MINUTES OF JULY 16, 1968
A regular meeting of the Rosemead Planning Commission was called
to order at 7:45 P,M. by Chairman Larson, in the Council Chambers
of the City Hall, 8838 Valley Boulevard, Rosemead.
1. CALL TO ORDER
The Pledge of Allegiance was led by Administrative Assistant,
Steve Street
The Invocation was delivered by Commissioner Schymos

3. APPROVAL OF MINUTES - July 2, 1968
(MO) It was moved by Commissioner Schymos, seconded by Commissioner
Floe, and unanimously carried that the minutes of July 2, 1968
be approved as written.

6. TENTATIVE TRACT NO. 28167 : John Marshall Construction Company -
Northwest corner Wells and Walnut Grove Avenue - R -1
Planning Director Hersh presented the factual data.
Mr. Persley, representing the Marshall Construction Company,
addressed the Commission regarding the conditions of the
tract, if approved. 'Mr. Persley stated that Item No. 9 was
objectionable and asked that the requirement for a five foot
wall along the rear of properties abutting Walnut Grove Avenue
be eliminated. Mr. Persley also stated that a ten foot
strip, 284 feet long, had been dedicated along Wells and
street improvements would be installed there, but they did
not wish to install sidewalks along the cul -de -sac street
of the tract.

Mr+ John Marshall addressed the Commission, asking to have
the 'sidewalk.requ'(rement on the cul "de -sac street eliminated
for financial readdons and for permission to leave the existing
chain link fencing in place and add on approximately 100
feet of chain link fencing to close the tract off from the
Edison Company right -of -way.
Mr. Bernard Koch addressed the Commission regarding future
development of the lots north of the subject tract. Planning
Director Hersh explained the alternates.
Mrs, Thelma Baquet, 4405 Walnut Grove, addressed the Com-
mission regarding alternate development possibilities
and need of street dedication if the subject tract was
abandoned, Planning Director Hersh explained alternates
and possible procedures.,
Mr. Richard Thacker, 3417 Chariette, addressed the Commission
regarding responsibility for development costs if street
is later extended north to take in properties above the
subject tract. Planning Director Hersh explained the affected
property owners would be responsible for expenses involved
in any development they propose.
Discussion by the Commission included possibilities of
extending the subject tract to the north; future arrange-
ments to redevelop the bulb area of the cul -de -sac and
extend the street north; fencing and wall requirements;
dedications necessary; location and extent of sidewalks
and revisions of conditions to approve tract.
(110) It was moved by Commissioner Floe, seconded by Commissioner
Schymos, that Tentative Tract No. 28167 be approved, subject
to the following conditions:
1. This approval shall expire 18 months from the date of
the approval of this tract by the City Council of the
City of Rosemead.
DESIGN
2. The area of lots one (1) through eight (8) shall average
approximately 6000 square feet, or have approximately
the area shown on the revised Tentative Map approved by
the City Council, to substantially conform to the R -I -
6000 Zone standard. Lot 9 , forty (40) feet wide, shall
be held in trust by the City for future use for street
purposes extending the street north beyonj the subject
tract. The City Attorney shall draw up a trust agreement
to control future extension of the north -south street,
including payment for the land, removal and replacement of
the existing cul -de -sac curbs, gutter and sidewalks to
extend the street with improvements to City standards.
3. Provide a right -of -way width of 40 feet with 30 feet
between curbs for the cul -de -sac street; a four and one -
half Mot wide sidewalk td be. integral-with the curb and
gutter, and to extea'. along the entire length of both
sides of the cul -de -sac street.

4. Dedicate a width of 25 feet from center line for Wells
Street, provide curb and gutter with a four and one -
half foot wide sidewalk adjacent to the curb; curbs to
be located 20 feet from center line of street.
5. Provide a 5 foot wide planting and utility easement
adjacent to the rights -of -way for Wells Street and the
cul -de -sac street. The area in this easement not to
be considered as reducing the area of the lot.
6. Provide the necessary dedication to accommodate a property
line return at the intersection of Wells Street and
Walnut Grove Avenue to the satisfaction of the Road
Department.
T. Reconstruct the curb and provide sidewalks for Walnut
Grove Avenue to the satisfaction of the Road Department.
8. Dedicate complete access right from Walnut Grove Avenue
directly to the abutting lots.
9. Provide the necessary length of 5 foot high chain link
fence along and within one foot of the rear of the lots
abutting the Southern California Edison Company Right -
of -Way with design standard comparable with D -62, leaving
the existing approximately 100 foot length of fencing.
Locate the street light and fire hydrant south of the
cul -de -sac bulb to avoid future relocation when and if
the street is altered and extended north.
If the wall and chain link fence are to be constructed
subsequent to the recordation of this tract, file a
faithful performance bond and agreement with the City
Engineer, Design Division, insuring their construction
prior to sale of lots or occupancy of homes constructed
thereon. The penal sum of the bond shall be determined
by the City,Engineer.
M. Provide a standard turnaround, 30 foot radius to curb
face, for the cul -de -sac.
11. Provide street lights and street trees to the satisfaction
of the City of Rosemead.
12. Provide underground utilities for the entire tract.
ROAD DEPARTMENT
13. a. Comply with the Road Department's requirements
regarding street and drainage improvements and
easements needed for street drainage.
b. Easements shall not be granted or recorded within
rights -o€ -way proposed to be deeded or dedicated
for public streets, until after the tract is re-
corded, unless such easements are subordinated to
the road easement by certification on the title
sheet of the final map.

CITY ENGINEER - DESIGN DIVISION

14. The property is subject to sheet overflow.
Approval pertaining to local drainage is subject to the
following requirements:
1. Provide for contributory drainage from adjoining
properties.
2. Eliminate the sheet overflow or elevate the floors
of the building with no openings in the foundation
walls to at least 12 inches above the finished
pad grade.
CITY ENGINEER - SANITATION DIVISION
15. Approval of this tract is contingent upon the installation
and dedication of local sewers to serve each lot of the
subdivision, with provisions for future extensions to
the north.
Easements are tentatively required, subject to review by
the City Engineer to determine the final locations and
requirements.
The subdivider shall consult the Sanitation Division
of the Department of City Engineer to determine the
sewer design requirements.
CITY ENGINEER - WATERWORKS & UTILITIES DIVISION
16. 1. All lots shall be served by an adequate size water
system. The water system shall include fire
hydrants of the size and type and location as
determined by the Fire Chief, with provisions for
future extentions to the north.
2. The water mains shall be of sufficient size to
accommodate the total domestic and fire flows
required for the tract. Domestic flows required
are to be determined by the City Engineer. Fire
flows required are to be determined by the Fire
Chief, with provisions for future extensions to
the north.
3. At the time the final tract map is submitted for
checking, plans and specifications for the water
mains shall be submitted to the City Engineer for
checking and approval, and shall comply with the
City Engineer's standards.

4, Approval for recordation of this tract is contingent
upen approval of plans and specifications mentioned
above, and the subdivider submitting to the City
Engineer, either (a) an Agreement and a Faithful
Performance Bond in the amount estimated by the
,City Engineer guaranteeing the installation of the
water system, or (b) an agreement and other evidence
satisfactory to the City Engineer, indicating that
the subdivider has entered into a contract with the
serving water utility to construct the water system
as required, and has deposited with such water
utility security guaranteeing payment for the in-
stallation of the water system.
S. The specifications shall include a certificate or
statement from a water utility stating that the
proposed system can be operated by the water
utility and that the system will in every respect
meet the requirements of the City.
CITY ENGINEER - BUILDING AND SAFETY DIVISION
i7. Prior to recordation, submit a soils engineer's report
on the expansive properties of soils on all building
sites in the proposed subdivision. Such report shall
be supported by sufficient test data to justify the
findings. If expansive soils are found to exist at
locations and depths likely to affect future structures,
the report shall include specific recommendations for
resisting the effects of differential movement of soils
supporting structures. Soils compacted to minimum of
90% of the optimum density and exhibiting a swell of
more than 3% from air dry to saturation under a sur-
charge loading of 60 pounds per square foot shall be
considered expansive soils.
FLOOD CONTROL DISTRICT
18. The subdivision is reasonably free of flood hazard from
major channels and streams under the Flood Control
District's jurisdiction. Refer to the flood hazard
report from the City Engineer of the City of Rosemead.
HEALTH DEPARTMENT
19. Approved on the condition that sanitary sewers be
installed and used as the method of sewage disposal
with provisions for future extension to the north.

Planning Director Hersh presented the factual data.
Mr Ai%ohony Miller addressed the Commission regarding his
reasons for the requested, modification, including the expense
involvedl existing tree in his front yard and roots inter-
fering with the - sidewalk; drainage problems; need to move
the utility meter; no other sidewalks on Street; and hazard
to pedestrians if sidewalk and street tree installed as
required.
Discussion by Commission included the economic problem
of the property owner; the drainage and liability hazards;
need to redo the existing landscaping; prpsent need of the
walk; future potential of walks in the area; the existing
trees, reasonability of modifying the requirement; and intent
of the ordinance.
City Attorney, Bob Joehnck, stated the need to establish
findings in the approval so that this case noes not establish
a hazardous precedent.
(MO) It was moved by Commissioner Schymos, seconded by Commissioner
Hunter that Mr. Miller be granted a modification of the
Rosemead Municipal Code requirements based on the findings
that the requirement was impractical and unnecessary due to
grade and drainage problems on the site; potential physical
hazards to the safety of pedestrians in the area; financial
hardship to the applicant; an existing large tree on the
site equivalent to the street tree; and, existing potential
for installation of sidewalks on the block under an essess-
ment procedure.

MATTERS FROM COMMISSION AND STAFF
8. Mr. Hersh informed the Commission data on lot splits was
being prepared for issuance to Commissioners and for pending
Committee consideration and action. Mr. Hersh reported
the pending meeting of the Underground Utility Advisory Board
and indicated printed data was being prepared for distribution
to the Commission.

9. Mr. Hersh reported a request from a citizen to consider
establishment Of a regulation to require enclosure of
trash bins and trash storage areas.
