CC - Minutes - 05-22-12Minutes of the Joint City Council, and Housing Development Corporation May 22, 2012 The joint meeting of the Rosemead City Council and the Housing Development Corporation was called to order by Mayor Armenta at 7:00 p.m. in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PLEDGE OF ALLEGIANCE: Director /Council Member Low INVOCATION: Director /Council Member Alarcon PRESENT: President/Mayor Armenta, Vice- President/Mayor Pro Tern Low, Directors /Council Members Alarcon, Clark and Ly STAFF PRESENT: City Manager Allred, City Attorney Richman, Assistant City Manager Hawkesworth, Community Development Director Ramirez, Director of Finance Brisco, Director of Parks and Recreation Montgomery- Scott, Public Works Director Marcarello, and City Clerk Molleda City Attorney Richman reported out of closed session from the previous City Council meeting under performance review evaluation, City Clerk Molleda received a five percent rating with a 5 -0 vote. 1. ORDINANCES READ BY TITLE ONLY State law requires that all ordinances be read in full prior to the City Council taking action; however, by motion, unanimously adopted, the City Attorney can be instructed to read all ordinances by title only. Recommendation: That the City Attorney be instructed to read all ordinances which appear on this agenda by title only, and that further reading be waived. Director /Council Member Steven Ly made a motion, seconded by Vice-President/Mayor Pro Tem Polly Low to approved ordinances by title only. PUBLIC COMMENTS FROM THE AUDIENCE Velia Navarro — expressed concern with the traffic near Bartlett Avenue and Marshall Avenue. Mrs. Navarro told Council of a previous traffic accident that had occurred on that intersection and asked if the City Council would be taking action in installing red flashing lights or other means to slow down traffic. Rosemead Housing Development Corporation and City Council Joint Meeting Minutes of May 22, 2012 Page 1 of 10 MayorArmenta stated that the City Council is concern with traffic flow near the schools and that Director of Public Works Marcarello was working vigorously to find solutions. Public Works Director Marcarello explained that there are two locations on Angelus and Graves were delineators would be replaced; staff is working with school officials and continue to progress on some signage and stripping improvements. Mr. Marcarello stated that the City has received Safe Routes to School funding to improve those areas. Jean Hall — expressed concern with an article written by Mr. Miller stating, "If you want to attend the state of city address, prepare to cough up some green bucks ". She stated that Mr. Miller wrote he had researched other cities and Rosemead was the only City charging to attend the event. She clarified that the City of Monterey Park was charging $25 for their State of the City luncheon and El Monte was also going to charge. Council Member Ly stated that the cost to attend the State of the City was reduced and it would only pay for the lunch. Mr. Ly noted that the event would be held during the day and some people could not attend the event; therefore, the meeting would be broadcast on the City's website for free. MayorArmenta stated that some of the City's service providers bought tables and seats were available for any one that was unable to pay to attend the City's State of the City Address. Mayor Pro Tom Low stated residents may want to know how the money being charge will be utilized. City Manager Allred stated that the caterer was charging $15 per person to cover the cost of the food and if there is any money left over it would go to the general fund. Craig Denton - Manager of the Del Rey Mobile Home Park, expressed concern with the proposed waste hauler contract. He stated that businesses will have to pay up to 26 percent to 109 percent for their current level of service and his business would operate on a 52 percent increase. Mr. Denton urged that the City Council consider a contract that is fair and equitable for multifamily and commercial businesses in Rosemead. Public Works Director Marcarello explained that staff is working with representatives from Consolidated Disposal on the negotiations for the solid waste franchise agreement; staff hopes to have more information as it relates to the proposed rates for Council's review. 3. PRESENTATION • Traffic Commissioner Joseph Wong — Plaque of Appreciation City Council presented a plaque of appreciation to Mr. Wong for his service as a Traffic Commissioner from 2010 to 2012. Council Member Ly thanked Mr. Wong for his service and encouraged him to reapply in the future. Mayor Armenta thanked Mr. Wong for his service and dedication to the City. Rosemead Queen Rosemead Housing Development Corporation and City Council Joint Meeting Minutes of May 22, 2012 Page 2 of 10 MayorArmenta introduced Samantha Tran as the first Rosemead Queen. Ms. Armenta also introduced and thanked Marie Tran from Bank of the West for supporting the program and providing a savings bond to the Rosemead Queen. • Don Bosco Technical Institute Student Recognition City Council presented an award of recognition to students from Don Bosco Technical for volunteering for the City of Rosemead Tiny Tots and Tutoring program. Director of Parks and Recreation Montgomery-Scott explained he was contacted by Miguel Flores to engage Don Bosco's 9th graders in the community. They develop the concept of providing a tutoring program in reading, math, and science; they tutored students and parents for a full year. MayorArmenta added that Miguel Flores was also involved with the Public Safety Forum Connections. Miguel Flores — thanked staff and City Council for their support and explained that through their philosophy at Don Bosco, "Education is the matter of the heart'. He stated they try to create a well balanced student in science, technology, math, and by having them give themselves to the overall community. Mr. Flores introduced Principal Javier Jimenez, Director of Services Tony Nichols, tutoring coaches and also thanked the parents of the students for their support to their program. Council Member Clark thanked all the students, teachers and parents for being an example and giving back to the community. MayorArmenta stated that giving back to the youth is important and planting the seeds for the future. Council Member Alarcon stated he was proud and thanked the students for their commitment. Mayor Pro Tern Low encouraged students to stay involved with the community and thanked them for their efforts. Council Member Ly commended the students for providing a public service and being good role models to the City. Director of Parks and Recreation Montgomery-Scott stated that the City of Rosemead received a mini grant for safety from the Department of Public Health State Program. Peter Romero from Don Bosco Tech Audio Visual Department created a safety video for the City. Council Member Ly stated the video was great and asked that the Traffic Commission also view the video. MayorArmenta stated it was an excellent video. She reiterated that there is a lot of concern with traffic flow in schools. As a teacher she has seen many near collisions because people are not observing their speed limits. People that drive around schools need to slow down and be careful how they drive. City Council presented certificates in recognition of contribution towards the production of the pedestrian's safety video to Nathan Morales, Roderick Grohl, Pablo De La Jolla, and Peter Romero. Rosemead Housing Development Corporation and City Council Joint Meeting Minutes of May 22, 2012 Page 3 of 10 MayorArmenta announced that the City of Rosemead and the California Office of Safety Department of Public Health extend an invitation to the public to attend the Pedestrian Safety Awareness Workshop entitle, "It's up to all of us ", on May 21, 2012 at the Rosemead Public Safety Center. 4. PUBLIC HEARING A. City of Rosemead Housing Element 2008 — 2014 State housing law requires local governments to adopt a Housing Element that adequately facilitates the improvement and development of housing to meet the existing and projected housing needs of all economic segments of the community. As the official housing policy document for local governments (and one of the mandatory elements of the General Plan) a Housing Element analyzes existing housing conditions, describes existing and future housing needs, and identifies opportunities for improving and expanding the City's housing supply. The City has been working with GRC Associates in preparing a draft Housing Element for the period 2008 — 2014. After numerous discussions with the State Department of Housing and Community Development (HCD) and revisions to the Housing Element, HCD has conditionally approved Rosemead's Housing Element. HCD indicated in their letter dated April 16, 2012 that the revised draft Housing Element will comply with State Housing Element Law (Article 10.6 of the Government Code) when adopted and submitted to HCD, pursuant to Section 65585(g). This item was presented to the Planning Commission for consideration on May 7, 2012. At that hearing, the Planning Commission reviewed the draft Housing Element. No members of the public testified for or against the draft Housing Element. At the conclusion of the hearing, the Planning Commission adopted Resolution No 12 -07 approving the City of Rosemead Housing Element 2008 -2014 and Negative Declaration; and recommended that the City Council adopt the City of Rosemead Housing Element 2008 -2014 and authorize submittal to HCD for State certification. Upon City Council adoption of the Housing Element, HCD will certify Rosemead's Housing Element. Recommendation: That the City Council approve Resolution No. 2012 -17, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ADOPTING THE CITY OF ROSEMEAD HOUSING ELEMENT 2008 -2014 AND NEGATIVE DECLARATION, AND AUTHORIZING THE SUBMITTAL TO THE STATE DEPARTMENT OF HOUSING AND COMMUITY DEVELOPMENT FOR STATE CERTIFICATION Community Development Director Ramirez reviewed the staff report. John Oshima — President of GRC Associates, stated that they have been preparing the Housing Element for the City as mandated by the State to be revised every five years. The purpose of the Housing Element Rosemead Housing Development Corporation and City Council Joint Meeting Minutes of May 22, 2012 Page 4 of 10 update is to identify the needs, city resources of existing programs, and identify land available to accommodate growth. Mr. Oshima explained that it was important to have an updated and certified Housing Element Plan to get access to grants, such as the Home Funds and Parks and Recreation Funds. Director /Council Member Clark stated that the law requires a density bonus of 35 percent of affordable housing and asked if the City was already providing the 35 percent. Community Development Director Ramirez replied that the City was already offering the 35 percent affordable housing; however it was not written on the City's zoning code. President/MayorArmenta asked if the rate of affordable housing would change considering the elimination of the Redevelopment Agency. Community Development Director Ramirez explained that the loss of funding did not change the numbers; therefore, if other funds became available to replace Redevelopment funds they could be used to build affordable housing. The draft numbers of affordable housing significantly changed from 780 to 602 for the years 2014 -2021. President/MayorArmenta opened the Public Hearing at 8:01 p.m. Juan Nunez - expressed concern with people moving to his neighborhood that are relocated from the low income housing program. President/MayorArmenta reassured Mr. Nunez that just because people participate in low income programs did not make them thieves or criminals. Ms. Armenta reiterated that the Housing Element Plan was mandated by the State and the City is following the requirements. President/MayorArmenta agreed with Mr. Alarcon and thanked staff for their hard work on the Housing Element and Zoning Code updates. Director /Council Member Clark reiterated that the Housing Element is mandated by the State and by taking away Redevelopment funds they take the tools for cities to implement the mandates. Claims and Demands • Resolution No. 2012 — 32 Recommendation: to approve Resolution No. 2012 — 32 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $1,409,833.79 NUMBERED 77246 THROUGH 77409 INCLUSIVELY C. Memorandum of Understanding with Rosemead Employee Association and Annual Salary and Benefits Resolutions The City Council will consider approval of a Memorandum of Understanding (MOU) with the Rosemead Employee Association covering all General Service employees, and annual Resolutions that detail the terms and conditions of employment for other full -time employees and members of the City Council. Amendments to the MOU and the resolutions for full -time employees include new language to establish an Amoeba Organization and Amoeba Flex Weeks, decrease vacation buy -back; decrease auto allowance for Middle Management, Professional, and Confidential service; and exclude disability policies for City Council. The MOU Resolutions will provide no merit increases, no salary range adjustments or increases in employee benefits. Recommendation: That the City Council approve Resolution No. 2012 -28, Resolution No. 2012 -29 and Resolution No. 2012 -30, respectively, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ESTABLISHING ANNUAL SALARY RANGES AND BENEFITS FOR CLASSIFICATION IN THE MIDDLE MANAGEMENT, PROFESSIONAL, AND CONFIDENTIAL SERVICE OF THE CITY OF ROSEMEAD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ESTABLISHING ANNUAL SALARY RANGES AND BENEFITS FOR CLASSIFICATION IN THE MANAGEMENT SERVICE OF THE CITY OF ROSEMEAD Rosemead Housing Development Corporation and City Council Joint Meeting Minutes of May 22, 2012 Page 6 of 10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ESTABLISHING ANNUAL SALARY RANGES AND BENEFITS FOR CLASSIFICATION FOR THE CITY COUNCIL OF THE CITY OF ROSEMEAD D. Approve a HOME Funds Commitment Agreement between the City of Rosemead and the Rosemead Housing Development Corporation for the Implementation of Certain HOME Funded Programs The City is required to commit its HOME funds for particular affordable housing activities within 24 months after HUD's appropriation of the entitlement allocation. To comply with this requirement, staff recommends that the City commit $167,137 of FY 2012 -13 HOME funds, plus unspent carried over funds from prior FY's, by contracting with the Rosemead Housing Development Corporation (RHDC) to administer certain HOME funded programs. Recommendation: That the Rosemead Housing Development Corporation and the City Council take the following actions. 1. Approve a HOME Funds Commitment Agreement between the Rosemead Housing Development Corporation and the City Council for the implementation of the City's Owner - Occupied Rehabilitation Loan Program and Mortgage Assistance Program; 2. Authorize the President to execute the contract on behalf of the RHDC; and 3. Authorize the Mayor to execute the contract on behalf of the City. E. Authorizing Resolution for LA County Proposition A Grant Application for RCRC Interior Renovations The people of the County of Los Angeles on November 3, 1992, and on November 5, 1996, enacted Los Angeles County Proposition A, Safe Neighborhood Parks, Gang Prevention, Tree - Planting, Senior and Youth Recreation, Beaches and Wildlife Protection provides funds to public agencies and nonprofit organizations in the County for the purposes of acquiring and /or developing facilities and open space for public recreation. One of the requirements of the application is a resolution authorizing submission of an application and designating an agent to act on behalf of the City in matters related to the grant should funding be awarded. As the City Council is aware, the Rosemead Community Recreation Center is part of the Civic Center project with renovations and expansion of the center included in the current Capital Improvement Project Plan. Interior improvements will include renovation of non -ADA restrooms, conversion of multi - purpose space into a computer lab, HVAC and lighting improvements, fire safety improvements, and window, wall, and floor treatments. Carde -Ten Rosemead Housing Development Corporation and City Council Joint Meeting Minutes of May 22, 2012 Page 7 of 10 Architects have developed conceptual drawings and cost estimates for the project are $500,000. Staff is developing an application for Proposition A grant funding from LA County for these renovations. Recommendation: That the City Council approve Resolution No. 2012 -35, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, APPROVING THE APPLICATION FOR GRANT FUNDS FROM THE LOS ANGELES COUNTY REGIONAL PARK AND OPEN SPACE DISTRICT EXCESS FUNDS GRANT PROGRAM FOR ROSEMEAD COMMUNITY RECREATION CENTER RENOVATIONS PROJECT Council Member Steven Ly made a motion, seconded by Mayor Pro Tem Polly Low to approve Consent Calendar, with the exception of item B. Appointment of a Planning Commissioner to the Zoning Code Update Committee On April 24, 2012, the City Council approved the Mayor's Appointments for 2012-2013. One of the appointments included the designation of Mayor Pro Tem Low and Council Member Alarcon to the Zoning Code Update Committee. This item is being brought back to the Council for consideration of the appointment of a Planning Commissioner to the Committee. Recommendation: That the City Council approve the appointment of a Planning Commissioner to the Zoning Code Update Committee. Council Member Ly nominated Planning Commissioner Nancy Eng to the Zoning Code Update Committee. Council MemberAlarcon supported the nomination adding that Mrs. Eng is very involved in the Garvey School District and the Garvey Avenue Committee. Mayor Pro Tem Low stated that Mrs. Eng is a good candidate because she has worked with staff on the Garvey Avenue Committee which involves zoning issues. She seconded the nomination for Nancy Eng. Mayor Armenta agreed that Nancy Eng is a good candidate because she asks thorough questions. West San Gabriel Running Rebels Request for Use of Garvey Gymnasium Representatives of West San Gabriel Running Rebels are requesting continued use of Garvey Gym, at a reduced rate, while they continue pursuit of 501(c)3 non - profit status. Recommendation: That the City Council provide direction regarding West San Gabriel Running Rebels' use of Garvey Park Gymnasium. MayorArmenta announced that the West San Gabriel Running Rebels request for use of Garvey Gymnasium item would be discussed on the following City Council meeting. CITY COUNCIL'S COMMENTS: Council Member Ly reported that Council Members, the City Manager, and the City Attorney had the opportunity to attend the Contract Cities Association Conference. Mr. Ly asked that Public Works look into the flags that are in the City of Rosemead to make sure that they are all in good condition. Council Member Clark stated that she attended the same conference and mentioned that there was a session on alternative tools that cities might have as a result of the elimination of Redevelopment Agencies. Mrs. Clark also inquired about the painting of house curb numbers. MayorArmenta stated that she had spoken to Public Works Director Marcarello about having non - profit organizations do the curb painting. There are people that are asking for donations and they have no affiliation with the City or any non - profit organization. Director of Public Works Marcarello stated that staff met with a non - profit agency that does curb painting and has been commissioned to perform curb painting as part of the slurry seal program; along with other Capital Improvement Programs staff is trying to incorporate curb painting. MayorArmenta stated that she had also attended the Contract Cities Association Conference and met with other council members from the San Gabriel Valley and City Managers; she indicated that in the conference there was networking and discussion about coming together to fight Sacramento from taking away the Cities' money. 8.
