PC - Minutes - 01-16-68PLANNING COMMISSION CITY OF ROSEMEAD ROSEMEAD, CALIFORNIA MINUTES OF JANUARY 16, 1968 A regular meeting of the Planning Commission was called to order by the Chairman, Commissioner Taylor, at 7:35 P.M., in the City Council Chambers, 3018 North Charlotte, Rosemead. 1. CALL TO ORDER The Pledge of Allegiance was led by Administrative Assistant Steve Street. Commissioner Pike delivered the invocation. 2. ROLL CALL Present: Commissioners: Holmes, Larson, Pike, O'Hagan and Taylor Absent: Commissioners: None Ex Officio: Director of Planning - Al Hersh Admin. Asst. - Steve Street City Attorney - Bob Joehnck Secretary - Foy Burton 3. -APPROVAL OF MINUTES - January 2, 1968 (MO) It was moved by Commissioner Larson, seconded by Commissioner Holmes, and unanimously carried, that the minutes of January 2, 1968 be approved as written. 4. TIME RESERVED FOR PERSONS IN THE AUDIENCE WHO WISH TO ADDRESS THE COMMISSION. None PUBLIC HEARING 5. CONDITIONAL USE PERMIT NO. 17 - City of Monterey Park - establish- ment of water well to supplement established water supply for the City of Monterey Park. Planning Director Hersh presented factual data. Chairman Taylor declared the public hearing open at 7:47 P.M. Mr. Hersh administered the Oath to those persons wishing to testify. PROPONENTS 1. Mr. Harry Wills, Director of Public Works, City of Monterey Park, 320 West Newmark, Monterey Park. OPPONENTS None Chairman Taylor declared the public hearing closed at 7:49 P.M. PC January 16, 1968 Page Two CONDITIONAL USE PERMIT NO. 17 (Continued) 0 Discussion by the Commission included the proposed walls, fencing, area for well or wells, area to be used for park purposes and parking. (MO) It was moved by Commissioner Holmes, seconded by Commissioner O'Hagan, that Conditional Use Permit No 17 be approved per Resolution No. 68 -3, subject to the foliowing conditions: 1. The applicant shall submit revised plans'; subject to staff approval; and the subject property shall thereafter be developed; landscaped' fenced, walled and maintained sub- stantially in accord with the approved, revised plot plan marked 'Exhibit A - revised" and "Exhibit B - revised ". 2� The applicant shall provide an area twenty feet deep at the front or northerly end of the property, along the westerly ninety (90) feet of the subject property for use as an entry drive to the site, and for eight (8) head -in type, off - street parking spaces; the applicant shall install six inch curbing along the perimeter of the inset area and shall pave the area to City Standards. 3. All mechanical and electrical equipment shall be enclosed and soundproofed to prevent noise in the surrounding area. The enclosure subject to Planning Department approval of the design for the structure. 4. A decorative masonry wall, with gate, not less than six (6) feet high shall be constructed within 150 feet of the rear property line, across the width of property; the rear approximately 150 feet of the subject property to be used for the proposed well, circular driveway, maintenance facilities, and interior landscape of the well site proper; the remaining front portion of the site to be permitted to be used for park purposes by the City of Rosemead except for the necessary twelve (12) foot driveway to provide access to the well site at the rear of the property. The City of Monterey Park is to provide the landscape plantings, minor park facilities, and general maintenance for the area, and shall be held free of liability in the area used for park purposes. 5. The City of Monterey Park may locate or relocate their water wellhead within the 112 by 150 foot well site area within the rear 150 feet of the subject property as required to secure the best well location, subject to staff approval of the selected site. 6. No work, except of an emergency nature, shall be performed on the site between the hours of 8 :00 P.M. and 8:00 A.M. 7. No trucks or other vehicles shall be stored on the site; and no vehicles shall be parked on the driveway outside the walled enclosure. 8. The property shall otherwise be developed and maintained in accord with applicable Zoning Ordinance standards and Planning Commission Policies and Standards. This permit shall become null and void unless use thereof is commenced within one year from the date of approval hereof. 10. Owner /applicant shall submit a signed Affidavit of Accep- tance of Conditions to staff. SUBDIVISION ORDINANCE (Hearing continued from November 21, 1967 and December 19, 1967) Chairman Taylor set this item back on the agenda to allow com- pletion of the other agenda items. PLOT PLAN NO. 342 - Euclid Land and Construction Company - duplex and single family dwelling on R -2 lot - 3240 Rockhold Ave. Planning Director Hersh presented the factual data. Mr. Lew Webb of Euclid Construction was present to answer any questions from the Commission Discussion by the Commission included the layout of the site, the regulations concerning fire protection of a dwelling unit over a garage, and parking provisions. (MO) It was moved by Commissioner Pike, seconded by Commissioner Larson, that Plot Plan No. 342 be approved subject to the following conditions: 1. Development of the subject property substantially in accord with the approved plot plan marked "Exhibit A ". 2. Applicant shall install sidewalks and an appropriate street tree (Jacaranda) on the Rockhold Avenue frontage. A deposit of twenty ($20) dollars shall be made to guarantee instal- lation of the required street tree. PC January 16, 1968 Page Four PLOT PLAN NO. 342 (Continued) �J 3. Development of the subject property shall otherwise be in accord with the applicable standards and policies of the Planning Commission; and in accord with the regulations of the City Zoning Ordinance (Ord. 112). 4. This approval shall expire one year from the date of approval unless a building permit has beenissued, construction has started on the proposed development, and construction is being diligently pursued prior to the stated expiration date. 5. PLOT PLAN NO. 343 - Mayer Construction Company - Design overlay plans for motel - 8617 -8635 Valley Boulevard. Planning Director Hersh presented the factual data. Mr. Dale Ingram, representing Mayer Construction Company, was present to answer any questions fromkhe Commission. Discussion by the Commission included parking arrangements, reserved parking for prospective tenants,. buffer areas, land- scaping, proper lighting, signs, motel office and its location, front setback, walks, appearance of building, stairways and elevators, proper usage of the motel, and enforcement of conditions. (MO) It was moved by Commissioner Holmes, seconded by Commissioner O'Hagan that Plot Plan No. 343 be approved subject to the following conditions: 1. The applicant shall submit revised plans indicating addi- tional landscaping in the planter at the rear of the sub- ject property, including Canary Island Pine trees spaced at twelve (12) foot intervals; showing six (6) foot orna- mental masonry walls at the sides and rear of the site adjoining the parking area where no masonry walls now exist; plans indicating the motel sign or signs, including dimensions, the name of the motel, and the message on the sign; and lighting in the parking area to City standards. The property shall thereafter be developed and maintained strictly and only for motel use and purposes substantially as indicated and approved herewith in accord with the approved plot plans marked "Exhibit A - Revised ", pages 1 through 4. 0 PC January 16, 1968 Page Five PLOT PLAN NO. 343 (Continued) 2. The motel shall not establish or cooking facilities for more approved on the plan. U or maintain kitchen facilities than 25% of the total units 3. The parkin gg area shall be enclosed by a decorative masonry wall six (6) feet in height, except that at the easterly line of the site, the first twenty (20) feet of the wall shall not exceed a height of four (4) feet. 4. The motel may have a two- faced, free standing motel sign, 48 square feet in area per face, in accord with Condition No 1. Signs may indicate "Vacancy" and "No Vacancy" but shall contain no references to weekly or monthly rates. 5. Building plans and construction shall be substantially in accord with the plans and intent of this approval as indi- cated herein and approved as "Exhibit A - Revised" (Four pages). 6. Not less than the first four parking spaces at the entry to the parking lot at the east side of the motel, acces- sible to the registration office, shall be reserved for parking of potential motel tenants. 7. The applicant shall install sidewalks and landscaping with an appropriate sprinkler system, in accord with the City Boulevard Beautification program, and a plan prepared by the City Landscape Architect. A bond or deposit to guarantee installation shall be submitted to the Planning Department in an amount estimated as the approximate cost of the project. 8. Development of the subject property shall otherwise be in accord with the regulations of the City Zoning Ordinance (Ord. 112). 9. This approval shall expire one year from the date of approval unless a building permit has been issued; con- struction has started on the proposed development; and construction is being diligently pursued prior to the stated expiration date; the applicant /owner shall there- after be required to submit new plans for Planning Com- mission consideration. 10. Failure to comply with the plans and conditions as approved herein shall be cause to suspend operation of the motel. 11. Owner /applicant shall submit a signed Affidavit of Accep- tance of Conditions to staff. KENNEES Planning Director Hersh presented the suggested changes and regulations to the Commission. Discussion by the Commission included. definitions, inclusion of veterinarians and animal hospitals; walls; runs and en= closures, conditions for approval, and appropriate zones. (MO) It was moved by Commissioner Larson, seconded by Commissioner Holmes, that the following changes and regulations be approved and be recommended to the City Council for consideration and enactment as additions and alterations to the Rosemead Munici- pal Code: 1. Revise the definition of Kennels (Section 9102.26) to: Any lot, building, structure, or premises in or on which two (2) or more dogs or cats, over four (4) months of age are kept for the primary purposes of sale, breeding; boarding or training, or where four (4) or more weaned dogs or cats over four (4) months of age are kept, main- tained or lawfully permitted for any reason or purpose, whether commercial, non - commercial or otherwise. 2. In Part XXIV - Conditional Use Permit - Section 9124.2 - Uses Permitted in Specific Zones; Use No. 1 - Animal hospitals, kennels and veterinaries in the C -2 and C -3 Zones -- delete "Kennels ". In Part XIV - M- 1.Zone - Permitted Uses Section B -2 - Animal raising and training -- delete ":animal raising and training ". In Part XIV - M -1 Zone - Permitted Uses - Section 9114:.1 -B -46- Veterinaries, animal hospitals and kennels -- Alter "46" to read: " Veterinaries and animal hospitals, including boarding of animals." In Part X,XIV - Conditional Use Permits - Section 9124.2 - Uses Permitted in Specific Zones - Add: #15. Kennels and A:.Ima_raising and training.. All facilities shall be confined to the parcel of land on which the use is no facility shall be so maintained as to constitute a nuisance or to be detrimental to the health or safety of persons residing in the immediate vicinity; all facilities shall be within a building, except that all outdoor cages or runs shall be completely enclosed by chain link fencing; and a six (6) foot masonry wal'1 shall enclose the parcel of lan'd.in the M -1 Zone; and such other conditions as the Planning Commission may impose. SECOND HAND STORES AND SALE OF USED GOODS Planning Director Hersh presented the suggested changes and regulations to the Commission. Discussion by the Commission included meaning of "genuine antiques ", sale of used goods taken in trade on new goods, appropriate zoning, sale of equipment and machinery, sale and display inside or outdoors, and effects of regulations. (MO) It was moved by Commissioner Holmes, seconded by Commissioner Pike, that the following changes and regulations be approved and be recommended to the City Council for consideration and enactment as additions and alterations to the Rosemead Munici- pal Code: 1. Add the following regulations to the list of uses permitted by Conditional Use Permit in Specific Zones - Section 9124.2: " #14. Second hand stores engaged primarily in the sale of used goods, furniture and appliances, other than used cars and the primary sale of genuine antiques, in the C -3 Zone. All sales, display and storage to be within a building." " #15. Sale of used equipment and machinery in the C -3 and M Zones." 2. Add the following paragraph as "e" in the list of conditions stated after the list of uses in the C -1 Zone, Section 9109.1, and as " E " in Section 9111.1 - Uses Permitted, in the C -3 Zone. "Used goods, furn.i:ture, appliances, equipment and machinery may not be displayed or sold unless the goods have been taken in trade on new sales; that all sales are incidental to permitted uses in the zone; and that such sales are a strictly minor part of all business conducted on the pre- mises." After discussion by the Commission regarding the control of animals in the City, Chairman Taylor appointed Commissioners Pike and Holmes to work with the Planning Director in the matter of animal controls. PUuLIC HEARING 6. SUBDIVISION ORDINANCE Planning Director Hersh presented the revised, proposed. ordinance to the Commission. Discussion by the,Commission included corrections suggested and approved by technical experts from Edison Company, Telephone Company; County Engineer's Subdivision Section, City Engineer, Larry Wise, and staff; the validity of regulations in latest revision;�need for subdivision of commercial properties and review of the ordinance again before recommending approval. (MO) It was moved by.Corimissioner Holmes, seconded by,Commissioner Larson, and unanimously carried, that the hearing be held over to February 6, 1968 to allow further review of the ordinance. 12. Mr. Hersh informed the Commission of the upcoming Southern California Planning Congress meeting which is being hosted by the City of Rosemead. The meeting to be held at the Santa Fe Inn on February 6, 1968. Chairman Taylor adjourned the meeting at 10:.40 P.M.
