MINUTES OF THE REGULAR MEETING
OF THE ROSEMEAD CITY COUNCIL
DECEMBER 13, 1977 AT 8:00 P. M.
The regular meeting of the Rosemead City Council was
called to order by Mayor Cichy in the Conference Room of the
City Hall, 8838 E. Valley Blvd., Rosemead, California at 8:00
P. M.
The Pledge to the Flag was led by Councilwoman Trujillo
The Invocation was.delivered by Rev. Hewett, Rosemead
Baptist Church
ROLL CALL OF OFFICERS:
Present: Councilmembers Hunter, Imperial, Taylor, Trujillo
and Mayor Cichy
Absent: None
APPROVAL OF MINUTES - November 14, 1977 - Special Meeting
MOTION BY COUNCILMAN HUNTER, SECONDED BY COUNCILMAN IMPERIAL
that the Minutes of the Special Meeting of November 14, 1977 be
approved. Vote resulted:

The Mayor declared said motion duly carried and so ordered.
APPROVAL OF MINUTES - November 22, 1977 - Regular Meeting.
MOTION BY COUNCILWOMAN TRUJILLO, SECONDED BY COUNCILMAN
IMPERIAL that the Minutes of the Regular Meeting of November 22,
1977 be approved. Vote resulted:

APPROVAL OF MINUTES - November 28, 1977 - Special Meeting
MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILWOMAN
TRUJILLO that the Minutes of the Special Meeting of November 28,
1977 be approved. Vote resulted:

The Mayor declared said motion duly carried and so ordered.
Miss Rosemead Jr. Miss, Carol Dibble, was presented to the
Rosemead City Council and pictures were taken.
1. Resolution No. 77-79 was presented for adoption:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD
ALLOWING CERTAIN CLAIMS & DEMANDS IN THE SUM OF $215,013.
NUMBERED 25552 THROUGH 25690 INCLUSIVELY
MOTION BY COUNCILWOMAN TRUJILLO, SECONDED BY COUNCILMAN
IMPERIAL that Resolution No. 77-79 be adopted and the reading
in full be waived. Vote resulted: .

Councilman Taylor requested that he be billed for the dinner
for his wife at T & J's on the evening of November 28, 1977.
Mayor Cichy stated that he would receive from the Finance
Director ascsoon as it was available.
MOTION BY COUNCILWOMAN TRUJILLO, SECONDED BY COUNCILMAN
IMPERIAL that reading in full be waived. Vote resulted:

MOTION BY COUNCILWOMAN TRUJILLO, SECONDED BY COUNCILMAN
IMPERIAL that Resolution No. 77-79 be adopted. Vote resulted:

Whereupon the Mayor declared said motion duly carried and
so ordered.
Councilman Taylor requested that the record show that the
reason for his "no" vote was because of checks numbered 25552,
25603, 25662, and 25681.
2. SETTING PUBLIC HEARING - REVENUE SHARING INPUT & AUTHORI-
ZATION FOR CITY CLERK-TO ADVERTISE - December 27, 1977
Councilwoman Trujillo inquired if the Revenue Sharing Hear-
ing was for funds for the present year or the coming year.
Frank Tripepi, City Manager, stated that a Public Hearing
is required prior to the end of this calendar year on the un-
appropriated $80,000 balance of the 1977-78 funds which is
available for distribution.
Councilwoman Trujillo requested that an announcement of
the Revenue Sharing Hearing be placed in the Sun Independent.
MOTION BY COUNCILWOMAN TRUJILLO, SECONDED BY MAYOR'CICHY
that the Public Hearing for Revenue Sharing be set for December
27, 1977 and that the City Clerk be authorized to advertise,
and also that an announcement be placed in the Sun Independent.
Vote resulted:
AYES: Councilmembers Taylor..-Trujillo and''Cichy,
NAYES: Councilman Hunter and Imperial
Whereupon the Mayor declared said motion duly carried and
so ordered.
Councilman Hunter stated that the reason for his "no" vote
was only because of the amendment that an announcement be placed
in the Sun Independent as well as the normal legal advertisement.
3. SETTING PUBLIC HEARING - Amendment of Section 89 of the Sub-
Division Ordinance regarding Fees for Tract Maps - December
_ 27, 1977.
MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILWOMAN
TRUJILLO that a Public Hearing be set for the Amendment of
Section 89 of the Sub-Division Ordinance regarding Fees for
Tract Maps on December 27, 1977. Vote resulted:

The following Resolution No. 77-80 was presented for adoption:

REQUESTING AN ALLOCATION AND PAYMENT OF COUNTY AID TO
CITIES FUNDS FOR THE MAINTENANCE OF SELECT SYSTEM STREETS
MOTION BY COUNCILWOMAN TRUJILLO, SECONDED BY COUNCILMAN
IMPERIAL that Resolution No. 77-80 be adopted and the reading

5. The following Resolution No. 77-81 was presented for adoption:

MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILWOMAN
TRUJILLO that Resolution No. 77-81 be adopted and the reading
in full be waived. Vote resulted:

6. CONTRACT CITIES LEGISLATIVE CONFERENCE IN SACRAMENTO
ON JANUARY 17-18, 1978 & REQUESTING AUTHORIZATION TO ATTEND
FOR CITY COUNCIL, CITY MANAGER, CITY CLERK & PAUL STROHMAN
& ROBERT SARNO.& CITY ATTORNEY
Councilwoman Trujillo stated that she did not feel that
the City of Rosemead should pay for the Sheriff's and Fire
Departments representatives.
MOTION BY MAYOR CICHY, SECONDED BY COUNCILMAN HUNTER that
the City Council, City Manager, City Clerk, Paul Strohman, Bob
Sarno and the City Attorney be authorized to attend the confer-
ence in Sacramento on January 17-18, 1978. Vote resulted:
AYES: Councilmembers Hunter, Imperial and Mayor Cichy
NAYES: Councilmembers Taylor and Trujillo
Whereupon the Mayor declared said motion duly carried and
so ordered.
7. GARVEY DRAIN PLANS & SPECIFICATIONS - Approve and Authorize
District to proceed with construction.
MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILWOMAN
TRUJILLO that the Plans & Specifications of the Garvey Drain
Project be approved and authorization be granted to the Dis-
trict to proceed with construction. Vote resulted:

8. CITY OF NORWALK'S COMMUNICATION REGARDING EFFORTS OF
COUNTY AUDITOR PARTIAL TAKEOVER OF VEHICLE CODE FINE & FOR-
FEITURES
Frank Tripepi, City Manager, recommended that the City
Attorney be directed to prepare a Resolution supporting the
City of Norwalk's efforts in opposing the County.
Councilman Taylor requested also that a report be prepared
as to how much the City of Rosemead would be losing by the take-
over of the County Auditor of the vehicle code fine and forfeit-
ures.

There being no objection, it was so ordered
9. Claim against the City on behalf of Arma May Cox.
Ed Dilkes, City Attorney, recommended that the claim be
denied.
MOTION BY COUNCILWOMAN TRUJILLO, SECONDED BY MAYOR CICHY
that the against the City on behalf of Arma May Cox be denied.
Vote resulted:

10. SETTING PUBLIC HEARING - ADOPTION OF 1977 EDITIONS OF
L. A. COUNTY BUILDING CODE, PLUMBING•CODE, MECHANICAL CODE,
& AMENDMENTS IN ELECTRICAL CODE BY REFERENCE - DECEMBER 27,
1977.
MOTION BY COUNCILWOMAN TRUJILLO, SECONDED BY COUNCILMAN
TAYLOR that a Hearing be set for December 27, 1977 for the
adoption of the LL. A. County Building Code, Plumbing Code,
Mechanical Code and Amendments in the Electrical Code by re-
ference. Vote resulted:
UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE.
The Mayor declared said motion duly carried and so ordered.
11. DISCUSSION ON JOINT POWER INSURANCE AUTHORITY
Councilman Taylor commented on a Joint Powers Insurance
Authority Meeting that was held on November 30, 1977 which he
had attended. He discussed the fact that the premium for the
City of Rosemead had increased from $28,000 to $68,000 arbi-
trarily, and he wanted the Council to know what was occuring.
Mayor Cichy requested that a letter be sent to all member
cities and to the Joint Powers Insurance Authority expressing
the City's feeling on how the Meeting was conducted and espe-
cially on being in violation of the by-laws that they had set
forward. The vote changing the method of assessng'.the City
would appear to be an illegal contractural action.
12. Councilman Taylor also inquired about the issue of oral
communication from the audience at the first council meeting
of the month.
Councilman Imperial andoCouncilwoman Trujillo concurred
with Councilman Taylor in requesting that audience participa-
tion be allowed at all public meetings.
Mayor Cichy stated that it has been the policy of the
Council that matters from officials require 24 hour notice to
the Mayor before it can be brought up at the Council Meeting.

TRUJILLO that Oral Communication both at the beginning and at
the end of the Meeting and Matters from Officials be included
on the Agenda for the first meeting of the month as it is on
the second meeting of the month. Vote resulted:

TAYLOR that the request made by Councilwoman Trujillo to be
allowed to bring up a matter from officials at this time be
approved. Vote resulted:
AYES: Councilmembers Imperial, Taylor and Hunter.
NAYES: Mayor
ABSTAINED: Councilwoman Trujillo
Whereupon the Mayor declared said motion duly carried and so
ordered.
13. Councilwoman Trujillo commented on a 2~ page press release
regarding Councilman Hunter1-s Rosemead Racquetball Club and in-
quired who authorized this release.
Mayor Cichy directed the City Attorney to investigate the
matter and to inform the entire Council in writing by the next
Council Meeting of his findings.
14. Mayor Cichy requested that the Council Meeting be adjourned.
Councilman Taylor requested that the staff research what is
the Council policy as far as audience participation.
MOTION BY COUNCILMAN HUNTER, SECONDED BY MAYOR CICHY that
the Council Meeting be adjourned. Vote resulted:

NAYES: Councilman Taylor
Whereupon the Mayor declared the Meeting adjourned at 9:00
p. m., to the next regular meeting of December 27, 1977 at 8:00
