PC - Minutes - 01-21-02.r 770 PLANN Ais y, J 1 anu WIMM NG CALL TO ORDER: The regular meeting of the City of Rosemead Planning Commission was called to order by Chairman Alarcon at 7:00 p.m. in the council chambers of the Rosemead City Hall at 8838 East Valley Boulevard, Rosemead Commissioner Ortiz led the Pledge of Allegiance. Commissioner Breen delivered the invocation. ROLL CALL: PRESENT: Chairman Alarcon, Vice - Chairman Loi, Commissioners Breen, Ortiz, and Herrera ABSENT: None EX OFFICIO: Crowe, Price, Johnson, and Romanelli 1. APPROVAL OF MINUTES Minutes for December 17, 2001, and January 7, 2002 (MO) Motion by Commissioner Ortiz, seconded by Vice - Chairman Loi, that the minutes of the City of Rosemead Regular Planning Commission Meetings of December 17, 2001, and January 7, 2002, be APPROVED as submitted. Chairman Alarcon declared said motion duly carried and so ordered EXPLANATION OF HEARING PROCEDURES AND APPEAL RIGHTS Deputy City Attorney Stan Price explained the public hearing process and the right to appeal Planning Commission decisions to the City Council. ADMINISTRATION OF OATH The commission secretary administered the oath to members of the audience wishing to speak before the Planning Commission. PUBLIC HEARING A. DESIGN REVIEW 01- 89/ZONE VARIANCE 01- 303 -8548 East Valley Boulevard A request by Mel Cruz/McDonald's Corporation, dba "McDonald's," for the development of a drive -thru restaurant with indoor playplace comprising less than the required amount of parking spaces located in the C -3C, Medium Commercial with a Design Overlay zone. Presentation: Planning Director Johnson • • JANUARY 21, 2002 PLANNING CON UVIISSION MINUTES PAGE 2 Staff recommendation: APPROVE —for a period of one (1) year, subject to the conditions listed in "Exhibit A." Applicant(s): In the audience. Questions from the commissioners to the staff.• Planning Director Johnson revealed the addition of condition number twenty -seven ( #27); wherein, the demolition of the remaining commercial structures, fencing, irrigation, hydroseeding, and landscape maintenance is mandated... "until as Stich time that future construction commences. " Taking into consideration that the subject site is located within a design review overlay zone, Commissioner Breen commented on the restaurant's contrasting signature "orange" color motif. Planning Director Johnson concurred with the commissioner's observation; nevertheless, the director emphasized the favorable area improvement generated by the proposed project. Anticipating a possible traffic disturbance; Vice - Chairman Loi questioned why a "No Left Turn" sign would be implemented at the Valley Boulevard egress, but not at the Walnut Grove Avenue outlet. Seeing as the avenue's access point is much further from the intersection, Director Johnson explained that the traffic engineer deemed an indicator as unnecessary. As a greater deterrence to illegal left turns, Chairman Alarcon recommended the mounting of yellow "bots dots. " In consideration of child safety, Commissioner Ortiz requested site enclosure verification. Although plans do not denote any proposed block walls or fencing along property lines, Director Johnson confirmed the installation of a six (6) -foot high chain link fence enclosing the remaining undeveloped open site as ordered in condition number twenty -seven ( #27); however, as future developments to the west are proposed, block walls will be required. ZONE VARIANCE 01- 311 -2722 Charlotte Avenue A request by Gilberto Rivera, for a variance from Section §17.20.080 of the Rosemead Municipal Code to construct a residential addition with less that the required lot size located in the R -2, Light Multi- Family Residential zone. Planning Director Johnson indicated that the lesser width is an extension of the existing home's setback. Chairman Alarcon opened the public hearing to those IN FAVOR of this application: In relating to the applicant's dilemma, a neighbor, Mr. Roberto Carrera of 2708 North Charlotte Avenue, Rosemead, offered a brief account of permit denials he also encountered while attempting to build a garage upon his undersized lot; consequently, Mr. Carrera declared his full approval of Mr. Rivera's zone variance application. CONDITIONAL USE PERMITS 01- 859/ZONE VARIANCE 01- 313 -3031 Rosemead Place A request by Hung Tran to construct a residence with a living area of over 2,500 square feet and for a variance from Section § 17.16.070 of the Rosemead Municipal Code for a residential addition comprising less than the required rear yard setback located in the R -1, Single- Family- Residential zone. Presentation: Planning Director Johnson Staff recommendation: APPROVE —for a period of one (1) year, subject to the conditions listed in "Exhibit A." Applicant(s): In the audience. Questions from the commissioners to the staff: Concerned that the proposed dwelling will overshadow the adjacent homes, Commissioner Ortiz desired to know the front yard setback dimension and whether the proposed unit will coincide with the twenty (20) -foot parameter requirement. As a final issue, the commissioner inquired into the west wall intention. Planning Director Johnson confirmed a front setback of twenty -four (24) feet — approximately five (5) feet beyond the existing home situated to the south; likewise, once the garage is demolished, the resulting block wall gap from where the accessory structure previously stood will be rebuilt. However, to maintain conformity, a fencing plan must be submitted prior to wall construction. • • JANuARY 21, 2002 PLANNING CONMSSION MINUTES PAGE 4 Chairman Alarc6n opened the public hearing to those IN FAVOR of this application: The project engineer, Mr. Kamen Lai of Elite Design Development, 8748 East Valley Boulevard, Suite K, Rosemead, commended staff for a thorough staff report. Afterward, Mr. Lai provided a brief project supplement recounting a forty (40) foot curbside setback, a four (4) to five (5) -foot protruding porch, and a main residence extending two (2) to five (5) feet past the neighbor to the south. Questions from the commissioners to the staff: None. • JANUARY 21, 2002 PLANNING CONMSSION MIN= PAGE 5 Chairman Alarcon opened the public hearing to those IN FAVOR of this application: Business owner, Ms. Maggie Nguyen of 4900 Overland Avenue, Apartment 149, Culver City, approached the microphone to request another one (1) year extension on a an awning replacement notice issued by the city. Ms. Nguyen cited economic hardship and contractor difficulties as the principal motives for the extra time appeal. In view of the facts that a one (1) year postponement had previously been granted at the last commission meeting, and the awning color patterns (dark green/burgundy) do not complement the design review guidelines; Planning Director Johnson advised against another extension. Nonetheless, the final decision was deferred to the commission. In preference to purchasing costly new awnings, Commissioner Herrera commented on the possibility of repainting directly onto the existing canvas fabric. As an alternative and to allow the applicant time to improve her finances, Commissioner Ortiz suggested a six (6) -month interval; the Planning Commission consented. MATTERS FROM CITY OFFICIALS AND STAFF A. Vice- Chairman Loi remarked of malfunctioning electronic voting machine switches and asked that they be repaired. Planning Director Johnson vowed to look into the problem. B. Commissioner Ortiz reported three (3) violations observed at 8925 Cortada Street involving discarded compaction dirt mixed with bricks, rocks, and debris; a disproportionate grading level; and a hazardously hanging telephone cable. Director Johnson assured the commissioner that a building inspector would be dispatched to the site and that the property owner would be ordered to clean up. 9.
