SUBJECT: CALIFORNIA LADYHAWKS REQUEST FOR CONTINUED FEE -
WAIVED USE OF SPORT FACILITIES
SUMMARY
Due to its long affiliation with the City of Rosemead, City Council authorized the fee waived
use of sports facilities at Garvey Park for the California LadyHawks, per the organization's
request, at its regular meeting of September 28, 2010. Further, City Council extended that
fee waiver at its February 22, 2011 regular meeting. City Council authorization was
necessary as the LadyHawks do not possess 501(c)(3) non - profit agency status, which is a
required for fee waiver. City Council authorized the fee waiver with the understanding that
the LadyHawks would pursue, the required non - profit status.
In its effort to do so, the California Ladyhawks has informed the City that the organization
has completed and re- submitted its Articles of Incorporation with the state, established a
Board of Directors, had their suspension (for failure to complete the process in 2006) lifted
by the California Secretary of State, and filed Form 1023 (Application for Recognition of
Exemption) and paid required fees to the Internal Revenue Service. Thus, they are asking
that City Council continue their fee - waived use.
Staff Recommendation
That the City Council provide direction regarding a further extension of fee - waived use of
sports facilities for the California Ladyhawks.
FISCAL IMPACT
As the Ladyhawks currently use the facility, this extension has added no fiscal impact.
