Commissioner Breen led the Pledge of Allegiance. Commissioner Herrera delivered the invocation. ROLL CALL: PRESENT: Vice- Chairman Loi, Commissioners Breen, Herrera, and Ortiz ABSENT: Chairman Alarcon EX OFFICIO: Crowe, Price, Wilkinson, Villasenor, and Romanelli 1. APPROVAL OF MINUTES April 1, 2002 (MO) Motion by Commissioner Ortiz, seconded by Commissioner Herrera, that the minutes of the City of Rosemead Regular Planning Commission Meeting of April 1, 2002, be APPROVED as submitted. Vote results: YES: LOI, BREEN, HERRERA, ORTIZ NO: NONE ABSTAIN: NONE ABSENT: ALARCON Vice - Chairman Loi declared said motion duly carried and so ordered 2. EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS Deputy City Attorney Stan Price explained the public hearing process and the right to appeal Planning Commission decisions to the City Council. t 3. ADMINISTRATION OF OATH The commission secretary administered the oath to members of the audience wishing to speak before the Planning Commission. 4. PUBLIC HEARING A. CONDITIONAL USE PERMIT 02- 865 -3508 Rosemead Boulevard A request by Ray Raffesberger, dba "Coast intelligen," to construct a 250 kilowatt cogenerator to be in operation with and adjacent to "Bally's Health Spa" in the C -3D, Medium Commercial with a Design Overlay zone. Presentation: Associate Planner Wilkinson Staff recommendation: TABLE —to an undetermined date. Questions from the commissioners to the staff.• • Avwl. 15, 2002 PLANNING COMMISSION ME4=S PAGE 2 Upon this application's recurrence before the Planning Commission, Commissioner Ortiz put forth a request for advance notice. Owing to unresolved circumstances between the property owners and Southern California Edison, this item will be TABLED until further notice B. CONDITIONAL USE PERMIT 02- 866 -3319 Ivar Avenue A request by Paul Chan to construct a single- family residence with over 2,500 square feet of living area located in the R -1, Single- Family Residential zone. Presentation: Associate Planner Wilkinson Staff recommendation: APPROVE —for a period of one (1) year, subject to the conditions listed in "Exhibit A." Applicant(s): In the audience. Questions from the commissioners to the staff: None. Vice - Chairman Lai opened the public hearing to those IN FAVOR of this application: Project architect, Mr. Kamen Lai of Elite Design Development, Inc., 8748 East Valley Boulevard, Suite K, Rosemead, emphasized having demonstrated sensitivity to neighbor privacy through the integration of ample window height and setback placements. Subsequently, Mr. Lai commended staff on a thorough report and then announced his availability to answer questions. Vice - Chairman Loi inquired into the possibility of front unit improvements; whereby, Mr. Lai answered that the applicant would improve the front unit including the demolition of the illegal garage- conversion. Public hearing was opened to those who wished to OPPOSE the application: Neighboring resident, Mr. Ignacio Guerra of 3322 North Muscatel Avenue, Rosemead, voiced opposition to the proposed dwelling; thereafter, Mr. Guerra concluded by requesting the fence setback dimension. Although Mr. Lai expressed regret for Mr. Guerra's concerns, the project architect provided assurance of the owner's willingness to be a good neighbor. Furthermore a fence setback of ten (10) to twenty (20) feet was established; consequently, affecting a fifty (50) to sixty (60) -foot expanse from Mr. Guerra's home. As a final point, Mr. Lai informed the complainant of today's large -sized housing trend. There being no one further wishing to address the commission, Vice - Chairman Loi closed the public hearing segment for this project. (MO) Motion by Commissioner Ortiz, seconded by Commissioner Breen, to APPROVE Conditional Use Permit 02 -866 for a period of one (1) year, subject to the conditions listed in "Exhibit A." TENTATIVE PARCEL MAP 26540 /CONDITIONAL USE PERMITS 02 -868, 869 2504 -2512 Falling Leaf Avenue A request by Mr. Lanh Trinh and Mrs. Yen Tran to subdivide two (2) residential parcels into four (4) lots for the development of four (4) new single - family residences, two (2) with a living area of over 2,500 square feet, located in the R -2, Light Multi- Family Residential zone. Presentation: Assistant Planner Villasenor Staff recommendation: APPROVE —for a period of two (2) years, subject to the conditions listed in "Exhibit A." Applicant(s): In the audience. Questions from the commissioners to the staff: None. Vice - Chairman Loi opened the public hearing to those IN FAVOR of this application: The project architect, Mr. Tom Can of Tritech Associates, 135 North San Gabriel Boulevard, San Gabriel, thanked staff for a comprehensive report and later offered to answer questions. Project architect, Mr. Kamen Lai of Elite Design Development, Inc., 8748 East Valley Boulevard, Suite K, Rosemead, agreed to the staff - recommended driveway width increase from ten (10) to twelve (12) feet; but opposed the installation of a wooden fence instead of a block wall. Associate Planner Wilkinson responded that the ten (10) -foot driveway width could not accommodate today's larger vehicles. Nonetheless, staff recommended that the fence area be reviewed during final inspection. Public hearing was opened to those who wished to OPPOSE the application: None. There being no one further wishing to address the commission, Vice - Chairman Lai closed the public hearing segment for this project. (MO) Motion by Commissioner Herrera, seconded by Commissioner Ortiz, to APPROVE Tentative Parcel Map 26540 /Conditional Use Permits 02 -868, 869 for a period of two (2) years, subject to the conditions listed in "Exhibit A." PC RESOLUTION 02 -20 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, RECOMMENDING APPROVAL OF CONDITIONAL USE PERMIT 02 -864 FOR THE INSTALLATION OF A FOUR HUNDRED (400) -FOOT UNDERGROUND WATER LINE AND A ONE HUNDRED THOUSAND (100,000) - GALLON BACKWASH WATER TANK WITHIN AN EXISTING PUBLIC UTILITY FACILITY TO BE LOCATED AT 2450 CHARLOTTE AVENUE IN THE R -1, SINGLE - FAMILY RESIDENTIAL ZONE (APN: 5283- 017 - 270,271).
