PC - Minutes - 08-01-67PLANNING COMMISSION CITY OF ROSEMEAD ROSEMEAD, CALIFORNIA MINUTES OF AUGUST 1, 1967 A regular meeting of the Planning Commission was called to order by the Cha�?man, Commissioner Pike, at 7:38 P.M. in the City Council Chambers, 3018 N. Charlotte Avenue, Rosemead. 1: CALL TO ORDER The Pledge of Allegiance was led by Commissioner Larson Reverend Foreman delivered the invocation. 2. ROLL CALL Present: Larson, O'Hagan and Pike Absent: Holmes and Taylor Exofficio: Director of Planning - Al Hersh City Attorney - Bob Joehnck Admin. Asst. - Steve Street Secretary - Foy Burton 3. APPROVAL OF MINUTES - July 18 1967 (MO) It was moved by Commissioner Larson, seconded by Commissioner O'Hagan and unanimously carried that the minutes of July 18, 1967 be approved as written. 4. TIME RESERVED FOR PERSOk'S IN THE AUDIENCE WHO WISH TO ADDRESS THE COMMISSION. Mr. Al Lewis, 1601 testified regarding was approved by the Mr. Lewis requested provided for a wall of the church. N. Delta, So. San Gabriel. Mr. Lewis Conditional Use Permit #12 which Planning Commission on July 18, 1967. the condition be deleted which to be erected on the south boundary (MO) It was moved by Commissioner O'Hagan, seconded by Commissioner Larson that the erection of a wall on the south boundary of the church be deleted from the conditions of Conditional Use Permit #12. ZONE VARIANCE CASE #45 - Revised (2) - Antique Auto Parts - 9113 East Garvey Planning Director Hersh presented the factual data. Chairman Pike declared the public hearing open at 7:55 P.M: Mr. Hersh administered the Oath to those persons wishing to tes at this public hearing. Mr. Dale Ingram, 10316 Asher Street, El Monte (representing Mr. Gene Scott) testified regarding reasons and justification for granting the proposed development. 2. Mr. B.H. Ranney, 1795 Wagner, Pasadena testified he was a property owner in the area under consideration -and would like to see the case approved as in accord with proper development of similar property in the area. OPPONENTS: 1. Elizabeth Houchen, 3027 Sullivan Avenue, testified that the use and appearance justified denying the requested development. 2. Wallace Houchen, 3027 Sullivan Avenue, testified regarding traffic on Sullivan Avenue and asked the request be denied. 3. Harry Aghbashian, 9063 E. Garvey testified regarding reasons for denying the requested development. Chairman Pike declared the public hearing closed at 8:48 P.M. Discussion by the Commission (MO) It was moved by Commissioner O'Hagan, seconded by Commissioner Taylor, that (as Resolution 67 -11) Zone Variance #45 - Revised (2) be approved subject to the following conditions: 1. Development of subject property shall be substantially in accord with the plans marked "Exhibit A - Revised (2)" The block wall indicated on the plans to north and west sides of the parcel north of the alley, shall be erected within thirty days of the date of this approval. 2. Signs in accord with City Standards subject to submission of plans, and approval by the Director of Planning. 3. All development on the site shall be in accord with approved plans and otherwise developed in accord with the City Zoning regulations (Ord. 112). 4. All existing structures located on the site north of the alley, in violation of city regulations shall be removed within 180 days of the date of approval of this variance. 5. This approval shall not be effective for any purpose until the owner of the property involved has filed an affidavit of acceptance of conditions indicating he is aware of and accepts all the conditions of this variance. 6. It is hereby declared to be the intent of this variance that if any provision thereof is held and declared to be invalid, the same shall be void and all of the privileges granted hereunder shall lapse, unless the Planning Commission, upon application and good cause appearing therefore, determines otherwise. It is further declared and made a condition of this variance that if any conditions is violated or if any other applicable law, statute, or ordinance is violated by development hereunder, this variance shall be sus- pended and the privileges granted shall lapse subject to the applicant being given written notice to cease such violation and he fails to do so within a period of thirty days thereafter,. 8. This variance shall become null and void unless use of this variance is commenced by clearance of the area north of the alley within 180 days from the date of approval of this variance; and once the land is cleared this variance shall become null and void unless a valid building permit has been secured and erection of the proposed storage building has commenced and is being actively pursued within one year of the date of this approval. 9. If the parcel north of the alley is not cleared within 180 days, thirty days notice to clear shall be issued. If the land is not cleared within said thirty days, this variance shall be void, no building permit may be issued, nor any outstanding permits used and the Commission will not accept the filing of any further cases on this property for a period of six months thereafter. 10. The applicant shall arrange to have all weeds on the subject properties cleared within thirty days of the date of this approval. ZONE CHANGE CASE #21 - Modern Service Company - Council requested Commission review of parking. Discussion by Commission (MO) It was moved by Commissioner O'Hagan, seconded by Commissioner Larson,that Zone Change Case #21 be referred back to the City Council for second reading with the recommendation that the C - 3-D zone is adequate to control parking and other facilities on the site. Proposed Service Station Ordinance Mr. Hersh presented the revised service station ordinance to the Commission. Mr, Stan Donovan, Atlantic - Richfield Company, was present to answer questions the Commission asked regarding service stations. Discussion by the Commission. The City Attorney and the Planning Director were requested t6 make the necessary minor changes and return the revised draft to the Commission for a final review before setting a public hearing. NEW BUSINESS 8, There was none COMMUNICATIONS 9'. There were none 10; ORAL COMMUNICATIONS FROM THE AUDIENCE ..There were none 11. MATTERS FROM COMMISSION AND STAFF 1' Planning Director Hersh reported staff findings regarding service station at southeast corner of Lower Azusa and Encinita Avenue. Letter sent requesting installation of trees and proper maintenance. 2. Commission advised that letter had been sent to OLE'S (valley Blvd,) requesting Earle Avenue cul -de -sac be planted and maintained and indicating street improvement requirement. 3'. The Commission.was advised that the home on the Morse property is in the process of remodeling under valid building permits, and authorized to continue to completion. 41. Mr. Hersh presented a request from the Modification Committee regarding side yard requirement modification at 2446 La Presa. Commission recommended Committee approve request. Chairman Pike adjourned the meeting at 11 :13 P.M. c P.
