The Regular Meeting of the Rosemead City Council was called to order by Mayor Tury at 8:00 p. m., in the Council Chambers of City Hall, 8838 E. Valley Blvd., Rosemead, California. The Pledge to the.Flag was led by Councilman Hunter The Invocation was delivered by Rev. Jim McClellan. ROLL CALL OF OFFICERS: Present:. Councilmen Hunter, Imperial, Taylor and Mayor Tury Absent: Councilman Cichy (excused) APPROVAL OF MINUTES: July 22, 1980 - Regular Meeting MOTION BY COUNCILMAN HUNTER, SECONDED BY COUNCILMAN IMPERIAL that the Minutes of the Regular Meeting of the Rosemead City Council of July 22, 1980 be approved. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. APPROVAL OF MINUTES: July 22, 1980 - Study Session w/Chamber MOTION BY COUNCILMAN HUNTER, SECONDED BY COUNCILMAN TAYLOR that the Minutes of the StudS~,-.Session with the Rosemead Chamber of Commerce on July 22, 1980 be approved. Vote resulted: .UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. Mayor. Tury stated that they would deviate from the order on the Agenda and take V-A Stone Roofing first. V-A. STONE ROOFING Councilman Taylor stated that he had been notified by resi- dents in the area that there was an obnoxious odor coming from either the carpet factory or the Stone Roofing Company, and that this odor has been going on for a few years although the Council had not been aware of the situation. This was the reason he had this placed on the Agenda in order to get an up-date of what has transpired regarding the odor problem. Arthur Seigal, Director of Enforcement of the South Coast Air Quality. Management District, stated that they were aware of the odor problems that is believed to come from Stone Roofing for several years since tha very nature of the material that they are processing is odorous through various actions they have worked with the residents who are complaining and the company to prevail upon them to put in control equipment, to take'some new operating procedures and to install other odor' abatement.processes that will reduce the odor. He stated that "odors" per se are not against the law unless it is causing a public nuisance so the goal has been to reduce the odors as soon as possible, as technology does not give us the knowledge to completely eliminate the odors at this time. With this new equipment and procedures the odors are less than before, and hopefully, as time goes on the odors will be.less;:offensive. He stated that for economic reasons there is a complaint desk that is manned from 6:00 a. m. to 10:00 p. m. and after ten o'clock there is a tape recorder that is checked hourly and based on the information on the tape it is relayed to an in- spector who will attempt to have someone at the scene as soon as possible, In emergency situations the Sheriff's department can be contacted and they can reach the district. CM 8-12-80 Page ;#1 0 1 • He commented that although the problem is eliminated the odors do linger. He felt that the new equipment which has been installed a few weeks ago hopefully will reduce the incidents, but if it doesn't they will take the enforcement action that has been taken. Councilman Taylor requested a report regarding the situation since it had been five or six weeks since he had been there. He stated that.what he had smelled was not just an odor but an ob- noxious odor which could be considered a public nuisance. Mr. Seigal.stated that there is no known solution that will completely eliminate the asphalt burning odors but efforts will be made to reduce the odor with this new stack so that it won't be a nuisance. Councilman Imperial requested a progress report on the odor problem.,about every thirty days. Councilman Taylor requested a written report form. Frank G. Tripepi; City Manager, stated that it could be an up-date to the chronological list of the events that have taken place to date that was received in writing from Mr. Limpke. Both Councilman Taylor and Imperial stated that would be fine. I. ORAL COMMUNICATIONS A. Ed Atkins, 3011 N. Bartlett, commented on the porno- grafic newstands on corners in this area and inquired if there was something that could be done to control this problem. Robert Kress, City Attorney, stated that they are in the process of revising the entire Municipal Code and that is one of the provisions. that is being changed to include the toughest adult business ordinance dealing with shops as well as news racks that has been approved by the courts. He stated that the City of Rosemead has a newsrack ordinance, but within thirty days a new and better adult business ordinance will be presented as part of the suggested revisions of the Municipal Code. Mayor Tury stated that the ordinance is being worked on, and will do the best they can to eliminate the problem. B. Michael.valdez,;8252 Graves Avenue, requested use of Zapopan Park in order to hold a memorium activity for a youthful friend that was killed.by gang members. Mayor. Tury suggested that he contact Mike Burbank, Parks & Recreation Director, and present the program so that all the de- tails will be known in order to make a decision. He also sug- gested that the Sheriff's Department also be contacted to find out what their feelings are on such a gathering. Mike Burbank, Parks & Recreation Director, stated that he felt that the Sheriff's Department should be worked with closely because of the nature of what we,will be dealing with. Councilman Taylor stated that in the past it has been very hard project or foretell what the actions will be when there will rival gang members getting together and when the sheriff is in- volved there can be better security at these affairs. Mayor Tury stated that a great deal of care has to be taken as there are many residences in. the area and it is a public park. CM 8-12-80 Page #2 lip C. Juan Nunez, 2704 N. Del Mar, stated that he again is complaining about the loud noises and music in the area, and he brought some neighbors. to support the complaint. Juan Nunez also stated that there is a'car parked at 2624-26 Del Mar, and another car on blocks at 2713 Del Mar. Mayor Tury directed John Carmona, Planning Director, to check into these cars. Mr. Nunez commented on a house at 3735 Del Mar.that is having yard sales week after week. Mayor:Tury stated that Mr. Carmona will take care of the vehicles and if it is possible to abate them,he will, and as far as the yard sales this too will be checked on. Dorothy Greer, 2639 N. Brighton Street, stated that on July 11, 1980 the music started at 11:00 p. m. and went on to-7:00 a.m. and it was loud amplified music. She inquired what is done to handle an abuse of the Noise Ordinance. Mayor Tury stated that he would allow Lt. Tait of the Sher- iff's department to explain the procedure. Myra Greer, 2639 N. Brighton Street, stated that the music that is being played is a hard-rock frequently with live audiences with 'crowds screaming and applauding. Most of the time it starts after 11:00 p. m. and goes on frequently until 6:00 a.m., most every week-end and sometimes during the week also. She has gone to the apartment where the music is coming from and requested that they lower the music, and they have thanked her for' telling them and not going to the police and they have cooperated with her re- quest. She is not sure that these are the same people who she contacted. Councilman Imperial inquired about the possibility of selec- tive enforcement on the situation. Irene Seaman, 2631 Brighton, owner of the property where the Greer family live, stated that the noise is disruptive to her ten- ants and may cause them to move. Maria Ochoa, 2536 N. Brighton, stated that the noise is getting worse all the time. Lt. Howard Tait stated that Sgt. Robert Owen will be assigned to this problem to work for a solution. Councilman Hunter requested that the City Attorney research the possibility of a known existing problem so this Council could initiate the abatement of same. Robert Kress, City Attorney, stated that the problem with the request is that that kind of an abatement action is necessarily proceeded by a series criminal prosecutions, and after list6ning to Lt. Tait's suggestion and feels it is an excellent proposal and he stated that he would work with Lt. Tait and Sgt. Owens for a solution to the problem. III. LEGISLATIVE A. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. CC-E AUTHORIZATION TO ATTEND NATIONAL LEAGUE OF CITIES ATLANTA, NOVEMBER 29-DECEMBER 3, 1980. Councilman Taylor stated that he wanted to voice his "no" vote on Item E. Mayor Tury stated that he would prefer that this Conference be limited to the City Council and the City Manager. Councilman Taylor made a motion to deny this request, but the motion died due to a lack of a second. MOTION BY COUNCILMAN HUNTER, SECONDED BY MAYOR-. TURY the City Council and the City Manager be authorized to attend the National League of Cities in Atlanta, November 29-December 3, 1980. Vote resulted: AYES: Councilmen Hunter, Imperial and Mayor Tury NAYES: Councilman Taylor ABSENT: Councilman Cichy ABSTAIN: None Whereupon the Mayor declared said motion duly carried dnd so ordered.- V. MATTERS FOR DISCUSSION & ACTION B. CANDIDATE'S STATEMENTS FUNDS DUE CITY MOTION BY COUNCILMAN HUNTER, SECONDED BY COUNCILMAN IMPERIAL that the City Clerk file Small Claims Court action to collect public funds from Peter Sacco, candidate for City Councilmember. Vote resulted: AYES: Councilmen Hunter, Imperial and Mayor Tury NAYES: None ABSTAIN: Councilman Taylor ABSENT: Councilman Cichy Whereupon the Mayor declared said motion duly carried. MOTION BY COUNCILMAN HUNTER, SECONDED BY COUNCILMAN IMPERIAL that the City Clerk file Small Claims Court action to collect, public funds from Roberta Trujillo, candidate for City Councilmember. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. Councilman__I'mperial requested that the record show the reason for his "yes" vote for Mr. Sacco was because.even though Mr. Sacco's occupation was not spelled out in its entirety it did not say that Mr. Sacco was doing something that he wasn't doing. Part of his job would be gardening and if he goes into the ornamental iron as- pect of it is another thing, but for him not to be allowed to pay for this expenditure would be a gift of tax payers money. Mayor Tury stated that he did not complain in-time, and he did have.ample time. C. PARKING PROBLEM--4108 N. ROSEMEAD BLVD. MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL that the Traffic Commissions recommendation be approved. Vote re- sulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. Page l#5 80 VI. MATTERS FROM OFFICIALS A. SETTING STUDY SESSIONS Mayor Tury requested that a Study Session be set for Rosemead Blvd., beautification on August 26, 1980 immediately following the RRA Meeting. Councilman Taylor requested that a Study Session be set for sidewalks as far as the 1911 Assessment Act for property improvement on September 9, 1980 immediately following the RRA Meeting. Councilman Taylor requested that the landscaping mainten- ,ance on Walnut Grove Blvd. and Rosemead Blvd. under the San Bernardino Freeway be placed on the next Council Meeting Agenda. Councilman Taylor requested that a memo be prepared in chronological order as to what has happened and if Cal Trans is responsible or if it is the City's responsibility to main- tain the landscaping in those areas. Frank G. Tripepi, City Manager, stated when a letter from Cal Trans is received stating that the City is responsible for the maintenance, the Council will be notified. Robert Dickey, Assistant Manager, stated-that a copy of an agreement has been received relinquishing the State Highway there that goes back to 1963, and the process that the City Manager is involved is to double check and verify this. B. Juan Nunez inquired if the street improvement projects included Del Mar. Mayor Tury stated these projects do not include Del Mar at this time.
