CC - Minutes - 07-24-12Minutes of the City Council Meeting July 24, 2012 The regular meeting of the Rosemead City Council was called to order by Mayor Armenta at 7:00 p.m. in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PLEDGE OF ALLEGIANCE: Mayor Pro Tern Low INVOCATION: Council Member Alarcon PRESENT: Mayor Armenta, Mayor Pro Tem Low, Council Members Alarcon, Clark, and Ly STAFF PRESENT: City Manager Allred, City Attorney Richman, Assistant City Manager Hawkesworth, Community Development Director Ramirez, Director of Finance Brisco, Director of Parks and Recreation Montgomery- Scott, Public Works Director Marcarello, and City Clerk Molleda 1. PUBLIC COMMENTS FROM THE AUDIENCE Barbara Carrera — representative of the San Gabriel Water District invited the City Council to the San Gabriel Water Forum on Tuesday, August 28th. Ms. Carrera stated that the forum was a water 101 workshop from 7:30 a.m. to 1:30 p.m. in the City of Pomona. 2. PRESENTATIONS • L.A. Assessor's Office Presentation Carol Quan - Special Assistant for the L.A County Assessor's office shared information regarding programs to help home owners save on their property taxes. Council Member Clark asked Ms. Quan, if home owners had to apply to obtain reductions in property value. Ms. Quan - replied that the Assessor's office conducted a proactive review and looked at about 480,000 single family homes, and reduced the assessment on about 365,000. Council Member Clark asked that if under Proposition 13, the property tax is frozen at 1 % your property decreases in value and its assets are lower, the property tax can be raised to 2 %. Ms. Quan — explained that under Proposition 13, once the Assessor establishes the base value, the assessment is no more than 2% a year under Proposition 13. She added that when the market was increasing 10% or 20 % during the height of the real estate market, the Assessor only increased an assessment that had an established value of no more than 2 %. • National Night Out Proclamation Rosemead City Council Regular Meeting Minutes of July 24, 2012 Page 1 of 7 Public Safety Coordinator Mandy Wong invited the public to National Night Out celebration at Zapopan Park on Tuesday, August 7th. Mrs. Wong stated that the City is taking a combat against crime. In addition, Rosemead has formed many programs to involve the citizens and help make Rosemead a safer community. National Night Out is a night where we can share our gratitude and partnership we have in our community. MayorArmenta stated it this was a great way to recognize and appreciate all the hard work everyone and the block captains have done; as well as the support from the Sheriffs Department. 3. PUBLIC HEARING A. Continued Public Hearing - Appeal of Conditional Use Permit 11 -14 8772 Valley Boulevard On January 17, 2012, the Planning Commission conducted a public hearing for Conditional Use Permit 11 -14 (CUP 11 -14), a request for a new On -Sale Beer and Wine (Type 41) ABC license in conjunction with a bona fide public eating place, known as Hunan Restaurant. The restaurant is located at 8772 Valley Boulevard, in the C -3D (Medium Commercial with a Design Overlay) zone. The Planning Commission denied the CUP based on the analysis and findings contained in the Planning Commission's staff report. On January 19, 2012, the City Clerk's office received an appeal letter from the applicant, Lan Tan, requesting to appeal the Planning Commission's decision. The City Council conducted a public hearing for the appeal of the CUP on February 14, 2012. During the public hearing Mr. Tan asked the City Council to postpone the public hearing so that he could continue to work with staff to address all the issues raised during the Planning Commission hearing. The Council unanimously approved his request, and the meeting was continued to March 27, 2012. Community Development Director Michelle Ramirez reviewed the staff report and reported that the applicant requested to postpone the public hearing until October 30th, 2012. City Manager Allred stated that the public hearing was for an appeal for denial of a Planning Commission action. Community Development Director Ramirez stated this public hearing was for the ABC license requested by Hunan's Seafood Restaurant. Council Member Steven Ly made a motion seconded by Mayor Pro Tern Polly Low to continue the Public Hearing to October 30, 2012. Minutes May 8, 2012 — Regular Meeting June 12, 2012 — Special Meeting B. Claims and Demands • Resolution No.2012 -45 Recommendation: to approve Resolution No. 2012 — 45 entitled: A RESOLUTION OF THE ROSEMEAD CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $2,692,777.90 NUMBERED 77961 THROUGH 78130 INCLUSIVELY C. Voluntary Early Retirement Incentive Plan As the City Council is aware, the City currently has an underlying structural budget imbalance and staff has been working to identify ways of reducing ongoing costs. The Council authorized the offering of a Retirement Incentive Plan in 2009 and earlier in 2012. In 2009 two employees retired under the plan; and in 2012 there were five employees who retired. Despite this reduction in the work force of seven employees, combined with reductions through regular attrition and a reduced reliance on part -time staff, the City continues to have an underlying structural budget deficit. Based upon ongoing discussion with employees, it is believed that there are several employees who would be interested in participating in a Retirement Incentive Plan if it were to be offered an additional time. As with previous offerings, the Retirement Incentive Plan will provide two additional years of service credit to full -time employees who accept the offer. The benefit is designed to mirror the CaIPERS retirement benefits and will be distributed and calculated as such. PARS will provide a general meeting for all eligible team members, and will then schedule individual follow -up meetings if employees wish to discuss the personal financial benefits of the plan. Under the proposed plan, employees will have to make their final decision of acceptance on or before August 31, 2012. Once a decision has been made, a retirement date on or before September 30, 2012 will be identified. Recommendation: That the City Council approve Resolution No. 2012 - 44, entitled: A RESOLUTION OF THE ROSEMEAD CITY COUNCIL OF THE CITY OF ROSEMEAD CALIFORNIA, AUTHORIZING AN AMENDMENT TO THE PARS RETIREMENT ENHANCEMENT PLAN TO INCLUDE AN EARLY RETIREMENT INCENTIVE Rosemead City Council Regular Meeting Minutes of July 24, 2012 Page 3 of 7 Council Member Steven Ly made a motion, seconded by Mayor Pro Tern Polly Low to approve the Consent Calendar. Garvey Avenue Master Plan The City Council will consider approval of the Garvey Avenue Master Plan, between New Avenue and the Garvey Bridge. The Garvey Avenue Master Plan addresses aesthetic and parking issues that property and business owners face in planning commercial and retail improvements. It is intended to be used as a reference point for expectations for quality development. The principal design criteria and architectural styles represented in the plan are not intended to be restrictive; they are meant to assist in the design, development, and implementation of quality architecture and site planning. On July 16, 2012, the Planning Commission was presented with the Draft Garvey Avenue Master Plan and adopted Resolution No. 12 -10 recommending approval of Resolution No. 2012 -34 to the City Council. Recommendation: That the City Council approve Resolution No. 2012 -34, entitled: A RESOLUTION OF THE ROSEMEAD CITY COUNCIL OF THE CITY OF ROSEMEAD CALIFORNIA, APPROVING THE GARVEY AVENUE MASTER PLAN Assistant Planner Lily Trinh reviewed the staff report. Council Member Clark asked if the guidelines were going to be mandatory. Assistant Planner Trinh replied no, the guidelines were not going to be mandatory. Council Member Clark asked Ms. Trinh if the guidelines were for new developments. Assistant Planner Trinh replied that the guidelines were for existing and proposed developments. Council Member Ly requested to table the item until August 14th to fully read the guidelines in detail. Council Member Steven Ly made a motion, seconded by Mayor Pro Tern Polly Low to defer the Garvey Avenue Master Plan item until the August 14, 2012, City Council meeting. MATTERS FROM MAYOR & CITY COUNCIL A. West San Gabriel Running Rebels Request for Use of Garvey Gymnasium Representatives of West San Gabriel Running Rebels are requesting continued use of Garvey Gym, at a reduced rate, while they continue their pursuit of 501(c)3 non - profit status. Recommendation: That the City Council permit West San Gabriel Running Rebels' use of Garvey Park Gymnasium at the non - profit rate of $25 per hour for a period of six months (through January 2013). Parks and Recreation Director David Montgomery-Scott reviewed the staff report. Council Member William Alarcon made a motion, seconded by Council Member Margaret Clark to approve the use of Garvey Park Gymnasium at the non - profit for a period of six months to the West San Gabriel Running Rebels' (through January 2013). Vote resulted in: Yes: Alarcon, Armenta, Clark, Low, Ly No: None Abstain: None Absent: None Council Member Clark asked Mr. Montgomery-Scott what the fees were for organizations that are not non- profit. Parks and Recreation Director Montgomery-Scott explained that there is a resident use fee and a non- resident use fee. The resident fee is about $32 an hour plus $11.44 for staff time and it is a double fee for a non - resident. 7. COMMENTS FROM CITY COUNCIL MayorArmenta reported that she attended the New Orleans NALEO's conference on national policy and emergency preparedness. Ms. Armenta stated that she would like to work with staff to talk about updating the City's mitigation plan and emergency preparedness plan. Council Member Ly reported he participated in a program involving the United States Marine Corps. The workshop incorporated ideas to build a good relationship between pacific educations and the Marine Corp. Rosemead City Council Regular Meeting Minutes of July 24, 2012 Page 5 of 7 Council Member Clark reported she attended a conference in Nashville, Tennessee for the National League of Cities on energy environment natural resources. Mrs. Clark stated that she took a tour of a water facility and explained how well prepared they were in case of an emergency. She informed Council she spoke about emergency preparedness for the City of Rosemead. Mayor Pro Tem Low stated that years ago the City did not have an emergency preparedness plan and asked how well the City is prepared compared to other cities. Mrs. Low warned that families should be preparing emergency items for several days in case of a disaster. City Manager Allred explained that there had been progress with the City's plan, which is in place. He explained there is an Emergency Operation Center in which staff is involved and has conducted mock emergency drills. As a result, Council allocated funds to purchase a generator for City Hall to power the building for several days if necessary. Mr. Allred stated two additional generators are budgeted to be purchased in the future and each department has different areas of responsibilities during a disaster. Council Member Alarcon stated that there was a plan in place when he was a Council Member the first time. Mayor Pro Tem Low replied that she was told the plan was never approved until recent years. She indicated that the City would not qualify for disaster funds because a plan was not approved at that time. City Manager Allred reminded Council of last year's City emergency involving windstorms and described that the City exercised the opportunity to declare an emergency at that time. Mayor Armenta reiterated that the City needs to have a mitigation plan, which is separate from an emergency plan. City Manager Allred replied that a mitigation plan had been submitted to the State; however, the plan has not been approved yet. 8. CLOSED SESSION A.
