ANGELUS AVENUE
SUMMARY
The Southern California Edison Company (SCE) has requested that the City of
Rosemead grant an easement for pole lines and cross -arms within and over a twelve
(12) foot wide strip of land lying within Los Angeles County Assessor's Parcel No. 5283-
032 -903. This parcel is owned in fee by the City of Rosemead and located within the
Alhambra Wash Los Angeles County Flood Control Channel. An existing pole line that
is owned and operated by SCE is currently at this location. This grant of easement will
allow cross arms to be installed for additional overhead electrical supply systems and
communication systems.
Staff Recommendation
It is recommended that the City Council:
1. Approve Resolution No. 2011 -51, determining that the value of the proposed pole
line and cross -arm easement over Assessor's Parcel No. 5283 - 032 -903 is of
nominal value and authorizing the grant of easement to the Southern California
Edison Company.
2. Authorize the City Manager to sign the attached grants of easement within and
over Los Angeles County Assessor's Parcel No. 5283 - 032 -903.
DISCUSSION
An existing pole line, owned and operated by the Southern California Edison Company,
crosses over Los Angeles County Assessor's Parcel No. 5283 - 032 -903. This parcelis
owned in fee by the City of Rosemead and is located within the Alhambra Wash just to
the east of the intersection of Klingerman Street and Angelus Avenue.
The Southern California Edison Company has requested the granting of a twelve (12)
foot wide easement to be centered on the alignment of the existing pole line which
presently is without cross -arms. The Southern California Edison Company has provided
a

a legal description of the proposed easement which the City Engineer has reviewed and
found appropriate for the grant of easement.
FINANCIAL REVIEW
Since the proposed easement passes over land encumbered by the Los Angeles
County's Alhambra Wash flood control channel the land owned in fee by the City of
Rosemead is of nominal value. Further, there will be no impact to the City's General
Fund.
ENVIRONMENTAL REVIEW
The Southern California Edison Company has owned and operated a pole line at this
location for many years and the addition of cross -arms and other overhead electrical
supply systems and communication systems will have no significant environmental
impact.

Scope of Work
PURPOSE OF PERMIT: To authorize the work described below affecting the subject stream in accordance with the submitted plan, Los Angeles
County Flood Control District Drawing No. 26 -F298 (Los Angeles County Department of Public Works Drawing No. PF555154).
WORK DESCRIPTION: install a fiber optic cable on existing poles, crossing over the District's easement per submitted plan. Allow access into District
right of way, If necessary, to perform work.
PermiHee must keep the gate lacked at all times and shall prevent unauthorized access into the District's right of way while exercising this permit.
PERMITTEE MUST NOTIFY THE ENGINEERING SUPPORT UNIT OF FLOOD MAINTENANCE -EAST OFFICE AT (626) 445 -7630 AT LEAST TWO
DAYS PRIOR TO STARTING ANY WORK UNDER THIS PERMIT. FAILURE TO SO NOTIFY IS CAUSE FOR REVOCATION OF PERMIT. SHOULD
PERMITTEE FAIL TO TAKE ACTION WITHIN 180 DAYS FROM THE DATE OF ISSUANCE OF THIS PERMIT OR FAIL TO ACTIVELY AND

Use of District's right of way for the construction or activity authorized under this permit is tantamount to agreeing to the conditions

GENERAL PROVISION NO.2 28- DEC -10 GMEKHAIEL
Permittee shell be responsible for notifying his contractor and all subcontractors of the provisions of this permit. No work will be started
until a copy of this permit is given to the contractor and each of his subcontractors. Further. the copy will be left at the site of the work
being done by each contractor (G2)
GENERAL PROVISION NO.3 28- DEC -10 GMEKHAIEL
Permittee is notified that in accordance with the STATE OF CALIFORNIA CONSTRUCTION SAFETY ORDERS. Section 1303, the permittee or

During the period of operations conducted under the permit. Permittee shall maintain in effect an insurance policy (minimum limit S
ONE million) naming the Los Angeles County Flood Control DistrictrLos Angeles County Department of Public Works andlor U.S. Army
Corps of Engineers as co- Insured with respect to these operations. A copy of this policy shall be submitted to the District for inclusion in
the District file copy of this permit. Expiration or cancellation of the insurance policy shall constitute revocation of this permit.(G24)
GENERAL PROVISION NO. 64 11- JAN -11 GMEKHAIEL
Access to the channel invert or use of the invert for storage or materials is prole bited.(G64)
PROVISION WORK IN CHANNEL NO.5 11- JAN -11 GMEKHAIEL
Permittee shall obtain a five -day clear weather forecast before conducting any operations within the channel and shall work only
when no rain is forecast for the next five days. as determined by the District's inspector. Operations and access to the channel invert are
specifically prohibited - during, rainfall or excessive storm flow. Once operations under this permit are initiated. work shall be conducted
in a diligent manner until completed. The permitter shall not hold the District responsible for any damage due to news within the

STANDA.IW FLOOD CONTROL PERMIT PROVISIONS
A. This permit is valid only for the purpose specified herein. No change of purpose as outlined in application or
drawings submitted with application is permitted except upon written permission of the Chief Engineer or his
representative.
B. Activities and uses authorized under this permit are subject to any Instructions of the Chief Engineer or his
representative. ALL INSTRUCTIONS MUST BE STRICTLY OBSERVED.
C. Permittee shall assume entire responsibility for all activities and uses under this permit and shall save the District
and Los Angeles County free and harmless from any and all expense, cost, or liability In connection with or resulting
from the exercise of this permit Including, but not limited to, property damage, personal injury, and wrongful death.
D. Any damage caused to Flood Control structures by reason of exercise of this permit shall be repaired, at the
permittee's sole expense, to the satisfaction of the District, Should the permittee neglect to promptly make repairs, the
District may perform such work or have others perform the work, and the permittee agrees to reimburse the District for
all costs of the work so performed upon receipt of a statement thereof.
E. Any structure or portions thereof or plantings placed on District rights of way or which affect District structures must
be removed, revised, and /or relocated by permittee without cost to the District, or any other public agency the District
shall so designate, should future activities or policy so require.
F. This permit is valid only to the extent of District jurisdiction. Acquisition of permits required by other affected
agencies and consent of underlying fee owner(s) of District easement lands are the responsibility of the permittee.
NOTHING CONTAINED IN THIS PERMIT SHALL BE CONSTRUED AS A RELINQUISHMENT OF ANY RIGHTS
NOW HELD BY THE DISTRICT.
G. This permit is subject to all prior unexpired permits, agreements, easements, privileges, or other rights, whether
recorded or unrecorded, in the area specified by this permit. Permittee shall make his own arrangements with holders
of such prior rights.
H. Unless otherwise, specified herein, this permit may be revoked or canceled at any time by the Chief Engineer or his
representative when required for District purposes.
1. Upon written notice of cancellation or revocation of this permit for any cause whatsoever, permittee shall restore
District right of way and structures to their condition prior to the Issuance of the permit and then shall vacate District
property. Should permittee neglect to restore the premises or structures to a condition satisfactory to the Chief
Engineer or his representative, the District may perform such work or have others perform the work, and the permittee
agrees to reimburse the District for all costs of the work so performed upon receipt of a statement thereof.
J. In the event of a District employee work stoppage, the Chief Engineer or his representative reserves the right to
suspend all activity authorized under this permit which requires inspection by the District. Activity authorized by the
permit shall not resume until District approval to do so is given.
K. Unless otherwise specifically provided, all costs incurred by permittee as a result of the conditions of the permit or
exercise by District of any right, authority, or reservation contained therein shall be the sole responsibility of and shall
be borne entirely by the permittee.

CITY OF ROSEMEAD, a municipal corporation (hereinafter referred to as "Grantor "), hereby grants to SOUTHERN
CALIFORNIA EDISON COMPANY, a corporation, its successors and assigns (hereinafter referred to as "Grantee "), an
easement and right of way to construct, use, maintain, operate, alter, add to, repair, replace, reconstruct, inspect and remove at
any time and from time to time overhead electrical supply systems and communication systems (hereinafter referred to as
"systems "), consisting of poles, guy wires and anchors, crossarms, wires and other appurtenant fixtures and /or equipment
necessary or useful, for distributing electrical energy and for transmitting intelligence by electrical means, in, on, over, along and
across that certain real property in the County of Los Angeles, State of California, described as follows:
For legal description see Exhibit "A" , attached hereto and by this reference made a part hereof.
Grantor hereby also grants to Grantee, its successors and assigns, and its and their contractors,
agents and employees, the right of free access to said systems and every part thereof, at all times, for the
purpose of exercising the rights herein granted, and the right to clear and to keep clear the above
described real property, free from explosives, buildings, equipment, brush, combustible material and any
and all other obstructions of any kind, and the right to trim or remove any tree or shrub which, in the
opinion of Grantee, may endanger said systems, or any part thereof, or interfere with the exercise of the
rights herein granted.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ROSEMEAD, CALIFORNIA, AUTHORIZING THE CITY MANAGER
TO EXECUTE A GRANT OF EASEMENT TO THE
SOUTHERN CALIFORNIA EDISON COMPANY WITHIN AND OVER
LOS ANGELES COUNTY ASSESSOR'S PARCEL NO. 5283-032-903
OWNED IN FEE BY THE CITY OF ROSEMEAD
WHEREAS, The Southern California Edison Company has owned and operated a pole line for
electrical supply systems and communications systems for many years within and over the parcel; and
WHEREAS, The Southern California Edison Company has requested an easement for pole lines
and cross -arms within and over a two (2) foot wide strip of land centered on the alignment of the existing
pole line within and over the parcel ; and
WHEREAS, The Los Angeles County Flood Control District has issued a permit for installing a new
fiber optic cable (Permit # PCFL 201004706) within and over the proposed easement; and
WHEREAS, the value of the proposed easement to be granted is nominal.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemead, California, as
follows:
Section 1. That the City Council of the City of Rosemead hereby directs and authorizes the City
Manager and City Clerk to execute the grant of easement to the Southern California Edison Company as
Attachment B within and over those portions of Los Angeles County Assessor's Parcel No. 5283 - 032 -903
as being owned in fee by the City of Rosemead.
Section 2. The City Engineer and /or his designee is hereby authorized to record the grant of
easement for the parcel in the Office of the Clerk/Recorder for the County of Los Angeles.
Section 3. That the City Clerk of the City of Rosemead shall certify to the adoption of this
Resolution which shall become effective upon its approval by the City Council.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Rosemead on the 27th Day of September 2011.
