STUDY SESSION l
STREET IMPROVEMENT INSTALLATIONS
SEPTEMBER 9, 1980 AT 7:15 P. M.
The City Council of the City of Rosemead held a Study
Session in the Conference Room of City Hall to discuss the
1911 Improvement Act, Chapter 27 and Section 8110 of the
Rosemead Municipal Code.
Councilman Taylor stated that what had initiated his con-
cern was the property listed on the second page. 3851 Ellis Lane.
He stated that in the past the City Council's policy has been
there were no sidewalks in the block it was not required to
put them in. In a four block area on this particular street
there was only one_sidewalk,at_one house:-_He also commented on
the fact that after°much'money had been spent on the Dinsmoor
Heritage House_sidewalks_had not been required by the City or
put-in by the City yet 3851 Ellis Lane is next door to the Heri-
tage House.
Robert Ritchie, Planning Commissioner, stated that was the
policy that the Planning Commission used generally. If there
were no sidewalks for a couple of blocks then to require them
would be an unreasonable encroachment on the property owner.
Most of the time he would go to the property to seeiif it were
needed or not.. The way the ordinance is written that expense
over $2000 for an improvement a waiver has to be applied for
or curbs,gutters and sidewalks have to be put in. He feels
that figure of $2000 should be increased.
Mayor Tury inquired if curbs and gutters were waived often.
Robert Dickey, Assistant City Manager, stated that on Brook-
line there were some waivers granted by the Planning Commission
for curbs & gutters as Section. 8111 of the Municipal Code sets
out a criteria that if the area involved is an assessment dis-
trict or within a project that is planned waivers can be granted.
Brookline and Marshall Street which is east of Temple City Blvd.,
is some that that will eventually be built and as an Assessment
District with the approval of the Council.
Mayor Tury_ inquired if some type of agreement is reached
with the owner when a waiver is approved stating that the owner
would not object to the assessment when it does go through.
Mr. Dickey stated that there is no agreement with the owner
when a waiver has been approved, and the Council has the statu-
tory power with 4/5 vote to order in the improvements.
Councilman Taylor stated that it could be included in our
ordinance that a particular homeowner could sign a waiver that
if the majority of people have improvements on that block that
the City at that time could complete the street instead of going
to condemnation.
Mayor Tury stated that he liked that idea to get some type
of commitment from the property owner for waiving the improvement.
Councilman Hunter requested that guidelines should be drawn
up as to how far a sidewalk is away before it is waived.
Councilman Imperial inquired if the owner couldlbe required
to sign a paper stating that they will put a sidewalk in at a
later date if the need is there and others on the block have, or
if it would be better to put a lien on the property. He also
inquire'if this would be legal even if the present owner should
sell the property. Would there still be an obligation no matter
who the owner was.

Robert Kress, City Attorney, stated that he would check
this out and report back to the Council.at the next meeting.
Councilman Taylor stated that there are very few streets
left in the City that do not have curbs and gutters.
Robert Dickey stated that there are spots within streets
throughout the City-that do not have curbs and gutters, but as
far as total. streets most of them do have curbs and gutters.
Councilman Taylor stated that there are so few that they
should be finished spot by spot.
Councilman Hunter stated that before this ordinance is
modified as discussed, it should be decided what type of pro-
gram is desired. An ambitious program initiated by Council or
by petition.,or if you want to go into areas and select certain
streets that lead directly to schools is another way. The Council
should come up with a policy.'
Robert Dickey stated that the ideas are all good and there
are only a few areas that improvements are needed.
Councilman Hunter inquired how long it would take for the
staff to prepare a report on how much of the City does-,.not have
curb and gutter & what portion of the street doesn't have at
least one half sidewalked and what percentage needs to be redone.
Mayor. Tury requested that Robert Kress, City Attorney; check
into the suggestion given'by Councilman Imperial regarding a
written obligation,- an increase from $2000 to $4000, and leaving
it to the Planning 00mmission for their recommendation.for waivers
but at least a dedication of right of way from those owners, and
guidelines be prepared for the Planning Commission.
Robert Dickey stated that he could have this report prepared
in a couple of weeks.
There being no further discussion at this time the study
session was adjourned to the regular Council Meeting at 8:00 p.m.
