SUBJECT: CITY HALL WINDOW REPLACEMENT /ENERGY EFFICIENCY CONSERVATION BLOCK GRANT (EECBG) — AWARD OF CONTRACT SUMMARY As part of the City's 2010 -11 Capital Improvement Program budget, the City Council approved a program titled Citywide Energy Efficiency Improvements, which consists of several modernization projects of existing infrastructure and systems at City facilities. This project includes the replacement of nearly 40 windows and frame components at City Hall. The City's allocated an amount of $85,000 that was acquired through the American Recovery and Reinvestment Act of 2009 (ARRA). On February 8, 2011, following a public advertisement/bid process, the City Council rejected all bids received for the project and directed staff to re- advertise at a later date. Since this time, the project was re- advertised and new bids were received. Staff Recommendation Staff recommends that the City Council: 1. Approve the plans & specifications for the City Hall Window Replacement Project. 2. Authorize the City Manager to enter into a contract with Fast -Track Construction Corp. for the City Hall Window Replacement Project for an amount of $72,900.00 and establish an amount of $10,935.00 (15 %) to cover the cost of unforeseen construction expenses. DISCUSSION As part of the American Recovery and Reinvesting Act (ARRA), the City of Rosemead received $509,800 from the Department of Energy (DOE) for the completion of several facility and infrastructure modernization projects at City facilities. The purpose of this grant program is to help public agencies implement projects that will reduce fossil fuel emissions, reduce energy use, improve energy efficiency, and create jobs. In June, staff received notification from the DOE that the City's projects were approved ITEM NO. _ � C____ APPROVED FOR CITY COUNCIL AGENDA: City Council Meeting March 22, 2011 Page 2 of 3 and authorized to move forward with the bidding process. The projects approved by the DOE include: • Development of an Energy Action Plan • Window Replacement at City facilities • HVAC Upgrade at City Hall • Interior lighting Improvements at City facilities • Exterior lighting Improvements at City facilities • HVAC Upgrade at Rosemead Community Center Each project is entirely funded through grant funds and no City matching funds are required. Additionally, each project will create energy and maintenance savings, thus lowering ongoing operational costs (including energy usage, maintenance /operations contracts) and improve energy efficiency. The window replacement projects involve replacing nearly 40 windows and frames at City Hall with tinted gray glass tempered over Low -E dual type glazing and dark bronze anodized aluminum metal framing. Low -E glass helps provide energy savings year around using thin, optically transparent layers to help regulate solar energy. This allows visible sunlight to enter buildings while blocking ultraviolet solar energy that drives up cooling costs. The estimated project cost is $85,000. On February 8, 2011, the City Council directed staff to reject all bids and re- advertise the project at a later date. Since this time, the project was re- advertised and new bids were received. Staff has concluded that Fast -Track Construction, Corp. is the lowest responsible bidder to perform the construction for this project. Fast -Track Construction, Corp. has satisfactorily completed similar projects for other agencies, including City of Long Beach, City of Torrance, and City of Cypress. The City Engineer's estimate for this project was $85,000.00. ENVIRONMENTAL REVIEW The project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (a) of the CEQA Implementing Guidelines. Staff Recommendation It is recommended that the City Council reject all bids received for this project and direct staff to readvertise the project for bid. DISCUSSION At 11:00 AM on January 19, 2011, the City Clerk opened and read the following total bid prices for this project: Bidder Total Bid Price 1 Robert Gosney Construction $ 64,400.00 2 GDL Best Contractors, Inc. $ 92,750.00 (aka: Best Quality Painting Inc.) 3 G Coast Construction $118,000.00 The window replacement projects involve replacing nearly 40 windows and frames at City Hall with tinted gray glass tempered over Low -E dual type glazing and dark bronze anodized aluminum metal framing. Low -E glass helps provide energy savings year around using thin, optically transparent layers to help regulate solar energy. The estimated project cost is $85,000. On January 13, 2011, a mandatory pre -bid meeting was held and eighteen (18) contractors were in attendance. Of this number, only three (3) submitted bids for the project. The lowest bidder, Robert Gosney Construction, submitted a bid approximately 24% less than the engineer's estimate for the project. After reviewing the bid it was determined that the contractor has no prior experience involving window installation /replacement projects. As indicated in the project specifications, contractors are required to provide references for similar projects completed for three (3) public agencies within the past two (2) years. The other two bidders, GDL Best Contractors, Inc. and G Coast Contractors, Inc. submitted bids above the engineer's estimate for the project (approximately 8% and 39 %, respectively). The wide range of bid prices received for this project shows confusion with the bid plans. The bid prices above the engineer's estimate are also unusual given the current favorable bidding climate for public projects. Rebidding this project will allow staff to clarify questions related to the project and then readverstise the project for a two -week period. Staff will also directly contact window contractors in the area and inform them of this project in order to receive more competitive bid prices. In accordance with the contract bid documents reviewed by each contractor, the City Council /Agency reserves the right to reject any or all proposal and readvertise bids.
