Valley Blvd., Rosemead, California at 8:00 p. M. , The Pledge to the Flag was led by Mayor'Pro Tem Imperial The Invocation was delivered by Hugh Foutz, City Treasurer ROLL CALL OF OFFICERS: Present: Councilmembers Hunter, Imperial, Taylor, Trujillo and Mayor Cichy Absent: None Ex-Officio: Dickey, Dilkes, Foutz and Poochigian APPROVAL OF MINUTES - August 23, 1977 - Regular Meeting MOTION BY COUNCILMAN TAYLOR, SECONDED BY MAYOR CICHY that the minutes of August 23, 1977 be approved. Vote resulted: AYES: Councilman Taylor NAYES: None ABSTAINED: Councilmembers Hunter, Trujillo, Imperial and Mayor Cichy Whereupon the Mayor declared said motion duly carried and so ordered. CONSENT CALENDAR (ITEMS A & E Deferred) CC-B RES. #77-55 CLAIMS & DEMANDS RESOLUTION NO. 77-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLIAMS AND DEMANDS IN THE SUM OF $299,617.47 NUMBERED 24858 - 24983 INCL. MOTION BY COUNCILWOMAN TRUJILLO, SECONDED BY COUNCILMAN IMPERIAL that Resolution No. 77-55 be adopted and the reading in full be waived. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. RES. #77-56 CLAIMS & DEMANDS RESOLUTION NO. 77-56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $17,310.79 NUMBER 24984 - 24987 INCL. 140TION BY COUNCILMAN IMPEnIAL, SECONDED BY COUNCILWOMAN TRUJILLO that Resolution No. 77-56 be adopted and the reading in full be waived. SETTING HEARING ESTABLISHING A NEED FOR UNDERGROUND UTILITY DISTRICT ON SEPTEMBER 30, 1977 The following Resolution was presented for adoption: RESOLUTION NO. 77-57 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT IN THE AREA SET FORTH ON EX."A" MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN HUNTER that Resolution No. 77-57 be adopted and the reading in full be waived. Vote resulted: UPON ROLL CALL ALL COUNCILMEMBERS PRESENT VOTED AYE. The Mayor declared said motion duly carried and so ordered. ITEMS REQUIRING DISCUSSION & ACTION 1. Midvalley Manpower Consortium Joint Power Agreement Councilman Imperial inquired if an Executive Session could be held regarding the Midvalley Manpower Consortium Joint Power Agreement. Ed Dilkes, City Attorney, stated that he didn't feel this discussion qualified as permitted reasons for an Executive Session. The permitted reasons for such sessions are: 1. A threat to National security. 2. A threat or insurection creating a disruption of public service. 3. The employment or dismissal of a public employee by implication. 4. Pending litigation. 5. Matters having to do with collective bargaining.' Councilman Hunter stated that there is a possiblility of litigation. Ed Dilkes, City Attorney, stated it would be permissible to recess to an executive session to discuss the possibility of litigation. The Council recessed to an executive session at 8:25 p, m. The Council reconvened from executive session at 8:35 p. m. The Attorney, Ed Dilkes, stated that an executive session ' was not held as he met briefly with only Mr. Hunter and Mr. Cichy and discussed two matters that Councilman Hunter had become aware of in discussion with people associated with the Consortium and those matters are proper matters for an Executive Session and can be responded to by confidential memorandums as they do carry with them some potential for litigation. Mayor Cichy inquired if anyone in the audience would care to speak regarding this matter. Sergio Cabanillas, Executive Director, requested that a study session be scheduled before the City takes any action to withdraw from the Consortium as the gravity of the matter may involve some litigation not only with the Consortium but with the City of Rosemead. CM 9-13-77 Page #2 Councilman Hunter stated that he and Councilman Imperial had asked for and received a personnel session with the Board of Directors of the Consortium and he wished to report to the Council that it was his recommendation that it would be of benefit to the City of Rosemead and to the other cities parti- cipating if Rosemead withdrew at this point and time from the Consortium. Councilman Imperial stated every effort has been made to make the Consortium idea work as an asset and he felt that the problem did not lie with Consortium idea nor with the Board of Directors, but with the management of it. Councilwoman Trujillo stated that she had requested a withdrawal from the consortium at the last Council Meeting and she feels that this would be very poor timing to withdraw since so many committments have now been made. Mr. Cabanillas stated that he felt that a better job had been done than was realized by the City of Rosemead, and requested that representatives from Bienvenidos and the Arch- diocese be allowed to express themselves. Mike Sakamoto, Director of Bienvenidos, stated that he was not aware of what the-County's decision would be regarding the funding to them if the City withdrew from the Consortium, but he felt it would be better if the representatives of the City were there in order to have a voice in the decision making of the Consortium. Bob Guttierez, representative of the Archdiocese of Los Angeles, stated that there had been an excellent working re- lationship with the Consortium and there-had. been a minimum amount of paperwork and bureaucratic tie ups to do his job in Rosemead. Councilman Hunter inquired what his job is in Rosemead Mr. Guttierez stated that the diocese is administering approximately a dozen slots in school/work experience program and approximately two dozen during the summer, and the majority of these are utilized at Maryvale Orphanage. MOTION BY COUNCILMAN IMPERIAL that the City of Rosemead withdraw from the Midvalley Manpower Consortium as.of the anniversary date of September 28, 1977. The motion died due to a lack of a second. The Motion was remade. MOTION BY COUNCILMAN IMPERIAL, SECONDED BY COUNCILMAN HUNTER that the City of Rosemead withdraw from the Midvalley Manpower Consortium as of the legal anniversary date or September 28, 1977. Vote resulted: AYES: Councilmen Hunter, Imperial, Taylor and Mayor Cichy NAYES: Councilwoman Trujillo Whereupon the Mayor declared said motion duly carried and so ordered. Mayor Cichy stated that from the very first day this agree- ment became effective it was a great disappointment. CM 9-13-77 Page #3 The Mayor stated that since the majority of the Council will be in San Francisco for a Conference the next regular meeting will be held on September 30, 1977. There being no objection, it was so ordered. The Council Meeting was adjourned at 9:30 p. m.to the next meeting on Friday, September 30, 1977 at 8:00 p. m.
