PC - Minutes - 10-21-02l PLANN ETING CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order by Chairman Loi at 7:00 p.m. in the council chambers of the Rosemead City Hall at 8838 East Valley Boulevard, Rosemead Commissioner Alarcon led the Pledge of Allegiance. Vice- Chairman Herrera delivered the invocation. ROLL CALL: PRESENT: Chairman Loi, Vice- Chairman Herrera, Commissioners Alarcon, and Breen ABSENT: Ortiz EX OFFICIO: Price, Johnson, Villasenor, and Romanelli 1. APPROVAL OF MINUTES Regular meeting of October 7, 2002. (MO) Motion by Commissioner Alarcon, seconded by Commissioner Breen, that the minutes of the City of Rosemead Regular Planning Commission Meetings of October 7, 2002, be APPROVED as submitted. Vote results: YES: LOI, HERRERA, ALARCON, BREEN NO: NONE ABSTAIN: NONE ABSENT: ORTIZ Chairman Loi declared said motion duly carried and so ordered 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS Deputy City Attorney Stan Price explained the public hearing process and the right to appeal Planning Commission decisions to the City Council. 3. ADMINISTRATION OF OATH The commission secretary administered the oath to members of the audience wishing to speak before the Planning Commission. 4. PUBLIC HEARING A. CONDITIONAL USE PERMIT 02- 896 -8717 East Garvey Avenue ' A request by Mr. David Cortez, dba "David's Tires," for the operation of retail, installation, and service of new and used tires within an existing service site located in the M -1, Light Manufacturing zone. Applicant(s): In the audience. Questions from the commissioners to the staff: After having noticed a damaged eastside building roof beam, Chairman Loi questioned whether the property owner would be required to renovate. Planning Director Johnson consented to add condition number eight ( #8); whereby, the property owner will be obligated to repair the structure. Chairman Loi opened the public hearing to those IN FAVOR of this application: Representative for the applicant, Ms. Miranda Liu of 5640 North Willard Avenue, San Gabriel, announced her client's willingness to alleviate compressor noise by installing a sound barrier and /or cover; thereby, reducing noise impact by seven (7) to twelve (12) decibels. In agreement, Director Johnson mentioned the neighboring trailer park residents' concerns over a compressor being situated outside the structure. Commissioner Alarcon requested gauged decibel readings; whereupon, Ms. Liu testified to measurements of seventy -five (75) decibels from a six (6) to (8) foot distance. However, Ms. Liu indicated the trailer park distance to be twenty -five (25) to thirty (30) feet from the proposed compressor site. Public hearing was opened to those who wished to OPPOSE the application: None. There being no one further wishing to address the commission, Chairman Loi closed the public hearing segment for this project. (MO) Motion by Commissioner Breen, seconded by Commissioner Alarcon, to APPROVE Conditional Use Permit 02 -896 for a period of one (1) year, subject to the conditions listed in "Exhibit A "— inclusive of condition number eight ( #8). ZONE VARIANCE 02- 320 -3041 Earle Avenue A request by Giovanni Calix for a variance from Rosemead Municipal Code Section 17.20.060 to construct a new residence with a five (5) -foot second -story setback located in the R -2, Light Multi - Family Residential zone. Presentation: Assistant Planner Villasenor Staff recommendation: APPROVE —for a period of one (1) year, subject to the .conditions listed in "Exhibit A." Applicant(s): In the audience.
