CC - Minutes - 08-24-11Minutes of the Community Development Commission and City Council Special Meeting August 24, 2011 The Special meeting of the Rosemead Community Development Commission and City Council was called to order by Mayor Ly at 6:06 p.m. in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PRESENT: Chair/ Mayor Ly, Vice- Chair/ Mayor Pro Tern Armenta, Commissioner /Council Members Alarcon, and Clark ABSENT: Council Member Low STAFF PRESENT: City Manager Allred, City Attorney Richman, Assistant City Manager Hawkesworth, Director of Finance Brisco, Director of Parks and Recreation Montgomery- Scott, and City Clerk Molleda 1. PUBLIC COMMENTS FROM THE AUDIENCE - None 2. MATTERS FROM EXECUTIVE DIRECTORICITY MANAGER & STAFF A. Enforceable Obligations Payment Schedule On August 11, 2011, in response to a lawsuit filed by the League of California Cities and the California Redevelopment Association, the California Supreme Court issued a stay on the implementation of AB 1X 26 and its companion legislation AB 1X 27. AB 1X 26 mandates the elimination of redevelopment agencies by October 1, 2011, while AB 1X 27 allows for the continuation of redevelopment agencies indefinitely if a city agrees to participate in a Voluntary Alternative Redevelopment Program by making significant annual financial payments to the State. The Rosemead City Council has previously adopted an Ordinance to participate in the Voluntary Alternative Redevelopment Program. Last week, on August 17, 2011, the Supreme Court issued an order modifying its stay on AB 1X 26 -27 to clarify ambiguities. The Supreme Court's most recent order makes it clear that all redevelopment agencies must approve an Enforceable Obligation Payment Schedule (EOPS) prior to August 29, 2011. Accordingly, the Community Development Commission Board will consider approval of the required EOPS for the remainder of 2011. Recommendation: That the Community Development Commission approve the required EOPS for the remainder of 2011. Rosemead Community Development Commission and City Council Special Meeting Minutes of August 24, 2011 Page 1 of 2 City Attorney Richman stated that on August 11th the Supreme Court issued its stay regarding legislation dealing with the demise of Redevelopment or the opt -in option. Previously it was not clear if cities that had adopted their opt -in ordinance had to adopt an enforceable obligation schedule. Clarification has now been provided and the Supreme Court stated that cities are to adopt an enforceable obligations schedule by August 28th. Mrs. Richman explained that staff worked on a schedule on the city's standing obligations and once adopted the payment schedule will be sent to various State entities and the County Auditor. Also, the California Redevelopment Association has asked for clarification from the Supreme Court as to whether cities that have adopted their opt -in ordinances were exempt from the stay of AB 1X 26. Juan Nunez — asked since Council previously adopted an ordinance to opt -in voluntary, does the City have the money to pay the obligation payments. Mayor Ly replied yes, the City did have the money to pay the State. Mr. Nunez — asked if the City will impose a tax on residents to pay for the enforceable obligations payments. Mayor Ly clarified that the City will not enforce a tax to residents to help pay the State. Vice-Chair/Mayor Pro Tem Sandra Armenta made a motion, seconded Commissioner /Council Member William Alarcon to approve the required Enforceable Obligation Payment Schedule. Vote resulted in: Yes: Alarcon, Armenta, Clark, Ly No: None Abstain: None Absent: Low 3. MATTERS FROM COMMISSIONICITY COUNCIL - None 4. ADJOURNMENT The meeting adjourned at 6:11 p.m. The next regular joint Community Development Commission and City Council meeting is scheduled to take place on September 13, 2011 at 6:00 p.m. and 7:00 p.m., respectively.
