CC - Item 4E - Authorizing City Manager or Designee to Accept Irrevocable Offers of DedicationROSEMEAD CITY COUNCIL STAFF REPORT TO: THE HONORABLE MAYOR AND CITY COUNCIL FROM: JEFF ACCRED, CITY MANAGER DATE: FEBRUARY 14, 2012 l/ SUBJECT: RESOLUTION NO. 2012 -02 AUTHORIZING THE CITY MANAGER, OR HIS OR HER DESIGNEE, TO ACCEPT IRREVOCABLE OFFERS OF DEDICATION SUMMARY Irrevocable Offers of Dedication (IOD) are made in conjunction with private improvement projects and map subdivisions, usually as a condition of approval related to a project. IODs represent a portion of land /real property that is dedicated by a property owner to the City for a public purpose (such as right -of -way enhancement, sidewalk installation, or planting of street trees). IODs are reviewed by the Public Works Department and subsequently presented to the City Council for consideration. After completion of improvement work (e.g. installation of sidewalk, trees), the City can formally accept the offer of real property to be used for public purposes. Approval of the attached resolution will allow the City Manager or designee to accept IODs on behalf of the City. Such delegation will streamline efforts for processing these items. Staff Recommendation It is recommended that the City Council approve Resolution No. 2012 -02, authorizing the City Manager, or designee, at such time as it is appropriate to accept and cause to have the acceptance of irrevocable offers of dedication be recorded by the Los Angeles County Recorder. ANALYSIS An Irrevocable Offer of Dedication (IOD) is typically completed as part of the condition of approval process for new development or subdivisions. IODs are prepared by the developer /proposer and reviewed by the Public Works Department. Subsequently, the IOD is presented to the City Council for review and approval. The City Council then takes action to approve a resolution authorizing the offer to be recorded by the Los Angeles County Recorder. After completing the required improvements (as set forth in the conditions of approval), a formal "acceptance" of the irrevocable offer of dedication is brought back to the City Council. Since this is a routine administrative process, it is recommended that this duty be delegated to the City Manager, or designee. LEGAL REVIEW The attached resolution has been reviewed and approved by the City Attorney. FINANCIAL IMPACT This action is intended to streamline processes and will help save costs involved in preparing staff reports and resolutions for the acceptance of irrevocable offers of dedication. Acceptance Form RESOLUTION NO. 2012-02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR DESIGNEE TO ACCEPT IRREVOCABLE OFFERS OF DEDICATION WHEREAS, section 27281 of the Government Code provides that a governmental agency, by a general resolution, may authorize an officer or agent to consent to such deeds or grants that convey an interest in real property, and WHEREAS, all Irrevocable Offers of Dedication are reviewed by the Public Works Department and approved by the City Council at the time of offer, and that all public improvements associated with said irrevocable offers of dedication are inspected and approved by the Public Works Department at the time of completion, and WHEREAS, provisions of the Rosemead Municipal Code, Subdivision Act, and Building Permit Requirements cause these issues to be routine occurrences, and WHEREAS, the City Manager is the Administrative Head of the City and should thereby be the authorized agent to consent to deeds or grants NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD, DOES HEREBY RESOLVE, FIND, DETERMINE, AND ORDER AS FOLLOWS: Section 1 . That all Irrevocable Offers of Dedication, reviewed by the Public Works Department and approved by the City Council at the time of offer, and that all public improvements associated with said irrevocable offer of dedication have been inspected and approved by the Public Works Department at the time of completion, may be accepted by the City Manager or designee and have the acceptance of irrevocable offers of dedication caused to be recorded by the County Recorder of the County of Los Angeles. Section 2 . That the City Clerk of the City of Rosemead shall certify to the adoption of this Resolution which shall become effective upon its approval by the City Council.
