PUBLIC HEARINGS A. Municipal Code Amendment 12.01, Amending the Rosemead Municipal Code to Add Regulations Pertaining to the Licensing and Operation of Home Occupations in the City of Rosemead The purpose of the proposed amendments is to allow home occupations as an incidental, accessory use in the R -1 (Single - Family Residential), R -2 (Light Multiple Residential), R -3 (Medium Multiple Residential), and RC -MUDO (Residential /Commercial Mixed Use Development Overlay) zoning districts. The regulations and procedures set forth in Municipal Code Amendment 12 -01 are intended to ensure that home occupations are compatible with the character of City of Rosemead's residential neighborhoods. The proposed Ordinance No. 925 addresses licensing /permitting provisions, operating standards, and zoning limitations to ensure that home occupations will not disrupt, become a nuisance, disturb, or modify the character of the residential areas within the City of Rosemead. At that hearing the Planning Commission reviewed the proposed home occupation regulations, as well as a letter of public comment that was submitted by a Rosemead resident. In response to public comment and testimony, the Planning Commission added language to Section 5.41.100.E of the Ordinance to clarify that testing, maintenance, repair, towing and storage of any boat, aircraft, or motorized vehicle is prohibited as a home occupation. With this revision, the Planning Commission adopted Resolution No. 12 -20, recommending that the City Council ADOPT Ordinance No. 925. Recommendation: That the take the following actions: 1. Conduct a public hearing and take public testimony; 2. Adopt the Negative Declaration as the CEQA determination for the project; 3. Adopt Resolution No. 2012 -70, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ADDING A HOME OCCUPATION BUSINESS LICENSE FEE 4. General Plan Amendment 11 -02, Zone Change 11 -02 and Modification 12 -01 2751 Del Mar Avenue This is an application requesting a General Plan Amendment, a Zone Change and a Modification of an existing Condition Use Permit for the property addressed as 2751 Del Mar Avenue. General Plan Amendment 11 -02 will change the dual land use designations from Commercial and Medium Density Residential to Medium Density Residential. Zone Change 11 -02 will change the dual zoning designations from P (Parking) and R -2 (Light Multiple Residential) zones to R -2 (Light Multiple Residential) zone. Modification 12 -01 will modify existing Condition Use Permit 86 -350 to construct a new 2,408 square foot Buddhist Temple located at 2751 Del Mar Avenue. Rosemead Place Shopping Center Lot Tie Application 3500 -3684 Rosemead Boulevard and 3501 -3535 Hart Avenue Rosemead Place, LLC, the owner of the Rosemead Place Shopping Center, has submitted a Lot Tie Application requesting to tie three (3) parcels of land that make up the shopping center into one (1) single parcel of land. Recommendation: That the City Council approve the Lot Tie Application and allow the applicant to record the Covenant and Agreement to Hold Property as One Parcel at the Los Angeles County Clerk's Office. C. Safe Route to School Project — Walnut Grove Avenue Enhancements — Award of Contract for Design Engineering Services As part of the City's Fiscal Year 2012 -2013 Capital Improvement Program, the City Council approved the "Federal Safe Routes to School Project', which consists of the construction of a raised landscaped median along Walnut Grove Avenue (from Marshall Street to Valley Boulevard) and the installation of pedestrian safety enhancements in areas surrounding Janson and Shuey Elementary Schools. This project is funded in part by a Federal Safe Routes to School competitive grant award in the amount of $860,000. As part of the grant requirements, the City is required to provide matching funds towards the project. In accordance with these requirements, the City will fund the design portion of the project using local Gas Tax funds. A request for proposal for the design engineering services was sent to five (5) engineering firms in October 2012 and three were received. Recommendation: That the City Council authorize the City Manager to enter into a contract with RKA Consulting Group to complete the project design engineering and federal funds administration with a not -to -exceed cost of $29,830.00. D. Traffic and Pedestrian Safety Enhancements Adjacent to Southern California Edison Corporate Headquarters The Traffic Commission recently reviewed a request from Southern California Edison (SCE) to evaluate traffic and pedestrian safety conditions adjacent to their corporate headquarters on Walnut Grove Avenue. In coordination with City staff, representatives from SCE funded a traffic study to evaluate traffic and pedestrian conditions in the area. The study found the general conditions to be safe, but also recommended several potential safety enhancements. Page 5 of 6 ROSEMEAD CITY COUNCIL MEETING AGENDA December 11, 2012 After review of the improvements and the finding that they will not require the use of City funds, the Commission concurred with the recommendations to proceed with additional traffic enhancements along Walnut Grove Avenue. Recommendation: That the City Council: 1. Approve the traffic striping and signage plan; 2. Authorize the City Manager to approve a funding agreement with SCE to fund the cost of improvements; and 3. Authorize staff to proceed with the installation of the identified improvements in an amount not -to- exceed the engineer's estimate of $33,000. 5. MATTERS FROM CITY MANAGER & STAFF 6.
