CC - 12-08-810 MINUTES OF THE REGULAR MEETING OF THE ROSEMEAD CITY COUNCIL APPROV EL CITY OF ROSEMEAD DECEMBER 8, 1981 AT 8:00 P. M. s The Regular Meeting-of the Rosemead City Council was called to order by Mayor Imperial at 8:03 p. m., in the Council Chambov. of City Hall, 8838 E. Valley Blvd., Rosemead, California. The Pledge to the Flag was led by Councilman Tury. The Invocation was delivered by Rev. Bill Fuller. ROLL CALL OF OFFICERS: Present: Councilmen Taylor, TUry and Mayor Imperial „ Absent: Councilman Cichy APPROVAL OF MINUTES: November 10, 1981 - Regular Meeting Mayor Imperial stated that he had some problems with the minutes regarding titles used and he had requested the Clerk to make corrections before they be approved, and therefore requested that they be deferred to the next regular meeting. There being no objection, it was so ordered. APPROVAL OF MINUTES: November 24, 1981 -:Regular Meeting f MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN TUP.Y that the Minutes of the November 24, 1981 Council Meeting be approved. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. I. ORAL COMMUNICATIONS A. Donna Bartlett, 9445 Marshall Street, complained about street sweeping near her home and also about the young people in automobiles' behaving in a manner that is embarrasing to passers by. Mayor Imperial requested that she contact City Hall with her problems and the Sheriff's department will be contacted . . and for her trash problems and the street sweeping the City Hall should also be contacted. B. Lloyd Alexander., 4403 North Muscatel, also complained about the Slurry Seal project and the sweeper scheduling, and he complained about the Motorcycle noises and speeding in the area. f, Mayor Imperial requested Mr. Alexander meet with Mr. Gutierrez and he would help him resolve his problem with the street sweeping and the motorcyclists. C. Lino Nardini, 7831 E. Emerson Place, commented on the drainage during times of heavy rain as the trash is swept into the street drains. He also requested that someone check on a store-on the corner of Del Mar and Emerson where electronic games are placed and the children are there playing from 7:00 a. m. to the evening. He felt that the welfare of these children are being jeopardized.be the allowing of these games in these stores. Mayor Imperial expressed appreciation to Mr. Nardini for this input, and it will be checked into. II. PUBLIC HEARING A. PUBLIC HEARING FOR THE ADOPTION OF A RESOLUTION OF NECESSITY FOR ACQUISITION BY EMINENT DOMAIN OF PUBLIC RIGHT OF.WAY FROM PROPERTY LOCATED AT 7723 NEWMARK CM 12-8-81 Page #1 • • Robert Kress, City Attorney, stated that although it was not listed on the Agenda as a Public Hearing this Item had been properly noticed and it would be appropriate to conduct that hearing. Mayor Imperial stated that the Public Hearing was open and inquired if there was anyone in the audience who would care to speak regarding this matter. Robert Kress, City Attorney, inquired if Mr. & Mrs. Pimentel were in the.audience since they are the only ones that would have an interest in this particular hearing. No one came forward, and Mayor Imperial closed the Hearing. Mayor Imperial requested that the City Manager prepare a memorandum explaining why the Public Hearing was not placed on the Agenda in proper order. III. LEGISLATIVE A. RESOLUTION NO. 81-64 - REQUESTING BOARD OF SUPERVISORS TO RENDER SPECIFIED SERVICES RELATING TO CONDUCT OF MUNICIPAL ELECTION, APRIL 13, 1982 RESOLUTION NO. 81-64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO RENDER SPECIFIED SERVICES TO SAID CITY RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, APRIL 13, 1982 MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN TAYLOR that Resolution No. 81-64 be adopted. RESOLUTION NO. 81-65 - ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO MATERIALS SUBMITTED TO ELECTORATE AND COSTS FOR MUNICIPAL ELECTION HELD ON APRIL 13, 1982 RESOLUTION NO. 81-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD,CALIFORNIA ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAINING TO MATERIALS SUBMITTED TO ELECTORATE AND THE COSTS THEREOF FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, APRIL 13, 1982. RESOLUTION NO. 81-66 - CLAIMS & DEMANDS RESOLUTION NO. 81-66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS & DEMANDS IN THE SUM OF $256,346.96 NUMBERED 8118/8122-8130/2778 THROUGH 2872 INCLUSIVELY MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN TURY that Resolution No. 81-66 be adopted. Vote resulted: Councilman Taylor requested the back up to check #2851 and inquired about the property listed at 8769 Ralph Street for a title search. Robert Dickey, Assistant City Manager, stated that it was presumed to be a public right of way and therefore a title search was approved for that. Councilman Taylor requested a copy of that particular re- search. D. RESOLUTION NO. 81-67 - APPROVAL OF ROSEMEAD CITIZEN PARTICIPATION FOR COMMUNITY DEVELOPMENT BLOCK GRANT Councilman Taylor stated that he had some questions regard- ing this Resolution and he requested that this be deferred to the next meeting. There being no objection, it was so ordered. IV. CONSENT CALENDAR (CC-E deferred) CC-A APPROVAL OF CDBG PROGRAM BUDGET FOR FY 1981-82 AND AUTHORIZATION FOR FUNDING OF LOCK INSTALLATION FOR SENIOR CITIZENS CC-B APPROVAL OF SPECIFICATIONS FOR SENIOR CITIZENS'.CRIME HARDENING PROGRAM AND AUTHORIZATION TO SEEK BIDS CC-C TRAFFIC CONTROL--SAN GABRIEL & GRAVES CC-D AUTHORIZATION TO ATTEND CITY MANAGERS MEETING IN SACRAMENTO MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN TURY that the foregoing Items on the Consent Calendar be approved. Councilman Taylor requested that the minutes show that he approved of 'part of the proprosal.but he objects to $80,000 in Administration costs.on Item.CC-A. Mayor Imperial stated that he also would like the minutes to show that even though he was in favor of the project he is not in favor of the funding. CC-E AUTHORIZATION TO RETAIN AN ENGINEER FOR REPLASTERING & RETILING ROSEMEAD POOL Councilman Taylor inquired about the recommendation to retain Black, O'Dowd and Associates for $4,500 instead of the low bidder Dakan Engineering at $4,460. Michael Burbank, Park & Recreation Director, stated that Dakan Engineering has a subsidiary corporation that does contract work for pools and he doesn't want to be caught between the Archi- tect and the contractor and considering the dollars are relatively small, he would rather go with an independent firm that has no bearing on the contractors. APPOINTMENT OF ALTERNATE TO SANITATION DISTRICT MOTION BY COUNCILMAN TAYLOR, SECONDED BY MAYOR-IMPERIAL that Councilman Louis Tury be selected Mayor Pro Tem and the Sanitation District Alternate. COUNTER PROPOSAL--MODERN SERVICE AGREEMENT Deferred for a full Council. D. REQUEST FOR USE OF ROSEMEAD PARK BY CHAMBER OF COMMERCE This item was pulled by the Chamber of Commerce. Councilman Taylor inquired why the Circus Vargus is not being held at the Shopping Center as it was last year? Dave DeGroff, President of the Chamber of Commerce, stated that it is not being held at Rosemead Square because Mr. Gilbert has not given his consent because of complaints he received from the theatre owner.and Love's. E. STREET SWEEPING BID After much discussion regarding the street sweeping bids, it was decided to reject the bids as presented. MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN TURY that the specifications be revised with.the deletion of dump sites and authorization be granted to seek new bids contacting Cities within a radius of 10 miles to send these specifications. Councilman Taylor stated that he would not be able to make a decision on this item as there are several questions that need to be clarified regarding the past three years. Peter Zebot, Manager, Pension Services, stated that this reporting!an'd funding of the Retirment Plan in a timely basis has not been done and it would be necessary for the Council to take immediate action to overcome the existing deficiency by contributing $15,984 into the Plan in behalf of the participants for benefits earned through December 31, 1980. ACCEPTANCE OF PROPOSAL FOR ENVIRONMENTAL IMPACT REPORT ON COGENERATION PLANT AT 1515 WALNUT GROVE Frank G. Tripepi, City Manager, stated that Ron Bass of the State Office of Plannin g and Research had been contacted and he indicated that there ar e no environmental impact reports that have been completed for cogeneration facilities. Mr. Bass indi- cated that if the City of Rosemead requires an environmental im- pact report that it wou ld be the first time in the State's history that such a report was required for this type of development. Mr. Bass offered his servic es to the City Council to explain any facets of cogeneration as reco gnized by the office of Planning and Research. He stated that the map indicating some of the other cogeneration facilities that have be en approved administratively i.e. negative declaration.is attached . CounIilman:Taylor stated that he did not object to that letter being in the min utes, but he requested that the addresses of all the locations be included in the minutes. At least those three, and he requested that the letter state a question to each of these Agencies or Board: If their intent was to install and to approve of cogeneration plants of this type in residential areas and around schools. Stating this particular one.... stating that the location is within 185 feet of fully developed community and houses to the north, south and the west and two elementary schools within one-half mile on the downwind side of the cogeneration plant. Councilman Taylor requested that that statement be in the letter because Mr. Tury referred to Mr. Ron Bass and at the public hearing it was stated that he did not know where this plant was. Mayor Imperial requested that.the size of the Cal Fed Co- generation plant be included in the letter. Councilman Taylor stated that there had been several ques- tions asked at the Public Hearing of the Planning Commission, and he requested a copy of the verbatim minutes of the Planning Commis- sions meeting. He felt that some of the questions asked need to be answered in that Environmental Impact Report. Robert Kress, City Attorney, stated that a copy had been re- ceived today and will be placed in the Council's boxes. Robert Bruesch, 3126 Isabelle, stated that approximately 800 of the Cogeneration plants on the map are divided in three types one is wood and pulp manufacturers, one is sugar manufacturers, and the third is petroleum related products. These are burning waste products that are already burnt, in his opinion,and they have converted the burning of these waste products into genera- tion of energy and to heat their facilities. Councilman Tury stated that he felt that it would be more helpful for the City to find out what kind of polutants they are putting out. MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN TURY that Atlantis Scientific be awarded the bid at $13,580 and that the City.pay the difference in the cost of the low bidder which was $8,080.00.. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. Mayor Imperial stated that he had some concerns with the low bidder and because of the element of time he felt that it would be best to go with Atlantis Scientific. Councilman Taylor inquired of the City Attorney if there was any problem with the City giving Cal Fed the difference between the lower price and the price Atlantis Scientific is asking. Could that be an Administrative charge? Robert Kress, City Attorney, stated he felt that was a very logical and fair.approach. He stated that five firms had been solicited and three were interested and they appear to be some- what equally qualified and since Cal Fed does have to pay for it, they should have the benefit of the lowest responsible bid. Councilman Tury stated that both the residents and the developer are entitled to an expeditious solution of the problem, and if there are any problems with Atlantis it would be best to state that now. . CM 12-8-81 Page #6 i VI. MATTERS FROM OFFICIALS • A. Councilman Taylor stated that he thought that the Project Area Committee that was Mr. DeGroff from the Chamber of Commerce and others, and that they by State Law they are a committee appointed by the City Council and are required to have open scheduled meetings and also to file Financial Dis- closure Acts. He asked the City Attorney if that was correct. Robert Kress, City 'Attorney, stated that they are not a Project Area Committee. That would be a term that is used in the Redevelopment Law and that is not what that advisory committee is. Councilman Taylor stated that they should be called an advisory committee, and he requested that at the next regular meeting that this be clarified if they fall under the require- ments of the Financial Disclosure Act and have to have posted notice of public meetings so that the public may attend. B. Mayor Imperial requested a status report on the Water- fall in front.of City Hall. C. Mayor Imperial requested whatever information is avail- able on the game machines that were discussed earlier in the meet- ing, and what can be done to limit, if possible, these machines within the City of.Rosemead. D. Mayor Imperial requested the status of the citizens complaint given to the Council as soon as possible. E. Mayor Imperial commented that there are 83 licenses for Alcoholic Beverages in the City of Rosemead. He felt that was a lot of licenses. He requested that the City Attorney re- search other cities and come up with some solution on how we may be able to limit the issuance of Alcoholic Beverage Licenses, and if there is a permit need for game machines and if not, why not. There being no further business, the City Council Meeting was adjourned to a Study Session on December 15, 1981 at 8:00 p. m.
