MINUTES OF THE SPECIAL MEETING
OF THE ROSEMEAD CITY COUNCIL
JULY 21, 1981 AT 5:00 P. M.
The Special Meeting of the Rosemead City Council was
called to order by Mayor Imperial at 5:00 p.m., in the Con-
ference Room of City Hall, 8838 E. Valley Blvd., Rosemead,
California.
ROLL:'CALL OF OFFICERS:
Present: Councilmen Hunter, Tury and Mayor Imperial
Absent: Councilman Cichy and Taylor (excused)
Mayor Imperial requested an Executive Session.
The City Council recessed to an Executive Session.
The City. Council reconvened.
Glen Watson, Attorney, stated that the City Council and
the special counsel discussed the litigation with the Hedrick
Company, and that no action was taken. Any action to be taken
would be during an open session.
Glen Watson,Special Counsel,;stated`the purpose of the
Special Meeting.... the City Council rejected Tract Map #38455
on June 23, 1981 and following that rejection a writ of Mandate
action was filed by Hedrick Company and that action is pending
in the Superior Court. He stated that he had advised the Council
that,in his opinion,some of the matters that the Council was en-
deavoring to deal with that effect the public are matters more
appropriately conditions of the precise plan of development
rather than conditions of the sub-division map, and since the
conditions are already set as far as the sub-division map is
concerned, in his opinion, the Council should consider approv-
ing the final map on the same conditions set forth on the tenta-
tive map and not add any conditions to that map. He also advised
the Council, that in his opinion, under the P/D Zone section of
the Rosemead Municipal Code, it is also required to present a
precise plan of development and that plan of development may
carry with.it the numerous ones that the staff has already recom-
mended as early as November of 1979 and other conditions which
the Council has talked about more lately as the concerns of the
Council regarding this proposed development. What the Council
is doing tonight is to reconsider its action on the final map,
and after reconsideration of that action then address the matter
of the final map and,if appropriate,approve the final map, and
direct the City Clerk to certify it'. Following which the staff
would be directed to work with the developer regarding the condi-
tions of the precise plan of development. The Council met in
Special Session on the 16th of July, 1981 and adopted a moratorium
on building permits on Planned Developments and Condominiums and
that moratorium will be in effect for four months unless it is
terminated prior to that time by further legislative action. That
is the explanation-given by special counsel Glen Watson.
MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN HUNTER
that the action taken on June 23, 1981 regarding the Final, S'ub-
divisi6n.'Map138455 ~Be.reconsidered,. Vote resulted:

The Mayor declared said motion duly carried and so ordered.

MOTION BY COUNCILMAN HUNTER, SECONDED BY COUNCILMAN TURY
the recommendations of the City Engineer be approved and the
findings be accepted. Vote resulted:
UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE.
The Mayor declared said"motion duly carried and so ordered.
MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN HUNTER
that the final Sub-division Map of J. H. Hedrick & Company
#38455::be approved and the City Clerk be directed to certify
the map pursuant to law. Vote resulted:
UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE.
The Mayor declared said motion duly carried and so ordered.
MOTION BY COUNCILMAN TURY, SECONDED BY COUNCILMAN HUNTER
that the staff be instructed to work with Hedrick and Company
in expediting the processing of the required development plan
to-completion and 'final action. Vote resulted:
UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE.
The Mayor declared said motion duly carried and so ordered.
Glen Watson, Attorney, stated that this completes the
action with respect to the litigation which is in Court tomor-
row,__and.it.-is his'intention,as special Counsel, to advise the
court of this evenings action and he assumes that that will
dispose of the mandate action.
Mayor Imperial adjourned the meeting in honor-of'the>Mayor
Pro Tem and his wife'who-are celebrating their "25th" Anniversary.
