OF THE ROSEMEAD CITY COUNCIL
SEPTEMBER 22, 1981 AT 8:00 P.M.
The Regular Meeting of the Rosemead City Council was called
to order by Mayor Imperial at 8:03 p. m., in the Council Chambers
of City Hall, 8838 E. Valley Blvd., Rosemead, California.
The Pledge to the Flag was led by Mayor Pro Tem Hunter.
The Invocation was delivered by Rev. Tom Phillips

Present: Mayor Pro Tem Hunter, Councilmen Tury, Taylor, Cichy
and Mayor Imperial

APPROVAL OF MINUTES: September 8, 1981 - Regular Meeting

that the Minutes of the regular meeting of September 8, 1981 be
approved. Vote resulted:

APPROVAL OF MINUTES: September 15, 1981 - Adjourned Meeting
MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN CICHY
that the verbatim Minutes of the adjourned Meeting of September
22, 1981 be approved. Vote resulted:

ORAL COMMUNICATIONS
A. Anna Marie Ardessi, 9028 E. Hershey Street, complained
about the proposed Heliport on 3440 Flair Drive in'E1 Monte and
about the fact that notification was not sent to the required
residents in Rosemead. She requested that-the City of Rosemead
contact the City of E1 Monte regarding this matter.
Robert Dickey, Assistant Manager, stated that the Public
Hearing in E1 Monte had been continued to October 5th and that
documents could be secured from the Planning Director of E1 Monte
and they could be reviewed before that meeting takes place.
Ed Perry, 9031 E. Hershey, spokesman of the group, stated
this project will be destroying his peace and tranquility by the
frequent Jet type helicopters that will be using that heliport
that is on the corner of the San Bernardino Freeway and Rosemead
Blvd. Mr. Perry asked the support and help of the Rosemead City
Council.
Councilman Tury requested that the staff get as much infor-
mation as possible on this item and possibly something can be
done together.
Mayor Imperial requested that the City staff request of the
City of E1 Monte a Environmental Impact Report on how this project
will effect the City of Rosemead, and requested that a meeting be
set up between himself and the Mayor of E1 Monte to discuss this.
Councilman Taylor stated that the group should return to the
Planning Commission Meeting in October and notify their City At-
torney that the residents were not properly notified of the Public
Hearing.

B. Donald Henderson, 2200 N. San Gabriel, commented on
the Traffic problem on the San Gabriel Blvd., and Graves Avenue.
He feels that a signal should be placed at this intersection as
there has been many accidents to his truck and to his building
because there is no deterent.
Councilman Tury stated that the Traffic Commission would
take another look at this intersection as it is a dangerous
corner and something should be done about this situation.
C. Thurston McDougall, 8818 E. Lawrence, inquired if the
City of Rosemead is allowed to have bands on the streets?
Robert Dickey, Assistant City Manager, inquired if he was
inquiring about the Muscatel School Band that practices after
school. He stated that permission would have to be obtained
from the City in order to utilize the public right-of-way.
Councilman Taylor suggested that Mr. McDougall attend the
school board meeting.
Mr. McDougall stated that they practice each school day
for about an hour for the past two years.
Mr. Dickey stated that he would be happy to contact the
Principal of the school.
Mayor Imperial requested a memorandum back to the Council
regarding what has been determined.
II. PUBLIC HEARING
A. PUBLIC HEARING TO CONSIDER.AN EXTENSION OF THE MORATORIUM
ON THE APPROVAL OF ALL ZONING AND INSPECTION OF ALL ADULT
BUSINESSES WITHIN ROSEMEAD.
Mayor Imperial stated that the Public Hearing was open and
inquired if there was anyone in the audience who would care to
speak regarding this matter.
No one came forward, and the Mayor closed the Public Hearing.
The following Ordinance was presented for adoption:

THE CITY OF ROSEMEAD EXTENDING A MORATORIUM ON THE APPROVAL
OF ALL'ZONING AND INSPECTION OF ALL ADULT BUSINESSES IN THE
CITY OF ROSEMEAD AND DECLARING THE PRESENCE OF AN EMERGENCY

V. MATTERS FOR DISCUSSION & ACTION
A. GOLDEN BEAR ARBORISTS INC.
City Attorney, Bob Kress, stated that the letter received
from the law firm representing the Golden Bear Arborists, Inc.,
was placed on the Agenda in case there were,any thing that the
Council would want to discuss or take action on regarding this
item, and also enclosed in this packet is a copy of the agreement
with Evans Tree Service.
MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN CICHY
that the Council proceed with the Contract as it was assigned.
Vote resulted:
AYES: Councilmen Hunter, Cichy, Tury and Mayor Imperial
NAYES: Councilman Taylor

Whereupon the Mayor declared said motion duly carried and
so ordered.
Councilman Taylor requested that the record show that his
objection was as it was at the last meeting.
VI. MATTERS FROM OFFICIALS
A. Councilman Cichy inquired if there was to be a discus-
sion regarding the consolidation of the recommendations on Modern
Service that took place at the September 15th Meeting?
Councilman Tury stated that he had not received a whole
package put together as yet.
Councilman Cichy stated that the next Agenda would be fine.
Councilman Tury stated that the payment of some delinquencies
had been held over for a few months and that should also be taken
care of at the next meeting.
B. Councilman Taylor stated that Beverly Van Fossen had
called him and inquired about the sound ordinance and working on
Sundays, and requested.that she comment on the results of the
call to the sheriff's department.
Beverly Van Fossen, 8538 Wells Street, commented that the
bui-lders.'of'the condos were beginning at 6:00 a.m. and on a Sunday.
She stated that after calling the Sheriff's Department whe was told
that it was not against the Municipal Code to work on Sundays, but
if she found out it was against the ordinance she would send a car
out to the site. The car never came.
Councilman Taylor inquired of the City Attorney if this was
a violation?
Robert Kress, City Attorney, stated that he`believed it was
a violation.
Councilman Taylor stated that the reason he brought this up
tonight was because he wanted this reaffirmed and get it straightened
out again so that the Sheriff's Department would be aware of the vio-
lation to the Rosemead Municipal Code.
Mayor Imperial stated that if this problem should reoccur to
contact staff at City Hall or call him at home on a Sunday morning.
Councilman Taylor requested a written report from staff and
get this problem cleared up and send a copy of the portion of the
code that states the violation.

Bevery Van Fossen stated that on the Cathay project that
is not even completed yet has 'FOR RENT' signs placed on it.
These are supposed to be condominiums and already the specula-
tors are in there.
Robert Dickey, Assistant City Manager, suggested that he and
Lt. Phillips.get together and work on the timing and reinforce
that provision of our Municipal Code with the Field Deputies to
ensure that calls that are received for that kind of violation
are responded to.
Mayor Imperial stated that was the directive given.
C. Don Henderson, 2200 N. San Gabriel, stated that he
had received a bill from Modern Service in the amount of $180.00
and that they had turned this bill over to the City for collection
and he wrote a note to them telling them to sue him.
Robert Kress, City Attorney, stated that this is something
that is being worked on by the City.
Mayor Imperial stated that at the present time there are
some negotiations taking place between the.City and Modern Service.
There being no further business to be handled the City Council
Meeting was adjourned to the Joint Meeting with the Planning Com-
mission on.September 29, 1981 at 7:00 p. m.
