The regular Meeting of the Rosemead City Council was called to order by Mayor Tury at 8:00 p. m., in the Council Chambers of City Hall, 8838 E. Valley Blvd., Rosemead, California. The Pledge to the Flag was led by Councilman Taylor. The Invocation was delivered by Rev. Jim Kehrli. ROLL CALL OF OFFICERS: Present: Councilmen Cichy, Cleveland, Imperial,Taylor-and'::'..1 Mayor Tury Absent: None APPROVAL OF MINUTES: April 20, 1982 - Adjourned Meeting MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL that the Minutes of the Council Meeting of April 20, 1982 be approved. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. APPROVAL OF MINUTES: April 27, 1982 - Regular Meeting Councilman Taylor requested that a clarification be made in paragraph one on.page 4 which would add-the words "in the park" after products and the word "individual" between for and profit. The paragraph would then read: Councilman Taylor requested that the record show that he does agree with the concept of trying to get community involvement but he does have reservation about people selling products in the park.for individual profit. He is not-again st any..individual, but he has reservations about what is being done. He also requested that on page 5 paragraph 4 should read as follows: Councilman Taylor stated that he would also like included in that letter a request for the list of the names of the cities that were provided bilinqual translations by Martin & Chapman MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN CICHY>,~/ that the Minutes of the Council Meeting of April 27, 1982 be ap- proved as corrected. PRESENTATIONS: DAUGHTERS OF THE AMERICAN REVOLUTION Mrs. Mark Neville, Daughters of the American Revolution, intro- duced Naseri Lutti, San Marino Chapter of the DAR speakers staff, who spoke on the voice of Democracy, and shared some thoughts re- garding the Constitution of the United States, and read a message from the President of the United States, Ronald Reagan. Mrs. Mark Neville introduced Richard Torres, fifth grade stu- dent of Savannah School, who presented his essay "The Constitution Is Important To Me Because". He will be traveling to Sacramento to speak to Assemblywoman Tanner for his First Place Winning of the DAR Essay. Mayor Tury complimented Richard Torres on his essay. Mrs. Neville presented a plaque to Councilman'Jay Imperial in recognition of his outstanding efforts in patriotic endeavors by giving time and talent for the cause of faith, hope and love for humanity. Councilman Imperial expressed his appreciation for the honor bestowed upon him by the DAR and he stated that he felt that this was one of the highlights of his life as he has always felt that he was lucky to be born an American and have a chance to live in freedom and be able to raise his family the same way. CM 5-11-82 Page #1 • • I. ORAL COMMUNICATIONS A. Bob Bruesch, 3126 Isabel Avenue, commented on the trash problems.that effect the city schools. He stated that he felt that the proximity of Encinita School to Rosemead Park was a major cause of the problem, and he stated that he felt that a fence might alleviate the problem. He requested a copy of the letter that was sent to the School Board by Mayor Tury. Mayor Tury stated that he would check with the City Attorney and if the letter was public information he would see to it that he would receive a copy. Frank G. Tripepi, City Manager, inquired if Mr. Bruesch had discussed this problem with the Rosemead School Board last week at their meeting for the first time. Mr. Bruesch'stated it was. Frank G.. Tripepi stated that as a result of Council direction at the last meeting there was additional patrol made at that parti- cular"location, and it was 'discovered that the problem does not seem to start at the park and over-flow to the school, but the problem seems to begin at the school property and over-flows to the Park. He commented that this Council has authorized additional personnel to work on week-ends to do nothing but clean up the parks so that they may be utilized by the residents that use parks in the fashion that they are designed to be used. Mr. Bruesch stated that he felt that the volley ball courts and the hand ball courts should be expanded at the parks. Lt. John Phillips stated,that units were made aware of the problem at the school and there were several arrests made both on the.school site and at the paik related to alcohol and mari- juana and additional offenses as well. He stated that they would continue to provide extra enforcement there. He stated that six were adults and one was a juvenile. Councilman Taylor requested that a follow-up report be pre- sented at the next Council Meeting.to see what has transpired in the next two week period. II. PUBLIC HEARINGS A. PUBLIC HEARING. TO CONSIDER AN EXTENSION OF THE MORATORIUM ON APPROVAL OF ALL ZONING AND INSPECTION OF ALL ADULT BUSINESSES WITHIN ROSEMEAD .Mayor T,ury stated that the Public Hearing was open and in- quired if there was anyone in the audience who would care to speak. No one came forward and the Public Hearing was closed. 1. ORDINANCE.NO. 544U--MORATORIUM ON ADULT BUSINESSES EXTENDED ORDINANCE NO. 544U AN ORDINANCE OF THE CITY OF ROSEMEAD EXTENDING A MORATORIUM ON THE APPROVAL OF ALL ZONING AND INSPECTION OF ALL ADULT BUSINESSES IN THE CITY OF ROSEMEAD AND DECLARING THE PRESENCE OF AN EMERGENCY MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN CICHY that Ordinance No. 544U be adopted, and,the reading in full be waived. PUBLIC HEARING TO CONSIDER ZONE ZMENDMENT TO.ROSEMEAD MUNICIPAL CODE ARTICLE IX, CHAPTER I-ZONING REGULATIONS ONE LOT SUBDIVISIONS (CONDOMINIUMS) Mayor Tury stated that the Public Hearing was open and in- quired if there was anyone in the audience who would care to speak regarding this matter. Bob Bruesch, 3126 Isabel Avenue, suggested some changes in the proposed ordinance. Mayor Tury inquired if anyone else would care to speak. No one came forward, and the Public Hearing was closed. Mayor Tury requested that the words tentative tract be changed to precise development plan on page 7 of the ordinance, and inquired'if there were any objections to that suggestion. There being none, it was so ordered. Mayor Tury directed that Appendix "A be labeled with the word "exterior under'heighboring property~'and the word "interior" under the'~roject property'.for additional clarification, and this appendix would be,made a part of the Ordinance itself. 1. ORDINANCE NO. 545 CONDOMINIUM DEVELOPMENT STANDARDS ORDINANCE NO. 545 AN ORDINANCE OF THE CITY COUNCIL FOR THE CITY OF ROSEMEAD PROVIDING FOR CONDOMINIUM DEVELOPMENT STANDARDS AND AMEND- ING THE ROSEMEAD MUNICIPAL CODE MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN CICHY that Ordinance No. 545 be introduced on its first reading and the reading in full be waived, and that the negative declaration be accepted. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. Mayor Tury commended the Planning Commission and the staff for an outstanding job in preparing this Condominium Ordinance. C. PUBLIC HEARING TO CONSIDER ZONE AMENDMENT TO ROSEMEAD MUNICIPAL CODE, PART XXII, AUTOMOBILE PARKING REQUIREMENTS Mayor Tury stated that the Public Hearing was open and in- quired if there was anyone in the audience who would care to speak regarding this matter. Hari Alipuria, owner of the Golden West Motel, stated that it would present a hardship on him at this time since'he is planning on adding to his motel complex and the parking requirements would make it difficult to receive financing for.the improvement. Mayor Tury suggested that he.expedite his presentation of his plans for the project to Plan Check, and check with Mr. Carmona and the City Attorney for further clarification.on his situation.' Mayor Tury inquired if there was anyone else who would care to speak regarding this matter. CONSENT CALENDAR (CC-B deferred) CC-A EXPANSION OF THE TARGET AREA FOR COMMUNITY DEVELOPMENT BLOCK GRANT FOR FISCAL YEAR 1982-83 CC-C ACCEPTANCE OF ROAD DEEDS, PERMITS TO ENTER AND RIGHT OF WAY AGREEMENTS FOR DEL MAR IMPROVEMENT PROJECT CC-D AUTHORIZATION TO ATTEND CONFERENCE ON SOCIAL SECURITY IN LOS ANGELES, ON JUNE 7, 1982 CC-E. AUTHORIZATION TO ATTEND LEGISLATIVE BRIEFING SEMINAR IN SACRAMENTO, JUNE 14-16, 1982 CC-F MISSION DRIVE & EARLE AVENUE--CROSSING GUARD CC-G CLAIM AGAINST CITY ON BEHALF OF SALVADOR PUGLIESE MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN CLEVELAND that the foregoing items on the Consent Calendar be approved. CC-B SPECIFICATIONS FOR HANDYMAN IMPROVEMENT PROGRAM AND , AUTHORIZATION TO ADVERTISE FOR BIDS Councilman:,Taylor inquired about a resident who had requested some assistance from the Handyman Program,.and was turned down be- cause her son was named as owner of the property'.in spite of the fact that she met all the other guidelines.. Marshall Krupp, Consultant, stated that one of the require- ments imposed by the Council as implementers of the Program, was that the Handyman Program goes to owner occupied units.only. CM 5-11-82 Page #4 Marshall Krupp stated that if the Council wants to modify the program and open it up to such cases as this one. One of the reasons why it was decided to have owner occupied units, was to make sure that the occupant of the property and the owner of the property was getting the benefit of the program. Mr.' Krupp stated that they would prepare a policy position for the next Council Meeting. MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN CICHY that the specifications for the Handyman ImproVement program be approved and authorization to advertise for bids be granted. Vote resulted: - UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. V. MATTERS FOR DISCUSSION & ACTION A. L. A. COUNTY ANIMAL CONTROL AGREEMENT George Baca, representative of the L. A. County Animal Control Department,.commented.on their proposal and Joan Coleman, represent- ative of the San Gabriel Valley Humane Society discussed their pro- posal. After much discussion and questions, the City Council deferred this item to the next regular Council Meeting to be held on May 25, 1982..for additional information and the '.costs be;verified. Councilman Imperial requested that the Humane Society and the County check into a toll-free.line for the residents to contact the animal control offices. He requested that.the record show that he is offended by the.fact that the Humane Society did not get a copy of this proposal. Mayor Tury stated that both the County and.the Humane Society should have copies of them. VI. MATTERS FROM OFFICIALS A. Robert Kress, City Attorney, requested an Executive Session at the end of the meeting. regarding pending litigation. B. Councilman Taylor stated that a letter was presented from Juan Nunez regarding the Garage Sales that are taking place in the City of Ros@mead, and requested that-it•be placed on the Planning Commission's Agenda'for 'study and resolution of the problem. C. Councilman Imperial requested that the Budget Session be held on June 12, 1982 at 9:00 a. m. D. Hugh Foutz, City Treasurer, stated that the.Prayer Breakfast will be held on Saturday, May 21st.at 10:00 a.' m., and also the Memorial Day Services will be held at Savannah Memorial Cemetary on Monday, May 31st'at 10:00 a.m. The Council recessed to the Executive Session. The Council reconvened from the Executive Session. Robert Kress, City Attorney, stated that Executive Session was regarding pending litigation and there was.no action taken.
