PC - Minutes - 08-15-67PLANNING COMMISSION CITY OF ROSEMEAD ROSEMEAD, CALIFORNIA 46 MINUTES OF AUGUST 15, 1967 A regular meeting of the Planning Commission was.called to order by the Chairman, Commissioner Pike at 7:42 P.M, in the City Council Chambers, 3018 N. Charlotte Avenue, Rosemead. 1. CALL TO ORDER The Pledge of Allegiance was led by Cha,irman Pike. Mr. John Aussenhofer of the Narramore Christian Foundation delivered the invocation. 2. ROLL CALL Present: Larson, Pike, O'Hagan, Taylor Absent: Holmes Exofficio: Director of Planning --Al Hersh City Attorney - Bob Joehnck Admin. Asst..- Steve Street Secretary - Foy Burton 3. APPROVAL OF MINUTES - August 1,.1967 August 8,.1967 (Special Meeting) Commissioner Taylor asked that the motion on page 2 of the minutes of August 1, 1967 be corrected to read "It was moved by Commissioner O'Hagan, seconded by Commissioner Larson ...." as Commissioner Taylor was not present at this meeting. (MO) It was moved by Commissioner O'Hagan, seconded by Commissioner Larson, and unanimously carried that the minutes of August 1, 1967 be approved as corrected.. (MO) it was moved by Commissioner Taylor, seconded by Commissioner Larson and unanimously carried that the minutes of August 8, 1967 be approved as written. 4. TIME RESERVED FOR PERSONS IN THE AUDIENCE WHO WISH TO ADDRESS THE COMMISSION. There were none. PUBLIC HEARING 5. ZONE VAR4ANCE CASE #50 - 4211 North Muscatel - a variance for a Minor Division of Land - two lots with less than required area. Planning Director Hersh presented the factual data. Chairman Pike declared the public hearing open at 7:52 P.M. _ 0 PC PAGE TWO August 15, 1967 Zone Variance Case #50 (Continued) Mr. Hersh administered the Oath to those persons wishing to testify at this public hearing. PROPONENTS: 1. Mrs. Jeanne Schreckler, 4211 N. Muscatel, testified regarding reasons and justification for granting the requested development. 2. Mr. Rodney Schreckler, P.O. Box 162, Rosemead, testified regarding reasons and justification for granting the requested development. OPPONENTS: None Chairman Pike declared the public hearing closed at 7:59 P.M. Discussion by the Commission. (MO) It was moved by Commissioner Taylor, seconded by Commissioner Larson that Zone Variance Case #50 be denied by Resolution 67 -13 based on the findings that.Zone Variance Case #50 presented no evidence of hardship and was contrary to the comprehensive General Plan. Service Station Ordinance - Chairman Pike set this item back on the agenda to permit other business to be completed. NEW BUSINESS 7. ZONE VARIANCE CASE #39 - Request Time Extension. Planning Director Hersh presented the case history of Zone Variance #39 and reasons for the requested time extensirn to the Planning Commission. Discussion by the Commission. (MO) It was moved by Commissioner Taylor, seconded by Commissioner Larson and unanimously carried that Zone Variance Case #39 be granted a one year time extension. 8. TENTATIVE TRACT 19922 - Euclid Construction Company - Angelus and Keim Streets - Nine Lot Subdivision r w, PC PAGE THREE August 15, 1967 Planning Director Hersh presented the factual data.. Mr..Lew Webb was present to answer questions for the Commission. Discussion by the Commission. (MO) It was moved by Commissioner O'Hagan, seconded L- Comm' - Taylor and unanimously carried that Tentative Tract 19922 be approved subject to the conditions recwmm;�nded by the Subdivision Committee and as amended in the attached letter from the Subdivision Committee dated August 10, 1967. 9.. PLOT PLAN #302 - R -3-D (Design Overlay) Plans - Euclid Construction Company. Planning Director Hersh presented the factual data. Mr. Lew Webb was present to answer questions for the Commission. Discussion by the Commission. (MO) It was moved by Commissioner Larson seconded by Commissioner O'Hagan and unanimously carried that Plot Plan #302 be approved subject to the following conditions:_ r 1. Development of the nine parcels substantially in a. .. with the plot plan marked "Exhibit A ", except that the Planning Director may approve minor revisions or altera- - tions on each lot. 2. The property shall otherwise be developed in accord with pertinent regulations of the City Zoning Ordinance (Ord 112) and applicable Commission policies and requirements. 3. This approval shall not be effective for any purpose until the City Council has approved the Final Tract Map, and the map has been recorded; and the applicant has filed an affidavit of Acceptance of Conditions indicating he is aware of and accepts all the cond;�;c:.. - , of this approval. 4. This approval shall become null and void unless us:: thereof is commenced within one year from the date of City Council approval and the recordation of the Final Tract Map. MATTERS FROM COMMISSION AND STAFF 0 a. Zone Violation - Minor Land Division Regulation - Mr. and Mrs. Cianfrocca - 3226 Rosemead Place. Planning Director Hersh presented the facts behind this odd violation. Mr. and Mrs. Cianfrocca testified regarding the manner in which the property came to be divided without Commission approval and no street access. A possible solution was suggested by Director Hersh. The Cianfrocca's agreed to try to arrange a drive access and to submit a request for Commission approval. Chairman Pike declared a recess at 9:10 P.M. Meeting was reconvened at 9:25 P.M. 6. Service Station Ordinance Planning Director Hersh presented the proposed ordinance to the Commission. Mr., Stan Donovan, Atlantic - Richfield Company, was present to answer questions from the Commission. Discussign by the Commission. Minor revisions were made by the Commission and a public hearing was set for September 5, 1967. .Chai;rman Pike adjourned the meeting at 10:45 P.M. CITY OF ROSEMEAD AUGUST 22, 1967 0 TENTATIVE TRACT NO. 19922 CONDITIONS 1. This approval expires 18 months from the date of approval of this tract by the City Council of the City of Rosemead. DESIGN 2. Provide sufficient area for all lots to conform with the re- quirements of the R -3 -D zone. 3. Provide street improvements including cement concrete curbs and gutters and drainage structures as required by the Sub- division Ordinance. 4. Provide street lights throughout the tract to the satisfaction of the Road Department, including one at the intersection of Kelm Street and Angelus Avenue. 5. As agreed, provide 5 foot wide sidewalks along Keim Street and along Angelus Avenue south of Kelm Street. Place these i sidewalks adjacent to the curb with above- ground utilities, . including but not /limited to street lights, fire hydrants, underground utility junction boxes, etc., outside the sidewalk area. Each lot in this Tract to have underground utilities. Provide 5 foot wide planting and utility easements outside of the right -of -way on Kelm Street and Angelus Avenue south of Kelm Street. Provide standard sidewalks along Angelus Avenue north of Kelm Street. 6. As agreed, provide street trees and signs to the satisfaction of the Planning Department. ROAD DEPARTMENT 7. a. Comply with the Road Department's requirements regarding street and drainage improvements and easements needed for street drainage. Split the north -south drainage at the intersection of Kelm Street and Angelus Avenue. b. Easements shall not be granted or recorded within rights - of -way proposed to be deeded or dedicated for public streets, until after the tract is recorded, unless such easements are subordinated to the road easement by certi- fication on the title sheet of the final map. CITY ENGINEER - DESIGN DIVISION 8. "Portions of the property are subject to sheet overflow and ponding. Provide for contributory drainage from adjoining properties. Eliminate the sheet overflow and ponding or elevate the floors of the buildings with no openings in the foundation walls to at least 12 inches above the finished pad grade." CITY OF ROSEMEAD AUGUST 22, 1967 0 TENTATIVE TRACT 19922 -2- CONDITIOMS CITY ENGINEER - SANITATION DIVISION 9. "Approval of this tract is contingent upon the installation and dedication of local sewers to serve the subdivision. Easements are tentatively required, subject to review by the City Engineer to determine the final locations and requirements. The subdivider shall consult the Sanitation Division of the Department of City Engineer to determine the sewer design requirements." CITY ENGINEER - WATERWORKS AND UTILITIES DIVISION 10. "1. All lots shall be served by an adequate size water system. The water system shall include fire hydrants of the size and type and location as determined by the City. 2. The water mains, within the tract, shall be of sufficient size to accommodate the total domestic and fire flows required for the tract. Domestic flows required are to be determined by the City. Fire flows required are to be determined by theitity. 3. At the time the final tract map is submitted for checking, plans and specifications for the water mains shall be submitted to the City Engineer for checking and approval, and shall comply with the City Engineer's standards. 4. Approval for recordation of this tract is contingC nt.upon approval of plans and specifications mentioned above, and the subdivider submitting to the City Engineer, either (a) an Agreement and a Faithful Performance Bond in the amount estimated by the City Engineer guaranteeing the installation of the water system, or (b) an agreement and other evidence satisfactory to the City Engineer, Indicating that the subdivider has entered into a contract with the sere! i r.g v :<�ter ut's 1 i ty �o :ct °`.e .._`er system as required, and has deposited with such water utility security guaranteeing payment for the installa- tion of the water system. CITY ENGINEER - BUILDING AND SAFETY DIVISION H. "The grading plan must be approved prior to recordation of the final map. ,Prior to issuance of building permits, submit a soil.test engineer's report on the expansive properties of soils on all building sites in the proposed subdivision. Such report shall be supported by sufficient test data to justify the findings. If expansive soils are found to exist at locations and depths likely to affect future structures, the report shall include specific recommendations for resisting the effects of differ- ential movement of soils supporting structures. Soils com- pacted to a minimum of 90% of the optimum density and exhibiting a swell of more than 3% from air dry to saturation under a surcharge loading of 60 pounds per square foot shall be con- sidered expansive soils." CITY OF ROSEMEAD TENTATIVE TRACT 19922 AUGUST 22, 1967 -3- CONDITIONS FORESTER AND FIRE WARDEN 12. "1. Provide water mains, fire hydrants, and fire flows as determined by the 6ity Fire Chief for all land shown on the map to be recorded. 2. Provide water mains, fire hydrants, and fire flows as determined by the City Fire Chief for any land shown on the tentative tract map but deleted as part of the final map prior to recordation if there are either existing streets and highways fronting the land deleted or streets and highways are to be constructed fronting the land deleted." DEPARTMENT OF PARKS AND RECREATION 13. "All existing trees, if any, to be removed from street R /W'.s to be dedicated, or dedicated R /W's, and no planting to be done except upon approval of the City Planning Department. The City of Rosemead requires trees. Please contact the City for the necessary permit and specifications." FLOOD CONTROL DISTRICT )4. "The subdivision is reasonably free of flood hazard from major channels and streams under the Flood Control District's jurisdiction. Refer to the flood hazard report from the office of the City Engineer, Design Division." HEALTH DEPARTMENT 15. "That sanitary sewers be installed to serve the tract. The owner's statement indicates that domestic water will be supplied by Southern California Water Company." AEH:fb
