PC - Minutes - 06-03-02PLANN ETING CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order by Chairman Loi at 7:00 p.m. in the council chambers of the Rosemead City Hull at 8838 East Valley Boulevard, Rosemead Commissioner Ortiz led the Pledge of Allegiance. Commissioner Alarcon delivered the invocation. Presentation: Assistant Planner Villasenor Staff recommendation: APPROVE —for a period of one (1) year, subject to the conditions listed in "Exhibit A." Applicant(s): In the audience. Questions from the commissioners to the staff: In reply to Chairman Loi's Ci ►go /7- Eleven status inquiry and concerns relating to the merging of a fueling station with alcohol retail, Planning Director Johnson informed the chairman that although plans are currently progressing through plan check; the project is, nevertheless, pending as a consequence of neighbors' opposition to ABC. Director Johnson also added that state legislation prohibits jurisdictions from disassociating both industries. Accordingly, Deputy City Attorney Stan Price supported the director's comments. Owing to the correlation of drinking and driving, Commissioner Ortiz called for the commission's denial; however, Deputy City Attorney Stan Price reminded the commissioner of the legal grounds for denial. Chairman Loi opened the public hearing to those IN FAVOR of this application: i The applicant, Mr. Sung Mo Ha of 8960 East Valley Boulevard, Rosemead, announced his presence and availability to answer any commission questions. Commissioner Alare6n sought after the percentage of customers who utilize the mini - market while refueling; at which point, Mr. Ha acknowledged that many make the most of his, as well as competitors' mini -mart services. Public hearing was opened to those who wished to OPPOSE the application: None. Vote results: Due to lack of a second motion, Commissioner Ortiz's motion to deny Conditional Use Permit 02 -870 failed. (MO) Motion by Commissioner Alarcon, seconded by Commissioner Breen, to APPROVE Conditional Use Permit 02 -870 for a period of one (t) year, subject to the conditions listed in "Exhibit A. TENTATIVE PARCEL MAP 26545 /ZONE VARIANCE 02- 31 51324 Rio Hondo Avenue A request by Mr. Hung Xuong Truong for the subdivision of one (1) parcel into three (3) lots with the development of two (2) new residences, and a variance from Rosemead Municipal Code Section §17.16.060 for the existing front unit's side yard setback located in the R -1, Single- Family Residential zone. Presentation: Assistant Planner Villasenor Staff recommendation: APPROVE —for a period of one (1) year, subject to the conditions listed in "Exhibit A." Applicant(.$): In the audience. Questions from the commissioners to the staff: Chairman Loi requested a block wall corroboration for the proposed two (2) units; Assistant Planner Villasenor confirmed. Chairman Loi opened the public hearing to those IN FAVOR of this application: Project engineer, Mr. Tom Cao of Tritech Associates, 135 North San Gabriel Boulevard, Suite 100, San Gabriel, approached the podium to disclose his client's acceptance of all conditions. In closing, Mr. Cao offered to answer commission questions. Chairman Loi put forth the question of a possible protective wall between the common driveway and existing front unit; whereby, Mr. Can responded negatively, emphasizing a wall's intrusive feature. Alternatively, the engineer recommended the installation of protective posts; however, the project architect, Mr. Charlie Shen of 325 South Altura Avenue, Arcadia, advised a more aesthetically pleasing form of landscape barrier. Public hearing was opener/ to those who wished to OPPOSE the application: Front unit resident, Ms. Siriwong Chulalux of 4334 Rio Hondo Avenue, Rosemead, expressed a safety concern in which the installation of a dividing brick wall down the middle of the driveway to separate vehicles was requested. In order to maintain the Fire Department access minimum of twenty (20) feet, Planning Director Johnson explained that a wall encroachment would not be feasible; therefore, the director urged a landscaped divider. PC RESOLUTION 02 -28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, RECOMMENDING APPROVAL OF CONDITIONAL U.SE PERMIT 02 -875 FOR THE INSTALLATION OF A MOBILE UNIT TO BE UTILIZED FOR OFFICE SPACE AND A LUNCHROOM LOCATED AT 8657 GRAND AVENUE IN THE R -1, SINGLE- FAMILY RESIDENTIAL ZONE (APN: 5389- 007 -017). Vote results: YES: LOL HERRERA, ALARCON, BREEN, ORTIZ NO: NONE ABSTAIN: NONE ABSENT: NONE Chairman Loi declared said motion duly carried and so ordererL 7 ORAL COMMUNICATION FROM THE AUDIENCE This is the time for the public to address the Planning Commission on any matter not presented on the agenda. No response. 8. MATTERS FROM CITY OFFICIALS AND STAFF A. With respect to the northwest corner of Rosemead and Valley Boulevards, Commissioner Breen related interest in the site's renovation progress. Planning Director Johnson notified the commissioner of upgraded design changes, as a result of which, a design review reapplication would be forthcoming. B. Commissioner Ortiz voiced concern over three (3) issues: Firstly, the commissioner conveyed graffiti sightings at the intersection of Del Mar Avenue and San Gabriel Boulevard, additionally, along the main streets of Hellman Avenue, Del Mar Avenue, and San Gabriel Boulevard. Secondly, Commissioner Ortiz solicited thoughts on how to control the widespread graffiti problem once and for all. Lastly, the Silver Mug Saloon had been observed violating a conditional noise restriction, whereby, front doors have been left ajar during operating hours. In response, Planning Director Johnson established that considerable expenditure of city funds is designated to remove graffiti; nevertheless, the director stressed tenant and property owner collaboration, and the hiring of more clean -up crews as possible solutions to the problem. Director Johnson further agreed with the commissioner's assessment of the Silver Mug's noise infraction and resolved to investigate. C. With reference to the southwest corner of Walnut Grove Avenue and Valley Boulevard, Commissioner Herrera communicated that location's untidy state. Planning Director Johnson informed the commissioner that negotiations to settle property line issues is currently ensuing between McDonald's and the T.1's Restaurant property.owner; moreover, the director verified the sending of clean -up notices. Chairman Loi also reported graffiti at 3206 and 3327 Del Mar Avenue; likewise, requesting the improvement status of the overpass situated in the vicinity of the new Garvey Senior Community Center. Planning Director Johnson updated the chairman with current plans to rebuild the entire bridge, together with the use of sloped surfaces to prevent transient encampments. E. Planning Director Johnson closed tonight's proceedings by thanking the commissioners for their appearance at City Manager Frank Tripepi's retirement party. 10.
