PLANNING COMMISSION
MINUTES
DECEMBER 3, 1968
A regu!ar: of the Rosemead Planning Commission was called
to order by Ch2?rman Larson at 7:35 P.M. in the Council Chambers
of the City Hall, 8838 Valley Boulevard, Rosemead,'California.

Chairman Larson introduced Mr. Dauer to the other members
of the Commission and the staff.
City Clerk, Milton Farrell, administered the Oath of Office
to Mr. Dauer.
4. APPROVAL OF MINUTES - November 19, 1968
(MO) It was moved by Commissioner Schymos, seconded by Commissioner
Hunter that the minutes of November 19, 1968 be approved as
written.
Chairman Larson stated he would like to bring up the election
of a vice - chairman even though it was not on the agenda as
the office hay' been vacant since the resignation of Mr. Holmes.
Commissioner Floe nominated Commissioner Schymos for the
office of Vice- Chairman. Commissioner Hunter seconded the
nomination.
It was moved by Commissioner. Floe, seconded by Commissioner
Hunter, and unanimously carried that the nominations be closed.
Commissioner Schymos was elected as Vice- Chairman of the
Planning Commission by a unanimous voice vote.

Planning Director Hersh presented the factual data.
Mr. Hersh administered the Oath to those persens wishing
to testify.
Chairman Larson opened the public hearing at 7 :49 P,M.
PROPONENTS
1. Mr. Pat Gaffney - 865 Linda Vista, Pasadena - addressed
the Commission stating he was representing Mr. Gambino
in this case. He stated the location of the proposed
restaurant building and the shape of the lot affected
the number of required parking spaces. He also stated
the development would be an asset to the area and would
not be in any way detrimental. to the surrounding resi-
dential and commercial areas.
OPPONENTS

Chairman Larson closed the public hearing at :00 P.M.
Discussion by the Commission included the possibility.of an
added 17th:parking space affecting the turning radius,
intention of owner to retain property under one ownership,
possibility of removing the kitchen facilities.from the -
old ..residence to assure its use as a storage area, dimen-
sions and locations of parking spaces, parking requirements
for existing residence as non - conforming use, lighting.of
property affecting residents to the west, size of sign,
and proper lighting of parking area.
Mr. Farrell commented the property owners to the west had
apparently made no objections to the lighting of the
former businesses at this location and that the storage
area would probably eventually be removed to provide more
parking area.
Mr. Eaffney stated that the proposed parking area layout
seems adequate since the majority of the business would
be during dinner hours and after the bakery and grocery
store were closed.

Mr. Gambino stated he had not yet determined the hours
of operation but that they would most likely be 4 P.M.
to.10 P,M, Monday through Thursday and 4 P.M. to Midnight
Friday and Saturday.
There was some discussion regarding the order in which to
vote upon the Zone Variance and Conditional Use Permit
as a denial of the Zone Variance would.affect the appli
Cant's desire to proceed with the Conditional Use Permit.
(MO) it was moved by Commissioner Floe, seconded by Commissioner
Hunter that Zone Variance No. 57 be approved subject to
the following conditions:
1. The subject property may be developed, operated and Main-
tained as a pizza restaurant, provided the property 1s
developed and maintained substantially as indicated on
the approved revised plot plan marked "Exhibit A -
Revised" and as otherwise specifically permitted herein,
and otherwise only as required and permitted in the
Rosemead Zoning Ordinance (Ord. 112). The revised plan shall
indicate the required masonry wall and the location of
the required parking area lighting, to staff satisfaction.
2. The parking area on the property, providing 16 marked
parking spaces, shall be paved, landscaped and main-
tained, and provided with wheel stops, and shall be
kept lighted after dark, during operating hours.
3. Two signs, not to exceed 80 square feet each and per-
taining to the use conducted on the premises, may be
erected on the site.
4. Prior to occupancy of the proposed pizza restaurant,
the applicant_shall have the kitchen facilities in the
storage building at the rear of the property removed,
and the building inspected by the City Building In-
spector, and the building shall thereafter be main-
tained and used only for storage purposes.
5. A masonry wall, 5 to 6 feet in height, shall be installed
along the southerly section of the westerly boundary
of the property.
6. The existing two parcels of land constituting the sub-
ject property shall have a clause recorded in the title
of each parcel, giving the legal description of the
other parcel and a statement included indicating that
the two parcels are joined and shall remain under one
ownership unless otherwise approved by the City of
Rosemead. A copy of such recorded documents shall be
submitted to the Planning Department for the record.

7. This Zone Variance shall not become effective until the
applicant and owner has filed a signed Affidavit of
Acceptance of Conditions with the City Planning Depart-
ment.
8. It is further declared and made a condition of this
Variance that if any condition hereunder is violated or
if any other applicable statute or ordinance is violated
in the development hereunder, this Va: shall be
suspended and the privileges granted hereunder shall
lapse; provided that the applicant has been given
written notice to cease such violation and has failed
to do so within a period of thirty days.

Attorney Joehnck presented this resolution by title only.

Hunter, and unanimously carried that further reading
be waived.

Hunter that Resolution No. 68 -16 be adopted.

REVIEW AND DISCUSSION OF STUDIES AND COMMITTEES, PROCEDURE,
ASSIGNMENTS, REPORTS AND RECOMMENDATIONS.
Planning Director Hersh reviewed the status of the Planning
Commission committees and studies and suggested establish-
ment of a Commission policy for the formation of a General
Plan Revisions Committee and a Zoning Regulations Amendments
Committee to be continuing committees with activity initiated
when needed.
Mr. Farrell commented that some subjects, such as R -1 and R -2
uses in R -3 and R -4 zones, need extensive study and perhaps
afield trip and that joint sessions with the Counci would
be valuable in such instances.

Hunter and unanimously carried that the policy be adopted to
study all matters relating to planning, zoning and subdivisions
as the need required; that the Commission .establish a General
Plan Revisions Committee, and a Zoning Regulations Committee,
and that members be appointed to these committees; and a re-
- luest for concurrence with this policy be made to the City
Council.
Chairman La -son appointed the following committee members:
Commissioners Hunter and Dauer to the R -I and R -2 uses Com-
mittee.
Commissioners Hunter and Dauer to the C -M Zone Committee
Commissioners Dauer and Schymos to the Move -In Committee
Commissioners Larson and Floe to the General Plan Revisions
Committee.
Commissioners Schymos and Floe to the Zoning Regulations
C'mcndments Committee.
Chairman Larson left a vacancy in the Commission Policies
and Standards Committee to keep it inactive until the Sub-
division Ordinance is adopted.
10. REVIEW OF ZONING ORDINANCE - Conditional Use Permits -
Any Zone Section 9124.1 - 16 Radio, microwave and tele-
vision transmitters and broadcasting stations, including
amateur and professional.
Planning Director Hersh presented the factual data report
stating that Mr. Thomas was an amateur "ham" operator ordered
to cease operation of his radio or acquire a Conditional Use
Permit. Hersh stated he had received a letter from an
attorney on behalf of Mr. Thomas including background and
facts pertaining to the subject and requesting some so-tof
solution to the problem. Mr. Hersh went on to say that no
useful purpose is served in requiring a Use Permit for ama-
teur operators since there are very few conditions that
could be applied not now covered by the Federal Ccmmunications
Commission which preempts the field. That some control over
antennae would be enough to control the situation if it
could be simple, fast, matter- of- ;vy7se and inexpensive.
Attorney Joehnck stated there had been extensive research
on this subject and the only limitation needed is something
regulating erection of the antenna and he found the staff
recommendation deleting the wor! 'amateur" appropriate.
Mr. Farrell commented the Commission might consider some
control over appearance and safety features in the erection
and maintenance of antennas.

Chairman Larson suggested this matter be taken under study
and be discussed in depth at a future meeting. Mr. Hersh
was requested to deliver to the Commission copies of a
NIMLO Model Ordinance on antennae, mentioned by Attorney
Joehnck.
]]..West San Gabriel Valley Council Meeting - December 13, 1968 -
A. Woody and Eddy's Restaurant - Noon - Speaker: ICrushkhov on
the subject of Local Planning in the next four years.
Planning Director Hersh informed the Committion of the
special Christmas luncheon and urged the members to attend,
Commissioners Dauer, Floe, Hunter, Larson and Schymos and
Administrative/Assistant Street indicated they would like
reservations made.
B. Planning Director Hersh announced the Southern California
Planning Congress Meeting on December 12, 1968 at the Anaheim
Convention Center.
Commissioner Floe, Hunter, Larson and Schymos indicated they
would like reservations made.
C. Mr. Hersh stated that he had been approached by three separate
property owners desiring a division of their property and that
in these instances the division of the land would not be
objectionable, since they would not involve tandem or flag
lots.
Mr. Hersh suggested that the Commission request the Council
pass an urgency ordinance amending the moratorium to allow
the divis.ion of property into four or fewer parcels, provided
there is at least 50 feet of street frontage for each parcel;
sufficient square ,footage in each parcel as required by the
zoning ordinance, and that no parcel be approved with suffi-
cient area to be divided again.
Discussion by the Commission included the validity of these
requests since it was not intended to close off lots with
street frontage.

Hunter that the Commission request the Council adoption of
an urgency ordinance to amend the ordinance on the mora-
torium of lot splits.

THE COMMISSION.
Councilman Pike addressed Mr. Dauer, congratulating him on
his appointment as a Planning Commissioner.
There being no further business, Chairman Larson adjourned the
meeting at 9:50 P.M.
