MINUTES OF THE ADJOURNED MEETING
OF THE ROSEMEAD CITY COUNCIL
NOVEMBER 4. 1977 -'.AT 8:00 P. M.
The adjourned meeting of the Rosemead City Council was
called to order by Mayor Cichy in the Conference Room of the
City Hall at 8838 E. Valley Boulevard, Rosemead, California
at 8:00 p. m.
The pledge to the Flag was led by Councilman Taylor.
The Invocation was delivered by the City Clerk.
ROLL CALL OF OFFICERS:
Present: Councilmembers Imperial, Hunter, Taylor, Trujillo
and Mayor Cichy
Absent: None
Ex-Officio: Dickey, Dilkes, Fleischman, Burbank, Tripepi,
and Poochigian
APPROVAL OF MINUTES - October 25, 1977 - Regular Meeting
MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL
that the Minutes of the regular meeting of October 25, 1977 be
approved. Vote resulted:
AYES: Councilmembers Taylor, Trujillo, Imperial and Cichy
NAYES: None
ABSTAINED: Councilman Hunter
Whereupon the Mayor declared said motion duly carried and
so ordered.
1. RES. 77-68 CLAIMS AND DEMANDS
The Following Resolution was presented for adoption and
reading in full be waived.
RESOLUTION NO. 77-68
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD ALLOWING CERTAIN CLAIMS & DEMANDS IN THE
SUM OF $208,847.22 NUMBERED 25315 THROUGH 25423
MOTION BY COUNCILWOMAN TRUJILLO,-SECONDED BY COUNCILMAN
IMPERIAL that Resolution No. 77-68 be adopted and the reading
in full be waived. Vote resulted:

Councilman Taylor stated that he wanted the record to show
that his "no" vote was for check no. 25423, Administrative
Luncheons.
2. Authorization for„Membership to the U. S. Conference of
Mayors.
MOTION BY COUNCILMAN HUNTER, SECONDED BY COUNCILMAN IMPERIAL
that membership'to the U. S. Conference of Mayors be authorized.
Vote resulted:

The Mayor declared said motion duly carried and so ordered.
3. Consideration of Amendment Alternatives to Refuse Contract.
Thec,three alternative methods of collecting and billing for
trash services were discussed by the Council and questions were
directed to the City Attorney.
Councilman Taylor requested that a survey be made regarding
the-alternative methods that are being used by the other cities
in the San Gabriel Valley.
MOTION BY COUNCILWOMAN TRUJILLO,: SECONDED BY COUNCILMAN
HUNTER that the City Attorney be directed to proceed with the
implementation of aAl.ternative No. 2 and to prepare the neces-
sary documents and'that the action of this Council be relayed
to the Court for the trial of Bezaire and Maloof v. Rosemead.
Vote resulted:

4. Consideration of Restrooms in Rosemead Park.
MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILWOMAN
TRUJILLO that the restrooms be located on the west side and
adjacent to the Edison Building and that General Funds money
be utilized for the restrooms. Vote resulted:

5. Authorization for City Clerk to attend Election Seminar-
in Irvine, Registry Hotel, November 16-18, 1977.
MOTION BY COUNCILWOMAN TRUJILLO, SECONDED BY COUNCILMAN
IMPERIAL that the City Clerk be authorized to attend Election
Seminar in Irvine, November 16-18, 1977. Vote resulted:
UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE.

6. Request from Robert DeCocker regarding Annexation #45 &#_46
Mayor Cichy stated that there being no objection,to the
request that Mr. Robert DeCocker circulating the petition re-
garding the annexation of area #45 & 46, it was so ordered.

8. Allocation and Payment of County Aid to City Funds.
The following Resolution was presented for adoption:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD REQUESTING AN ALLOCATION & PAYMENT OF
COUNTY AID TO CITIES FUNDS FOR THE MAINTENANCE
OF SELECT SYSTEM STREETS
MOTION BY COUNCILMAN TAYLOR, SECONDED BY COUNCILMAN IMPERIAL
that Resolution No. 77-69 be adopted and the reading in full be
waived. Vote resulted:
UPON ROLL CALL.ALL COUNCILMEMBERS PRESENT VOTED AYE.
The Mayor declared said motion duly carried and so ordered.
7. Council discussion of Ordinance No. 439 & No. 456 regard-
ing Outdoor Display.
Frank G. Tripepi, City Manager, stated that Ordinance No.
456 was now in effect, and any business violating this ordinance
will be cited by the Sheriff's Department.
Ed Dilkes, City Attorney, stated that legally, it would be
impermissable to enforce an ordinance against some individuals
and intentionally not enforce it against others.
The City Attorney stated that when an up-grading process
is going on,the courts do not want to see individuals lose their
-investments, but courts get very strong on enforcement if indi-
viduals are dragging their feet or are just being obstinate.
Councilman Imperial inquired who would be the decider of
the fact of sufficient or insufficient progress being made.
The City Attorney stated that the Courts would be making
the decision, but that the City's imput would be a major influ-
ence on this decision.
The City Manager stated that everyone had at least five
months to rectify the problem and now that the Ordinance is
in effect they are asking for an extension.
Mr. Ralph Monaca, owner of fruitstand at Mission & Valley
Blvd., requested an extension.
Councilman Imperial stated that this Ordinance had to be
enforced and then the City will handle the possible extensions.
Mayor Cichy stated that before the individuals that are
cited go to trial,they should meet with the City Manager and
City Attorney and the City Manager will return to the Council
with a recommendation.
MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN
HUNTER that the Staff be directed to issue citations forthwith.
Vote resulted:

Lt. Ed Coffine of the Sheriff's Department stated that the
citation will simply indicate that the individual is in violation
of the Ordinance and that the operator, who is present at that
time, promises to appear.
Councilman Taylor inquired as to the process of citing these
individuals.
Frank G. Tripepi, City Manager, stated that the citations
will start with the listed businesses as they have been notified
by hand delivered letters some time ago. Any other business
that is in violation of this ordinance will be notified in a
like manner and if the violation is not corrected in a suitable
length of time, these violators will also be cited by the Sheriff's
Department.
The Council Meeting was adjourned at 9:30 o'clock p. m.,
to the next regular meeting on November 22, 1977 at 8:00 p. m.
