The Regular Meeting of the Rosemead City Council was called to order by Mayor Tury at 8:00 p. m., in the Council Chambers of City Hall, 8838 E. Valley Blvd., Rosemead, Calif. The Pledge to the Flag was led by Councilman Cleveland. The Invocation was delivered by Rev. Art Freund. ROLL CALL OF OFFICERS: Present:-.Councilmen Cichy, Cleveland, Imperial, Taylor, and Mayor Tury Absent: None APPROVAL OF MINUTES: April 20, 1982 - Regular Adjourned Meeting. Councilman Taylor requested that the verbatim portion be gone over more thoroughly. Mayor Tury requested that the approval of the minutes be deferred to the next meeting. II. PUBLIC HEARING TO CONSIDER PROJECTS THAT WILL BE INCLUDED IN THE APPLICATION TO L. A. COUNTY FOR INCLUSION.:IN ITS APPLICATION TO DEPARTMENT OF HOUSING & URBAN DEVELOPMENT Mayor Tury opened the Public Hearing and inquired if there was anyone in the audience who would care to speak. No one came forward and he closed the Public Hearing. Marshall Krupp, representative from Willdan Associates, commented that the allocation for the fiscal year 1982-83 has been reduced approximately 15% and the total grant is in the amount of $603,904. He `stated that although there is a de- crease in funds they have attempted not.to..reduce the street improvement projects, housing rehabilitation assistance will be continued with money that has remained in the bank without allocating considerable funds from the 1982-83 program, and graffiti removal and maintenance will be,the continuation of this years program for 1982-83 at the cost of $10,000. The Administrative and Contingency Account will continue to be $40,000. MOTION BY COUNCILMAN CICHY, SECONDED BY MAYOR TURY that the CDBG Program recommended be approved. Councilman Taylor requested that the record show that even though he favors the citizens of Rosemead getting a share of their taxes returned, he still objects to some of the administra- tive costs. III. LEGISLATIVE A. RESOLUTION NO. 82-20 A RESOLUTION OF THE CITY COUNCIL OF THE.CITY OF ROSEMEAD AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN FOR PROPERTY LOCATED ON STEELE STREET MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN CICHY that Resolution No. 82-20 be adopted. RESOLUTION NO. 82-21 -CONDITIONALLY APPROVING TENTATIVE,TRACT #42132, 3853 MUSCATEL AVENUE RESOLUTION NO. 82-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD CONDITIONALLY APPROVING TENTATIVE TRACT NO. 42132 (3853 MUSCATEL AVENUE) MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL that Resolution No. 82-21.be adopted as amended. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. Andy Anderson, City Engineer, commented that some of the amendments were typographical in the Resolution and the words in Exhibit "A" item #2 be changed to read:. That the street shall be constructed in accordance with the approved tentative map, and shall include curb and gutter within one (1) year from the final tract approval." Item #9 to be changed by the addition of: "in and adjacent to lot 5". Item #13 to be changed to read: "Since sidewalks do not presently exist on Guess Street, the sidewalk improvements for the modified cul-de-sac shall;not'be.'.installed at this time." Councilman Taylor questioned the drainage direction;:of-.the street. Mr. Anderson stated that it.appears on the Map that it drains west but will not know exactly until the improvements are in. Councilman Taylor stated that it should be covered in the conditions before the approval of the tentative tract. Mr. Anderson stated that item #14 could be added to state: "Drainage to be approved by the City Engineer." D. ORDINANCE NO. 543 - AN INTERIM ZONING ORDINANCE OF THE CITY RESTRICTING THE ESTABLISHMENT OF AMUSEMENT ARCADES &'-DIRECTING PLANNING COMMISSION TO INITIATE STUDY GOVERNING SUCH USES. ORDINANCE NO. 543U AN INTERIM ZONING ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD PURSUANT TO THE PROVISIONS OF GOVERNMENT CODE SECTION 65858 RESTRICTING THE ESTABLISHMENT OF AMUSE- MENT ARCADES AND DIRECTING THE PLANNING COMMISSION TO INI- TIATE A STUDY WITH RESPECT TO APPROPRIATE ZONING REGULATIONS GOVERNING'SUCH USES. Councilman Taylor made a motion to introduce Ordinance No. 543 not as an Urgency Ordinance, but died.,due:;.to a lack of a second. AWARD OF BID FOR INSTALLATION OF TRAFFIC SIGNAL MODIFICATIONS TO S & W ELECTRICAL CONTRACTORS, INC. MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN CICHY that Item B be approved. CC-A PLANS & SPECIFICATIONS FOR MARSHALL STREET (ROSEMEAD BLVD/RIO HONDO)SIDEWALKS"AND AUTHORIZATION TO ADVERTISE FOR BIDS Councilman Taylor stated that he felt that a'-better price could be had if it were consolidated.with other-projects".-., Mr. Anderson stated that it would be no problem to put it together with another project. time. CC-D REQUEST BY CHAMBER OF COMMERCE TO USE CITY FACILITY . ROSEMEAD PARK--AND STRAIN POLES Councilman'. Taylor inquired,ab'diut..the: Round Up procedures on the Park grounds, and he stated that baseball'games would be held on the 5th and 6th of June using parking lot facilities. Bonnie Culbertson, Executive Vice President, after the parti- cipants remove..their wares they take their cars or trucks to another location to park them. The booths in the park will not be near the playing field and will'be closer to the street for better visibility. Most of the.people that attend do not arrive at the same time and parking should. not :be a. problem. MOTION BY COUNCILMAN CICHY, SECONDED BY MAYOR TURY that the request by the Chamber of Commerce to use Rosemead Park for three Art Fairs this year, and the use of. the City's strain poles be approved and that the Chamber be responsible that no vehicles be parked on the lawns and that the displays be set up at least 8 feet behind the sidewalk, and that the Council is not setting prece- dent with this one time approval. CM 4-27-82 Page #3 41 Councilman Taylor requested that the record show that he does agree with the concept of trying to get community involve- ment but he does have reservation about people selling products in the park for.-individual profit. VI. MATTERS FROM OFFICIALS A. BI-LINGUAL REQUIREMENT FOR CANDIDATES STATEMENTS Councilman Taylor commented on the bill received for his Candidates Statements which stated the cost of the English printing was $78.50 and the Spanish was $128.50 for printing. He felt that because Martin & Chapman are professional Election Suppliers that there should not be such a discrepancy in the cost between the English and the Spanish printing. He did not feel that the billing should be twice as much to-have Spanish than to have it printed in English.only. CM 4-27-82 Page #4 Robert Kress, City Attorney,.stated that he did discuss this problem with Paul Marshall of Martin & Chapman and he indicated that the handle 119 Elections on April 13, 1982 all these statements have to be prepared within the,-same,-'few weeks:'so they have to contract with typesetters. It is not totally a matter of their expertise and their employees. Councilman Taylor stated that this procedure has been going on for years, but this is double billing. If they are using an outside printing: firm then possible they should change tha't•printing firm and maybe this discussion will make them look at their procedures a little more. Mayor Tury directed the City Clerk to write a letter to Martin & Chapman:expressing the Council's concern about the excessive costs of the Spanish typesetting and request an explanation as to the large difference between the English and Spanish. Councilman Taylor stated that he would also like included in.that letter a.reques.t.for the list of-,the names of the cities thati.were provided bilinqual translations by Martin & Chapman.. The Clerk stated that should be happy to do that. B. AMBULANCE BILLING Councilman Taylor inquired about the Ambulance Billing, and requested a--.copy of the last billing received from the County listing the properties where people were picked up and where they were taken and listing of the dry runs. He thinks there is a problem surfacing, and requested that this be checked into. . Mayor Tury suggested that a copy of the ambulance bill be giveioto the Council and letters written to Sally Tanner and Joe Gonsalves under everyones signature questioning the pro- cedures. He directed the staff for a packet including infor- mation regarding the law suit with the County up-dating the entire ambulance situation. C. Councilman Taylor stated that he had received a letter from a resident regarding item pricing in one of the local markets. The letter referred to Alpha Beta which did not have item pricing. He requested a status report back on the legis- lation regarding item pricing. D. Councilman Imperial inquired about the parking enforcement in the evening and commented on the violations that have not been cited. Lt. John Phillips stated that Sgt. Dave Kading handles that on a daily basis and he would check with him on it to resolve the problem. Councilman Taylor stated that deputies have been called and the response time is slow and inquired about the investigative procedures used. QMayor Tury requested a report back on some of these problems. E. Holly.Knapp;,.8367:E.'-Whitmore;,,commented on a burglary of a car at Beach's parking lot..and'_stated that the box boys captured the two that were trying to steal the car and she thought that they should be given some type of recognition. She also commented on the We-Tip Convention which will take place on may 6,7,and 8, 1982 on the Queen Mary in Long Beach, and stated that she felt that it would be very worthwhile for members of the Council to attend, and requested that an ad'be placed in the Newsletter regarding We-Tip. CM 4-27-82 Page #5 iI • F. Rev. Tom Phillips, 8875 good job that the Sheriff's response to his calls. 0 Mission Drive, commented on the department is doing and the quick G. Robert Bruesch, 3126 S. Isabel Avenue, commented on the spanish translations in the Candidates Statements and felt that there were errors made in the translations in the different use of capitalization and it was not uniform. Councilman Taylor requested that Mr. Bruesch circle the discrepancies that he is talking about and brought back to the Council, and some of the errors may be made-by-the'-,printer. H. Juan Nunez, 2704 Del Mar, commented on the yard sales and felt that although there is no ordinance in the City that con- trols'yard sales but possibly the outdoor ordinance could be used to stop some one from having yard sales every week or so. He read a list of the dates that the people living at 2737 Del Mar Avenue had yard sales. Councilman Taylor requested a letter with a list of those dates from Mr. Nunez that yard sales took place at that property. Robert Kress, City Attorney, stated that there had been an ordinance prepared but the Planning Commission had different opinion on this subject.than the Council. Mayor Tury requested a study session be set as soon as possible with the Planning Commission. Councilman Taylor requested copies of what they have been studying regarding yard sales. Mayor Tury requested a package of all the materials presented to the Planning Commission s'o'-;that they can study it and also re- quested the list of dates from Juan Nunez on the yard sales held at 2737 Del Mar Avenue.
