Chairman Kelty at 7:00 p.m. in the council chambers of the Rosemead City Hall at 8838 East Valley Boulevard, Rosemead. Commissioner Loi led the Pledge of Allegiance. Commissioner Lopez delivered the invocation. ROLL CALL: PRESENT: Chairman Kelty, Commissioner Herrera, Commissioner Loi and Commissioner Lopez ABSENT: Commissioner Breen EX OFFICIO: Johnson, Jaramillo, Price, Donovan and Tone 1. APPROVAL OF MINUTES Minutes of June 21, 2004 MOTION BY COMMISSIONER LOI, SECONDED BY COMMISSONER HERRERA, that the minutes of the City of Rosemead Regular Planning Commission Meeting of June 21, 2004, be APPROVED as submitted. Vote results: YES: HERRERA, KELTY, LOI AND LOPEZ NO: NONE ABSTAIN: NONE ABSENT: BREEN Chairman Kelty declared said motion duly carried and so ordered. 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS City Attorney Price explained the public hearing process and the right to appeal Planning Commission decisions to the City Council. 3. ADMINISTRATION OF OATH The planning secretary administered the oath to members of the audience wishing to speak before the Planning Commission. 4. PUBLIC HEARING A. TENTATIVE TRACT MAP 61005 /CONDITIONAL USE PERMIT 04 -950 — 3313 -3319 Del Mar Avenue. Michael Sun has submitted an application for a Tentative Tract Map to subdivide two (2) parcels into fifteen (15) residential lots for the development of fifteen (15) townhome units. The proposed residences will range from 1,166 — 1,410 square feet of living area. Continued to July 19, 2004. B. PLANNED DEVELOPMENT REVIEW 94 -07 (MODIFICATION) — 8451 Mission Drive, 8457- 8461 Mission Drive and 4703 -4717 Willard Avenue. The property owners at 8451 Mission Drive, 8457 -8461 Mission Drive, and 4703 -4717 Willard Avenue, located in the P -D (Planned Development) zone, have submitted an application to modify the approval of Plan Development Review 94 -07. The applicants are proposing to modify the approved landscaped areas of the rear yards. Presentation: Planning Director Johnson Staff Recommendation: APPROVE -for one (1) year subject to the conditions listed in "Exhibit A" Chairman Kelty called for questions from the Commissioners. City Attorney Price noted that the recommendations of the Commission regarding the seven units that submitted the application will also apply to the two units that were not included in the application. Chairperson Kelly opened the public hearing to those IN FAVOR of this application. 10ro m Public hearing was opened to those who wished to OPPOSE the application: Dolly Leong, 8455 Mission Drive, Rosemead, read a letter describing her opposition to this project and a brief history of related events. Copies of the letter were distributed to the Commissioners. Planning Director Johnson pointed out that this is a PD zone so the back yards are smaller than in an R -1 zone and different regulations apply. Commissioner Herrera questioned the efficiency of the drainage system at the site. Building Official Donovan stated that he visited the site and noted that the water drains to the street. He further stated that the placement of concrete slabs and planters would not effect drainage as there is enough slope on all lots to channel water to the street. Planning Director Johnson said that the installation of planters could be made a condition for approval of the application. He also suggested a thirty day timeframe for compliance. Juan Nunez, 2702 Del Mar Avenue, Rosemead, expressed concern regarding clean -up at the site. There being no one further wishing to address the Commission; Chairperson Kelty closed the public hearing segment for this project. DESIGN REVIEW 04 -115 /ZONE VARIANCE 04 -326 - 8779 Valley Boulevard. The applicant, Tuan Pham, has submitted design review and zone variance applications for the development of a 3,500 + /- square foot bakery /sandwich establishment with a drive through window, located at 8779 Valley Boulevard located in the C -3 D (Medium Commercial with a Design Overlay) zone. Included with the application is a zone variance to allow the proposed establishment with less than the required parking. Presentation: Assistant Planner Jaramillo Staff Recommendation: APPROVE -for one (1) year subject to the conditions listed in "Exhibit A" Chairman Kelty called for questions from the Commissioners. Commissioner Loi asked the number of parking spaces on this property. Planning Director Johnson said the plans show 40 spaces. Commissioner Loi asked how many spaces belong to Mr. Baguette. Planning Director Johnson responded that about 20 to 30 spaces belong to Mr. Baguette. Commissioner Kelty asked about the patio walls. Mr. Tuan Phan, 18010 Sky Park Circle, Irvine, the project architect, said that the patio walls would be made of stucco and would be kept low in case of fire so that a gate would not be necessary. Commissioner Kelty also asked about the shut off feature on the computers. Mr. Phan briefly described the procedure. Applicant(s): In the audience. CONDITIONAL USE PERMIT 03 -944 - 3809 Brookline Avenue. The applicant, Ka Wo Chan, is proposing a 2 -story residential addition with 2,962 +/- square feet of living area. The proposal, located in the R -1 (Single Family Residential) Zoning District, will include a new detached 2 -car garage. Continued to July 19, 2004. 5. CONSENT CALENDAR —These items are considered to be routine actions that may be considered in one motion by the Planning Commission. Any interested party may request an item from the consent calendar to be discussed separately. A. RESOLUTION 04 -18 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, RECOMMENDING CITY COUNCIL APPROVAL OF ZONE CHANGE 03 -217 AND TENTATIVE TRACT MAP 60158 FROM R -1 (SINGLE - FAMILY) RESIDENTIAL ZONE TO PD (PLANNED DEVELOPMENT) ZONE FOR THE SUBDIVISION OF 4 PARCELS INTO 13, LOCATED AT 8470 MISSION DRIVE (APNs: 5372- 016 -021, 022, 023, 038). B. RESOLUTION 04 -19 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 02 -863 (MODIFICATION) FOR THE DEVELOPMENT OF A MIXED -USE MINI- STORAGE AND INDUSTRIAL COMPLEX LOCATED AT 2401 PINE STREET & 2447 SAN GABRIEL BOULEVARD IN THE M -1 (LIGHT MANUFACTURING) ZONE. (APN: 5284- 006 -800, 802, 803, 805; 5284- 012 -801). Chairman Kelty presented the resolution by title only. MOTION BY COMMISSIONER LOPEZ, SECONDED BY COMMISSIONER LOI, to waive further reading and adopt said resolutions. COMMUNICATION FROM THE AUDIENCE Juan Nunez, 2702 Del Mar, Rosemead, said he was collecting signatures on a petition to keep the cross in the California State seal. City Attorney Price explained that involvement as a Commission was inappropriate but as an individual, it would be acceptable. MATTERS FROM CITY OFFICIALS AND STAFF Planning Director Johnson noted that the public comment period on the Wal -Mart EIR ended July 2, and now the environmental consultant will reply to comments. He said that the project should be before the commission in mid - August and that the rules for running the public meeting will be reviewed before then. He said that the city has applied to Rosemead High School for use of their auditorium for this meeting. ADJOURNMENT There being no other business to come before the commission, the meeting was adjourned at 8:10 p.m. The next meeting will occur on Monday, July 19, 2004, at 7:00 P.M. BWJ /BT
