SUBJECT: UPDATE ON PROPOSED CLEAN WATER, CLEAN BEACHES
MEASURE
SUMMARY
On Tuesday, January 15, 2013, the Los Angeles County Board of Supervisors held a
public hearing on the proposed Clean Water, Clean Beaches Measure. As the Council
will recall, the Clean Water, Clean Beaches Measure is a proposed parcel fee to be
assessed on the more than 2.2 Million parcels of property in the service area of the
County Flood Control District. The revenue from this proposed fee would be used to
fund water quality projects and compliance with National Pollutant Discharge
Elimination System (NPDES) regulations. At the conclusion of the public hearing the
Board of Supervisors, voted 3 -2 to continue the protest period for 60 days to allow for
redrafts to the proposed measure, continued protest from the property owners, and
additional public outreach.
Staff Recommendation:
It is recommended that the City Council receive and file this report.
ANALYSIS
On January 15, the Board of Supervisors held a public hearing on the proposed Clean
Water, Clean Beaches Measure as required under Proposition 218. The hearing lasted
approximately 4.5 hours and had more than 200 registered speakers, representing
cities and school districts, residents, businesses and environmental groups, many of
whom spoke in opposition to the measure. Opposition points focused on poor public
outreach, the appearance of the hearing notice as junk mail, the amount of the
proposed fees, and the fiscal impact to schools. As of Friday, January 11, the Board of
Supervisors had received more than 95,000 written protests, which is about 4.3% of the
total. A protest of 50% +1 will prevent the proposed measure from going to a vote. The
Board of Supervisors was expected to vote on whether or not to authorize an election
on this proposed measure; however, they voted to continue the authorization vote and
extend the protest period by 60 days.
The additional 60 days will allow for continued protest by property owners as well as
additional public outreach from the county to those affected. Minimal redrafts will be

completed to address concerns that had arisen regarding the measure and include the
insertion of a sunset clause, or end date, and a list of proposed projects to be funded.
Additional discussion will be held to determine whether or not this measure be placed
on a general election ballot rather than a vote of property owners.
FINANCIAL ANALYSIS
The Clean Water, Clean Beaches Measure would provide the City of Rosemead with a
dedicated funding source to meet the unfunded mandates of NPDES regulations. The
County's Engineer's Report indicates the City would receive an annual amount of
$614,000 while being assessed $12,000 on the forty parcels owned by the City. The
estimated net annual proceeds for the City would be approximately $602,000.
