SUBJECT: CALPERS~WAIVER OF 960-HOUR RULE FOR DON ANDERSON
SUMMARY
Public Employee Retirement Law prohibits a retired annuitant from working more than
960 hours in a fiscal year unless a resolution is adopted in accordance with Government
Code section 21224(h). Don Anderson, a retired CaIPERS annuitant has been working
for the City for approximately two years and is close to his hour limit for the current fiscal
year. Staff is currently working on a permanent plan for his position, and will be ready
to move forward by July 1, 2009.
Staff Recommendation
Staff recommends that the City,Council adopt Resolution 2008-79 (Attached) requesting
an employment extension per Government Code section 21221(h).

The City Attorney has reviewed the proposed Resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEfiIIEAD,
COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, WAIVING THE
CALPERS 960-HOUR RULE FOR DONALD ANDERSON.
WHEREAS, Donald Anderson retired from the City of Duarte in the position of
Director of Public Safety Coordination, effective June 8, 2006; and
WHEREAS, the City of Rosemead appointed Donald Anderson to the position of
Interim Public Safety Director, a position deemed to be of limited duration and requiring
specialized skills, effective December 6, 2006; and
WHEREAS, Donald Anderson is expected to reach his maximum of 960 hours
this fiscal year on or about January 15, 2009; and
WHEREAS, due to the appointment of a new Lieutenant and Sergeant to the City
of Rosemead by the Sheriff's department and the subsequent creation of several new
public safety programs within the community, recruitment for this position has been
postponed pending the appointment of a permanent Director; and
WHEREAS, Donald Anderson has extensive experience in public safety, sheriff
department collaboration and the development of community involvement programs;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD
HEREBY RESOLVES AS FOLLOWS:
That the CaIPERS Board of Administration be requested to approve an extension
in accordance with Government Code section 21221(h) for the temporary
employment of Donald Anderson for 960 additional hours or through June 30,
2009. An appointment made under this section of this subdivision may not
,exceed a total of 12 months. `
