A. Continued — Municipal Code Amendment 12 -01, Amending the Rosemead Municipal
Code to Add Regulations Pertaining to the Licensing and Operation of Home
Occupations in the City of Rosemead
The purpose of the amendments is to allow home occupations as an incidental, accessory
use in the R -1 (Single - Family Residential), R -2 (Light Multiple Residential), R -3 (Medium
Multiple Residential), and RC -MUDO (Residential /Commercial Mixed Use Development
Overlay) zoning districts. The regulations and procedures are intended to ensure that home
occupations are compatible with the character of City of Rosemead's residential
neighborhoods. The proposed Ordinance No. 925 addresses licensing /permitting provisions,
operating standards, and zoning limitations to ensure that home occupations will not disrupt,
become a nuisance, disturb, or modify the character of the residential areas within the City of
Rosemead.
This item was presented to the Planning Commission for consideration on November 19,
2012. At that hearing the Planning Commission reviewed the proposed home occupation
regulations, as well as a letter of public comment that was submitted by a Rosemead
resident. In response to public comment and testimony, the Planning Commission added

language to Section 5.41.100 of the Ordinance to clarify that testing, maintenance, repair,
towing and storage of any boat, aircraft, or motorized vehicle is prohibited as a home
occupation. With this revision, the Planning Commission adopted Resolution No. 12 -20,
recommending that the Council ADOPT Ordinance No. 925.
The City Council was presented the Municipal Code Amendment 12 -01 on December 11,
2012. At the meeting, the City Council directed that the item be continued to the January 8,
2013 City Council meeting to allow additional time to review the document.
Recommendation: That the City Council take the following actions:
1. Conduct a public hearing and take public testimony;
2. Introduce for First Reading, by title only, Ordinance No. 925, entitled:

On February 14, 2012, the City Council conducted a duly noticed public hearing for the
appeal of the Planning Commission's January 17, 2012 decision to deny Conditional Use
Permit 11 -14 for a new On -Sale Beer and Wine (Type 41) ABC license at the Hunan
Seafood Restaurant, located at 8772 Valley Boulevard. At the direction of the City Council,
staff has met with the applicant and his consultant several times and has agreed on a
revised floor plan.
Recommendation: That the City Council take the following actions:

C. Award of Contract for Jay Imperial Park Design
In November, 2012, the City issued a Request for Proposals for landscape architectural
design services for Jay Imperial Park. Specifically, the scope of work included conceptual
design, design development, construction documents, and construction administration
services.
Proposals were received from four firms including Steven A. Ormenyi & Associates, NUVIS
Landscape Architecture and Planning, Lawrence R. Moss & Associates, and Meyer and
Associates. All are reputable landscape architecture and design firms with more than 25
years of experience and all have completed projects in the region. All four firms have, in their
proposals, demonstrated extensive similar municipal project experience and the requisite
expertise to perform the requested services. Lastly, all firms indicate an ability to complete
this phase of the project, as required, by mid -May, 2013. Proposed costs are as follows:

The proposal submitted by Lawrence R. Moss & Associates' is more than $46,000 less than
the second lowest bid. Moss & Associates has worked with the City of Rosemead on a
variety of other projects including master planning and landscape design and consultation.
They consistently perform quality work and are qualified to complete the requested design
and affiliated responsibilities for Jay Imperial Park.
Recommendation: That the City Council authorize the City Manager to enter into a
professional services agreement with Lawrence R. Moss & Associates for landscape
architectural design services for Jay Imperial Park in the amount of $63,000. Additionally, as
the property is not City- owned, it is recommended that contingency funding in the amount of
$9,450 (15% of proposed costs) be approved to cover any unforeseen circumstances
identified through further evaluation of the site. Thus, the total available contract amount,
including possible contingencies, is not to exceed $72,450.
D. Review of Traffic Conditions at Bartlett Avenue and Loftus Drive
The Traffic Commission received a request to review traffic conditions at Bartlett Avenue and
Loftus Drive. A resident in this neighborhood indicated that there are pedestrian and vehicle
safety concerns in this area, due to the lack of stop signs and crosswalks at this intersection.
A traffic study was conducted at the location included a warrant study to determine if the
installation of stop controls and crosswalks is appropriate. After studying the location, it has
been determined that the installation of some traffic controls would improve safety in this
area. The Commission concurred with this recommendation.
Recommendation: That the City Council approve the Traffic Commission's recommended
improvements, including the traffic striping and signage plan for:
1. The installation of a stop sign on Loftus Drive (heading westbound) at the intersection of
Bartlett Avenue; and
2. The installation of a yellow marked school zone crosswalk across Loftus Drive at the
intersection of Bartlett Avenue.

5. MATTERS FROM CITY MANAGER & STAFF
A. Request to Participate in the 710 Coalition
The City recently received a request to participate in the 710 Coalition in partnership with the
surrounding cities of San Gabriel, San Marino, Monterey Park, and Alhambra. As proposed,
the group will help advocate for the completion of the 710 Freeway from its current terminus
in Alhambra to the Interstate 210 Freeway in Pasadena. Participation in this coalition will
require a financial contribution that will fund strategic planning and outreach efforts to help
promote the successful completion of the Interstate 710 extension.
Recommendation: That the City Council authorize participation in the 710 coalition,
including the payment of membership dues and execution of appropriate agreements.
B. Water Quality Funding Initiative
Since 1991, the City of Rosemead has participated as co- permitees with Los Angeles
County and 84 cities under the National Pollutant Discharge Elimination System (NPDES)
Municipal Separate Storm Sewer System (MS4) Permit. Since that time, the City has
actively participated with cities in the region to adopt practices to address water quality
issues. Recently, the Los Angeles Regional Water Quality Control Board (State of California
agency) approved a new permit format that will require each agency to prepare individual
MS4 permits. This effort, combined with other new requirements are anticipated to be quite
costly to implement and could have significant potential impacts on the City's financial
resources.
In response to these state and federal mandates, the County has developed the Water
Quality Funding Initiative (WFI, also referred to as the Clean Water, Clean Beaches
Protection Measure), a proposed parcel fee that would be used to offset the costs associated
with new MS4 permit requirements. The WFI is a Proposition 218 parcel fee that as
proposed, will be subject to approval by the Los Angeles County Board of Supervisors in
January, and then to a vote of property owners in Spring of 2013. All funding through the
WFI would be used to offset the new unfunded mandates associated with the new MS4
permit developed by the Regional Water Quality Control Board.
Recommendation: That the City Council:
1. Provide input on mandated water quality projects and costs to the City; and
2. Receive and file this report.
