PC - Minutes - 04-28-030 PLANNING COMMISSION REGULAR MEETING MINUTES April 28, 2003 CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order by Chairman Loi at 7:00 p.m. in the council chambers of the Rosemead City Hall at 8838 East Valley Boulevard, Rosemead. Commissioner Ortiz led the Pledge of Allegiance. Commissioner Herrera delivered the invocation. ROLL CALL: PRESENT: Chairman Loi, Vice -Chair Herrera, and Commissioner Ortiz ABSENT: Commissioner Breen EX OFFICIO: Price, Johnson, Villaschor, and Duong APPROVAL OF MINUTES Minutes of April 7, 2003. (MO) Motion by Commissioner Ortiz, seconded by Commissioner Alarcon, that the minutes of the City of Rosemead Regular Planning Commission Meeting of April 7, 2003, be APPROVED as submitted. Vote results: YES: LOI, HERRERA, ORTIZ NO: NONE ABSTAIN: NONE ABSENT: BREEN Chairman Loi declared said motion duly carried and so ordered. 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS Deputy City Attorney Stan Price explained the public hearing process and the right to appeal Planning Commission decisions to the City Council. 3. ADMINISTRATION OF OATH The assistant planner administered the oath to members of the audience wishing to speak before the Planning Commission. 4. PUBLIC HEARING A. CONDITIONAL USE PERMIT 03 -919 - 8200 East Garvey Avenue Burt Goralnick has submitted an application to construct a new multi- tenant commercial center to include a Walgreen s pharmacy located at the southeast corner of San Gabriel Boulevard and Garvey Avenue in the C -3 (Medium Commercial) zone. Recommendation: Approve Subject to Conditions. Presentation: Assistant Planner Villaseiior Staff recommendation: APPROVE —for a period of two (2) years, subject to the conditions listed in "Exhibit A." Applicant(s): In the audience. 0 Chairman Loi opened the public hearing to those IN FAVOR of this application: Mr. Burt Goralnick applicant for the proposed project approached the podium to answer any questions the commissioners and staff may have about the project. Neither staff nor commissioners had any questions for Mr. Goralnick. Public hearing was opened to those who wished to OPPOSE the application: Ms. Wilson Lee a business owner at 8208 Garvey Avenue approached the podium to address his concerns about the proposed project. He informed staff and the planning commission that he was not informed of the project by the property owner, and his lease does not expire for another three years. The City Attorney Mr. Price advised Mr. Lee to have his attorney talk to the property owner about the lease. Chairman Loi informed Mr. Lee that the property owner is responsible for informing all tenants about matters such as this one. Mr. Gary Goralnick, who is affiliated with the applicant and the proposed project approached the podium to inform staff, the planning commission that the business owners where the proposed project is to be will be compensated adequately for having to relocate their business. They're being no one further wishing to address the commission; Chairman Loi closed the public hearing segment for this project (MO) Motion by Commissioner Ortiz, seconded by Commissioner Herrera, to APPROVE Conditional Use Permit 03 -919 for a period of one (1) year, subject to the conditions listed in "Exhibit A." Vote results: YES: LOI, HERRERA, ORTIZ NO: NONE ABSTAIN: NONE ABSENT: BREEN Chairman Loi declared said motion duly carried and so ordered. B. CONDITIONAL USE PERMIT 03- 918 -7902 Emerson Place Kin Shing Kwan has submitted an application for the construction of a new single family dwelling with over 2,500 square feet of living area, located at 7903 Emerson Place in the R -2 (Light Multi- Family Residential) zone. Recommendation: Approve Subject to Conditions. Presentation: Assistant Planner Duong Staff recommendation: APPROVE —for a period of one (1) year, subject to the conditions listed in "Exhibit A." Applicant(s): In the audience. Chairman Loi opened the public hearing to those IN FAVOR of this application: None. Public hearing was opened to those who wished to OPPOSE the application: None. N MAP 27036 -3021 Del Mar Avenue Yin Hai, DBA Buddhist Ortho Creed Associates, has submitted an application for the consolidation of three lots into one parcel for the construction of a new assembly hall and parking garage at an existing Buddhist temple, located at 3021 Del Mar Avenue in the C -3 (Medium Commercial) zone. Presentation: Assistant Planner Villasenor Staff recommendation: APPROVE —for a period of two (2) years, subject to the conditions listed in "Exhibit A." Applicant(s): In the audience. Chairman Loi opened the public hearing to those IN FAVOR of this application: Mr. Kai Chan, the architect for the project approached the podium to answer any questions the commissioners and staff may have about the project. Neither staff nor commissioners had any questions for Mr. Chan. Mr. Martin Lin approached the podium to represent the congregation, and to show his support for the project. He informed staff and the planning commission of the need for more space at the temple, as there congregation is growing. Public hearing was opened to those who wished to OPPOSE the application: None. MO) Motion by Commissioner Ortiz, seconded by Commissioner Herrera, to APPROVE Conditional Use Permit 93 -589 (Modification), and Tentative Parcel Map 27036 for a period of two (2) years, subject to the conditions listed in "Exhibit A." Vote results: YES: LOI, HERRERA, ORTIZ NO: NONE ABSTAIN: NONE ABSENT: BREEN Chairman Loi declared said motion duly carried and so ordered. D. CONDITIONAL USE PERMIT 03 -917- 2518 San Gabriel Boulevard Peter Ngai, DBA Faith Alliance Church, has submitted an application to install a portable trailer to be utilized for office space and a Sunday school classroom on property used for religious facilities located at 2518 San Gabriel Boulevard in the M -1 (Light Manufacturing - Alquist Priolo) zone. Recommendation: Approve Subject to Conditions. Presentation: Assistant Planner Duong 0 • Staff recommendation: APPROVE —for a period of one (1) year, subject to the conditions listed in "Exhibit A." Applicant(s): In the audience. Chairman Loi opened the public hearing to those IN FAVOR of this application: Mr. Peter Ngai, the architect for the project approached the podium to answer any questions the commissioners and staff may have about the project. Mr. Ngai had a few questions for staff about permits for installing a trailer on the property, and also the landscaping and parking for the proposed project. Director Johnson answered all of Mr. Ngai's questions and concerns. Commissioner Ortiz asked Mr. Ngai to install a skirt to the base of the trailer for safety reasons. Public hearing was opened to those who wished to OPPOSE the application: None. PC RESOLUTION 03 -19- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 81 -241 FOR THE OPERATION OF AN AFTER - SCHOOL TUTORING PROGRAM AT AN EXISTING RELIGIOUS FACILITY, TO BE LOCATED 1255 SAN GABRIEL BOULEVARD IN THE PD (PLANNED DEVELOPMENT) ZONE. (APN: 5275 - 015 -039, 040,-041) D. PC RESOLUTION 03 -20- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 88 -388 MODIFICATION FOR THE CONSTRUCTION OF AN WATER TRETMENT FACILITY AT AN EXISTING WATER WELL AND PLANT OPERATIONS FACILITY, TO BE LOCATED AT 2657 DELTA AVENUE IN THE R -2 (LIGHT MULTI FAMILY RESIDENTIAL) ZONE.
