PC - Minutes - 07-19-66CITY OF ROSEMEAD PLANNING COMMISSION MINUTES 'OF JULY 19,1966 A regilar meeting of the Planning Commission was called to order by Chairman Taylor at 7:35 P.M, in the Council Chambers at the City Hall, 3018 North Charlotte Avenue. 1. CALL TO ORDER The Pledge of Allegiance was led by Commissioner Pike. The Invocation was given by City Attorney Brown. 2. ROLL CALL Present: Commissioners: Buchanan, Holmes, Kunz,, Pike, Taylor Absents Commissioners: None Ex Officio: Brown, Hersh, Meyer, Wilder APPROVAL OF MINUTES 3. JUNE 8, 1966 (MO) It was moved by Commissioner Buchanan, second by Commissioner Holmes, and unanimously carried, that the Minutes of June 8, 1966, be approved as written. 4. JULY 5, 1966 (MO) It was moved by Commissioner Kunz, second by.Commissioner Buchanan, and unanimously carried, that the Minutes of July -5, 1966, be approved as written. Mr. Hersh administered the Oath to those persons wishing to testify at this public hearing. Chairman Taylor declared the Public Hearing open at 7:44 P.M. PROPONENTS: l.. C.. Discussion by the Commission (MO) I't' was moved by Commissioner Kunz, second by Commissioner Holmes,, that Zone Variance Number 39 be approved subject to the following conditions: l That the existing' and proposed development be maintained substantially as indicated on the Plot Plan marked Exhibit A. 2. That any future additions or modifications substantially in accord with the present approved dev lopment may be considered- and approved by the Planning Commission under the plot plan procedures, except,in those cases where a zone variance request is indicated as necessary by the existing zoning regulations, 3. That parking and landscaping shal,I'be provided and maintained „in accord with zoning ordinance requirements, and in accord with plans submitted to and approved by the City Staff. 4.. The maximum horizontal height of.the proposed four story building shall not exceed the maximum horizontal height of the adjoining residence,to.the south,.House "A ", 8521 Drayer Lanei 5. This approval shall not be effective for any purpose until the owner of the property involved has filed an Affidavit of Acceptance of Conditions, indicating he is aware of and accepts all the conditions.of this Variance: 6: It is hereby declared to be the intent of this, Variance that if any provision thereof is held and declared to be invalid, the same . shall be void and all of the privileges granted hereunder shall lapse, unless the Planning Commission, upon application and good cause appearing thereforei determines otherwisei 7: It is further declared and made"a condition of this Variance that if any condition hereunder is violated or if any other applicable law, statute, or ordinance is violated in the development hereunder, this Variance shall be suspended and the privileges granted hereunder shal %l lapse; provided that the . applicant has been given written notice to cease such violation and has failed to do so within a period of thirty days. 8: this Variance shall become null and void unless use thereof is commenced within one year from the date of approval hereof: (RC) ROLL CALL VOTE on the motion as follows Ayes: Commissioners: Buchanan, Holmes, Kunz, Pike, Taylor Noes: Commissioners: None Absent: Commissioners: None 7. UNFINISHED BUSINESS 8. PLOT PLAN NUMBER 253 (LOT SPLIT) CHARLES HENNINGS 4456 NORTH EARLE STREET Mr: Hersh presented the factual data. Discussion by the Commission followed the presentation. (MO) It was moved by Commissioner Pike, second by Commissioner to approve Plot Plan.Number 253 as a division of land, subject to the following conditions: 1. That the subject property shall be divided as indicated on the plan marked Exhibit "A ". 2. That a sidewalk, approximately. 82 feet long, shall be installed along the front of the property designated as 4456 Earle Street prior to the approval and recordation of the required parcel map. 3_,. That the owner and applicant shall submit "a Parcel ;;ap as required and setforth in the S' to Subdivision Map Act and shall pay such fees as are required to cover the processing and recordation of said Parcel Map. 4c That the land shall not be sold or transferred prior to the approval and recordation of the required Parcel Map: 5t This approval shall not be effective for any purpose until the owner and applicant has filed a signed Affidavit of Acceptance of Conditions. 6. The subject property shallotherwise be developed in conformity with Ordinance requirements and the applicable Commission olicies and standard requirements, 7. This approval shall be null and void unless used within one year of the date of this approval. PLOT PLAN NUMBER 264 FRANK PACE 2643-45 MUSCATEL Mr Hersh presented the factual date to the Commission Discussion by the Commission. (MO) It was moved by Commissioner Holmes, second by Commissioner Buchanan, that Plot Plan Number 264 be approved with the following conditions: 1. That five copies of revised plot plans, showing garages, not carports, and guestparking, as requested by the Planning Commission, be submitted to Staff for review and approval. 2. That the subject property shall otherwise be developed in conformity with the City Zoning Ordinance and the applicable Commission policies and standard requirements. 3. That the owner of the subject property shall dedicate a four foot strip of street frontage for the required improvements. 4. That the installation of curbs, gutters, and sidewalks be made prior to occupancy of the proposed dwelling units, and that the permit for said improvements be obtained at City Hall prior to the issuance of a building permit. 5. The parking area at the rear of the restaurant shall be kept lighted after dark, during !-.c:.::-s, 5. There shall be use of flashing or blinking lights or signs, 6. The occupancy capacity of the restaurant shall not exceed forty persons at any time: 7. This Permit shall expire two years from the date of this . approval, except that the owner may apply for,an'extension of time, and the Commission may consider and.gran:: such extension of time as they then consider appropriate; 8. If, for any reason, the Permit hereby granted is vacated, suspended, or lapsed, then in that event there shall be no liability of any kind of the City of Rosemead; its officers, officials, or employees, to this permitfee or to any successor in interest. 9. This Conditional Use Permit shall not become effective until the owner /applicant of the property involved has filed with the Planning <-a:'.men Ais signed Affidavit of Acceptance of Conditions. 10. It is hereby declared to be the intent of this Permit that if any provision thereof is held and declared to be invalid, the same shall be void and all of the,privileges granted hereunder shall lapse, unless.the Planning Commission, upon application and good cause appearing therefore; determines otherwise. 11.
