SUBJECT: APPROVAL OF ENTERTAINMENT PERMIT FOR CAFE CAU VONG,
3365 WALNUT GROVE AVENUE, #B
SUMMARY
This establishment is a cafe serving non - alcoholic beverages and the owner wishes to
allow customers to sing with a "Karaoke" machine. The requested hours of operation
for entertainment will be Sunday through Saturday, 8:00 p.m. to Midnight.
Staff Recommendation:
Staff recommends that the City Council approve an Entertainment License contingent
upon the attached conditions.

LIST OF CONDITIONS
Approval of the Entertainment Permit is contingent upon submittal and
approval of floor plan prior to issuance of business license.
2. Approval of the Entertainment Permit shall not take effect for any purpose until
the applicant has filed with the City of Rosemead a notarized affidavit stating that
he /she is aware of and accepts all of the conditions of approval as set forth in the
letter of approval and this list of conditions, within ten (10) days from the City
Council approval date.
3. The Entertainment Permit is approved for Karaoke entertainment as an
accessory entertainment use to the primary cafb use at Cafe Cau Vong. This
Karaoke Entertainment Permit only allows the use of one (1) Karaoke machine
within the Cafe Cau Vong tenant space.
4. This permit is granted or approved with the City and its City Council retaining and
reserving the right and jurisdiction to review and to modify the permit, including
the conditions of approval based on changed circumstances. Changed
circumstances include, but are not limited to, the modification of the use, a
change in scope, emphasis, size, or nature of the use, or the expansion,
alteration, reconfiguration, or change of use. This reservation of right to review is
in addition to, and not in lieu of, the right of the City, its City Council to review
and revoke or modify any permit granted or approved under the Rosemead
Municipal Code for any violations of the conditions imposed on this permit.
The applicant shall defend, indemnify, and hold harmless the City of Rosemead
or its agents, officers, and employees from any claim, action, or proceeding
against the City of Rosemead or its agents, officers, or employees to attack, set
side, void, or annul, an approval of the City Council concerning the project, which
action is brought within the time period provided by law.
The applicant shall comply with all Federal, State, and local laws relative to the
approved use including the requirements of the Planning, Building, Fire, Sheriffs
and Health Departments.
Entire premises is subject to inspection by the Sheriffs Department at any time
while the business is operating. Any locked or otherwise secured doors will be
opened upon demand.
No alcoholic beverages shall exist on the premises at any time.
No "Adult type videos" (karaoke laser discs) will be utilized.
10. All doors must be closed when utilizing karaoke or any other music.
11. The floor plan and room use shall not change without City and Sheriffs approval.
12. Karaoke entertainment will be provided only between the hours of 8:00 p.m. to
12:00 a.m., Sunday through Saturday.
13. One (1) uniform security guard will be stationed in the parking lot on Fridays and
Saturdays (8:00 p.m. to 1:00 a.m.)
14. The licensee and /or security guard will prevent and discourage loitering inside
and in the parking lot. Such loitering tends to promote violence.
15. The licensee will be in compliance with the City's Noise Ordinance restrictions at
all times. The volume of the karaoke machine will be set in excess of the
predetermined digital volume reading limit (4242).
16. Applicant shall post signage in a prominent position in the premises advising
patrons to exit with due regard for the peaceful enjoyment of the area by other
commercial or residential users, advising patrons that loitering in the parking
facility or areas adjust is strictly prohibited and advising patrons that any
disruption of the area will result in an immediate notification to law enforcement
by Management of licensee or the security guard on duty.
17. Any accumulation of trash in or adjacent to the premises shall be removed
immediately.
18. Any violation of any applicable laws and /or these operating conditions will be
grounds for suspension and /or revocation of these business licenses.
19. In addition to any Entertainment Manager, a responsible person will be on duty
at all times while the business is open. At any such time any regulatory City
official, Sheriffs Deputies, Fire Officials, Health Officials, Building Inspector,
Code Enforcement, etc) announces his arrival at the restaurant, this responsible
person will immediately introduce himself to the regulatory city official and offer
his assistance and cooperate fully with all requests. All management designated
"responsible persons" will be a minimum twenty -one (21) years of age, possess
on his person a valid California (DMV) identification and be able to communicate
effectively with such officials.
20. The public entering the business premises must enter via the main door to the
cafe.
21. The owner will notify the Sheriffs Department if any of the following incidents
occur within the establishment or within (100) feet of the premises: robbery,
assault, firearm crimes, alcoholic related crimes, drug offenses, theft, or any
minors remaining on the premises after 10:00 p.m. without adult supervision.
The premises include all parking areas utilized by this business.
22. No minors under the age of eighteen (18) years will remain in the location
without adult supervision after 10:00 p.m.
23. The site shall be maintained in a graffiti -free state. Any new graffiti shall be
removed within twenty -four (24) hours. A 24 -hour Graffiti Hotline can be called
at (626) 569 -2345 for assistance.
24. The applicant shall be in compliance with the RMC Chapter 1.01.040 (Los
Angeles County Provisions Adopted by Reference) which adopts the County of
Los Angeles ordinance as related to "Nonsmoking Areas in Eating
Establishments" (Title 11.15 Health and Safety).
25. The applicant shall be in compliance at all times with the County of Los Angeles
Code, Title 7, Chapter 7.36 which the City has adopted by reference, pertaining
to Entertainment License.
