PLANNING COMMISSION
Minutes of August 20, 1962
A regular meeting of the Planning Commission of the City of
Rosemead was held in the Council Chambers, 8815 East Valley
Boulevard. The meeting was called to order by Chairman Wilt
at 7 :45 o'clock p.m.
1. The Pledge of Allegiance was led by Commissioner Taylor.
2. Present: Commissioners: Taylor, Kunz, Crabtree, Wilt.
Absent: Commissioners: Casares, Buchanan, McCaffree.
Ex officio: Farrell, Flanery, Mansur, Phillips.
3. APPROVAL OF MINUTES: August 6, 1962.
Chairman Wilt stated that the following corrections should be
made: (1) Page 2, paragraph 5, add "The applicant declined to
withdraw his application." (2) Page 2, Item 7, condition No. 2,
should read "construction of garages." (3) Page 3, Item 8,
paragraph 1, and Condition No. 2 in the motion strike the word
"standards." (4) Page 3, last motion, second line, strike
"provisions" and add "conditions."
(MO) It was moved by Kunz, second by Taylor and unanimously carried
that the minutes of August 6, 1962, be approved as corrected.
ADMINISTRATION:
OLD BUSINESS
4. PLOT PLAN NO. 78 - REPORT RE: ESCROW DATES, ETC.
Secretary Farrell stated that this plot plan is being investigated
by Mr. Norman Frakes, Regional Planning Commission. This investi-
gation is not complete as yet.
Chairman Wilt stated that this item should be on the next agenda.
NEW BUSINESS
5. ZONE EXCEPTION CASE NO. 14 - PUBLIC HEARING - OVERTON A. PHILLIPS -
8724 EAST GARVEY AVENUE
Advisor Flanery presented the factual data regarding this Zone
Exception Case. All legal requirements have been met. This
request is to extend an existing automobile restoration business
onto adjacent property in the R -2 Zone (Two Family Residence),
and to construct a 6 foot high wall extending into the setback.
The proposed developments, which include a 3,500 square foot
structure, a 6 foot high wall on the east, and portions of the
south and west property lines, and black top surfacing, are shown
on the Plot Plan marked Exhibit "A ". This use would require seven
oof- street parking spaces. It is indicated on Exhibit " A " that
18 parking spaces would be provided on the subject property.
Chairman Wilt declared the Public Hearing open at 8 :05 o'clock
p.m. Chairman Wilt asked that anyone desiring to be heard concern-
ing this matter stand and be sworn in.
The oath was administered by Advisor Flanery.
Mr. 0. A. Phillips, 8724 East Garvey Avenue, South San Gabriel,
owner and applicant, stated that he has owned this property for
12 years during which time the business of restoring antique
automobiles has grown to where he needs more room. He has 8

employees at the present time and is most willing to comply with
any reasonable condition the Commission might impose on this case.
Mr. Alvarez, 2729 North Stimgle Avenue, stated that he had no
objection to this type of business, but he did not want to.have
it so close to residences.
Considerable discussion was held in regard to drainage, land-
scaping, limit of age of cars to be restored, etc.
Everett Mansur, Planning Consultant, stated that being there are
no strong objections, this would probably be a good use.
Chairman Wilt stated that there being no opposition in writing
and all persons so desiring had been heard the Public Hearing
would be closed at 8 :25 o'clock p.m.
(MO) It was moved by Taylor, second by Kunz, that Zone Exception Case
No. 14 be approved subject to the following conditions:
1. That four (4) copies of a revised plot plan be submitted
for approval by the City Administrator incorporating such of the
following conditions as may be shown on a plan. The property
shall be developed substantially in accordance with the approved
revised plan.
2. That a 6 -foot masonry wall be erected along that portion
of the southerly boundary of the property not covered by buildings.
Such wall shall extend from the southeast corner of the building
to a point 15 -feet from the east property line and shall be step-
ped down or tapered to a 42- inches within the front setback area.
3. That, except for the accessway, a 6 -foot wall shall be
constructed parallel to Muscatel Avenue and setback 15 -feet from
the east property line.
4. That the area between the 6 -foot wall and the front
property line shall be landscaped in a manner suitable to the
City Administrator and continuously maintained.
5. That all areas used by automobiles or trucks shall be
paved with blacktop, concrete or macadam.
6. That the roof shall be so designed and constructed as to
require that drainage shall be onto subject property.
7. That there shall be no windows along the southerly wall
of the structure.
8. That air conditioning equipment and blowers shall be
placed along the northerly portions of the proposed structure.
9. That this facility be limited to the restoration of
automobiles 20 years old or older.
10. That a minimum of ten (10) off - street parking spaces be
provided on property under their ownership.
11. That curbs, gutters and sidewalks be constructed.
12. That there be no outside storage above the height of
the fence.
13. This exception shall not be affective for any purpose
until the owner of the property involved has filed at the office
of the Planning Commission his affadavit stating that he is aware
of and accepts all the conditions of this exception.

14. It is hereby declared to be the intent of this zone
exception, that if any provisions thereof are held and declared
to be invalid, the same shall be void and all of the privileges
granted hereunder shall lapse,. unless the Planning Commission,
upon application and good cause appearing therefore, determines
otherwise.
15. It is hereby further declared c:n.d made a condition of
this zone exception, that if any condition hereunder is violated
or if any other applicable law, statute or ordinance is violated
in the operations hereunder, this zone exception be sus -
pended and the privileges granted hereunder shall lapse, provided,
that the applicant has been given written notice to cease such
violation and has failed to do so for a period of thirty (30)
days.
(RC) Roll call vote was as follows: Ayes: Taylor, Kunz, Crabtree,
Wilt. Noes: None. Absent: Casares, Buchanan, McCaffree.
Advisor Flanery presented the Findings of Fact as follows:
1. There were no protests to the granting of this exception.
2. There are practical difficulties or unnecessary hardships
in the way of carrying out the strict letter of the ordinance.
In the granting of this exception the spirit of the ordinance
will be observed, public safety secured and substantial justice
done.
6. PLOT PLAN NO. 107 - GEORGE D. FINLAY - 9256 RIO DELL STREET
Advisor Flanery presented the factual data regarding this plot
plan.
Chairman Wilt stated that these long driveways are not the best
arrangement.
George Finlay, owner, stated that he preferred two separate drives
rather than one community drive, because he plans on living on
Parcel " A " and has children and the safety factor of a community
drive is not good.
(MO) It was moved by Kunz, second by Taylor, that Plot Plan No. 107 be
approved subject to the Planning Commission's Standard Requirements
and that the existing driveway on Parcel " A " be resurfaced.

Wilt. Noes: None. Absent: Casares, Buchanan, McCaffree.
