PC-09-20-04CITY OF ROSEMEAD PLANNING COMMISSION REGULAR MEETING MINUTES September 20, 2004 CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order by Chairman Kelly at 7:00 p.m. in the council chambers of the Rosemead City Hall at 8838 East Valley Boulevard, Rosemead. Commissioner Lopez led the Pledge of Allegiance. Commissioner Herrera delivered the invocation. ROLL CALL: PRESENT: Chairman Kelly, Commissioner Breen, Commissioner Herrera, Commissioner Loi and Commissioner Lopez ABSENT: None EX OFFICIO: Johnson, Jaramillo, Price, and Tone 1. APPROVAL OF MINUTES Minutes of July 19 and August 16, 2004 MOTION BY COMMISSIONER LOI, SECONDED BY COM 41SSONER HERRERA, that the minutes of the City of Rosemead Regular Planning Commission Meeting of July 19 and August 16, 2004, be APPROVED as submitted. Vote results: YES: BREEN, HERRERA, KELTY, LOI AND LOPEZ NO: NONE ABSTAIN: NONE ABSENT: NONE Chairman Kelty declared said motion duly carried and so ordered. 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS City Attorney Price explained the public hearing process and the right to appeal Planning Commission decisions to the City Council. 3. PUBLIC HEARING A. CONDITIONAL USE PERMIT 04 -969 — 9544 Valley Boulevard. Jose R. Rivera of Rancho Los Magueyes has submitted a conditional use permit application for the transfer of an On -Sale Beer & Wine (Type 41) ABC license in conjunction with an eating establishment, located in the C -3 D (Medium Commercial within a Design Overlay) Zone. Presentation: Planning Director Johnson Staff Recommendation: APPROVE -for one (1) year subject to the conditions listed in "Exhibit A" Chairman Kelty called for questions from the Commissioners. Commissioner Herrera asked what was being done about the trash on this property. Planning Director Johnson explained that the trash is generated by the car wash which shares the property as a co- renter. He further explained that the car wash is for sale and suggested adding a requirement for clean up within thirty (30) days to the Conditions of Approval. Applicant(s): In the audience. Chairperson Kelly opened the public hearing to those IN FAVOR of this application. Stan Czeto,1300 East Main, #109, Alhambra, CA 91801, represented the applicant, Jose Rivera. He stated that Mr. Rivera is willing to accept all conditions listed. He further asked that problems with the car wash be referred to car wash owner rather than his client. Planning Director Johnson noted that the illegal sign issue with the car wash can be addressed by Code Enforcement. Commissioner Breen asked about the illegal patio cover. Planning Director Johnson said that Mr. Rivera can work with the property owner on this issue. Commissioner Loi suggested that this item be continued until the next meeting to give the applicant and property owner an opportunity to address the issues of trash, illegal signs and the illegal patio cover. CONDITIONAL USE PERMIT 04 -961 8419 East Garvey Avenue (DBA City Tech Auto Repair). Ricky Thai, DBA City Tech Auto Repair, has submitted an application for the expansion of an existing auto repair business in the M -1; Light Manufacturing and Industrial Zone. This project consists of improving a currently vacant lot that sits adjacent to the north of the existing commercial, auto repair business. TENTATIVE TRACT MAP 61005 /CONDITIONAL USE PERMIT 04 -950 — 3313 -3319 Del Mar Avenue. Michael Sun has submitted an application for a Tentative Tract Map to subdivide two (2) parcels into fifteen (15) residential lots for the development of fifteen (15) townhome units. The proposed residences will range from 1,166 — 1,410 square feet of living area. Presentation: Planning Director Johnson Staff Recommendation: APPROVE -for two (2) years subject to the conditions listed in "Exhibit A" Chairman Kelty called for questions from the Commissioners. None. Applicant(s): In the audience. Chairperson Kelty opened the public hearing to those IN FAVOR of this application. Michael Sun, Project Architect, said that this project was begun about a year ago. He also said that the applicant has read and agrees to all conditions. Public hearing was opened to those who wished to OPPOSE the application: Daniel Deng, 3303 Del Mar Avenue, Rosemead, said that his property is next to the site. He expressed concern about traffic noise and safety on Del Mar. He also questioned whether these units would be affordable. Michael Sun replied that the size of these units will be 1100 to 1400 square feet and that since these units will be small they will be affordable. There being no one further wishing to address the Commission; Chairperson Kelty closed the public hearing segment for this project. MOTION BY COMMISSIONER BREEN, SECONDED BY COMMISSIONER LOI to APPROVE TENTATIVE TACT MAP 61005 /CONDITIONAL USE PERMIT 04 -950, for two (2) years, subject to the conditions listed in "Exhibit A" as modified. Vote results: YES: BREEN, HERRERA, KELTY, LOI AND LOPEZ NO: NONE ABSTAIN: NONE ABSENT: NONE Chairman Kelly declared said motion duly carried and so ordered. D. CONDITIONAL USE PERMIT 03 -944 - 3809 Brookline Avenue. The applicant, Ka Wo Chan, is proposing a 2 -story residential addition with 2,962 +/- square feet of living area. The proposal, located in the R -1 (Single Family Residential) Zoning District, will include a new detached 2 -car garage. Application withdrawn by applicant. E. TENTATIVE PARCEL MAP 60733(formerly 60732) /CONDITIONAL USE PERMIT 04 -978 - 3906 Earle Avenue. Steven Van has submitted an application for a Tentative Parcel Map to subdivide one parcel into four (4) residential lots for the development of four (4) new single - family residences; one of the four units requires a Conditional Use Permit for having more than 2,500 square feet of living area. The proposed residences will range from 2,495 - 2,755 square feet of living area. Presentation: Planning Director Johnson Staff Recommendation: APPROVE -for two (2) years subject to the conditions listed in "Exhibit A" Chairman Kelty called for questions from the Commissioners. Planning Director Johnson made a recommendation that the conditions be modified to require monitoring by an arborist during the final stages of the project. Applicant(s): In the audience. Chairperson Kelty opened the public hearing to those IN FAVOR of this application. Kamen Lai, Project Architect, said that the applicant agrees to all conditions except condition #37 which requires a setback of ten feet for the second story. The setback on the plans is 8 -1/2 to 9 feet, which he feels is sufficient. After general discussion among the Commissioners it was decided to delete condition #37 and accept the setback as shown on the plans. CONSENT CALENDAR —These items are considered to be routine actions that may be considered in one motion by the Planning Commission. RESOLUTION 04 -24 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 04 -962 FOR THE CONVERSION OF AN EXISTING ASSISTED -LIVING FACILITY INTO A PRESCHOOL, LOCATED AT 2600 -2608 NEW AVENUE IN THE R -3 (MEDIUM MULTI - FAMILY RESIDENTIAL) ZONE. (APN: 5285- 008 -023). Chairman Kelty presented the resolution by title only. MOTION BY COMMISSIONER LOPEZ, SECONDED BY COMMISSIONER LOI, to waive further reading and adopt said resolutions.
