PC - Minutes - 04-15-69PLANNING COMMISSION MINUTES APRIL 15, 1969 A regular meeting of the Rosemead Planning Commission was called to order by Chairman Larson at 7:43 P.M. in the Council Chambers of the City Hall, 8838 Valley Boulevard, Rosemead, California. l.. CALL TO ORDER The Pledge of Allegiance was led by Chairman Larson. Mr. John Aussenhofer, Narramore.Christian Foundation, delivered the Invocation. 2. APPROVAL OF MINUTES - April 1, 1969 (MO) It was moved by Commissioner Schymos, second by Commissioner Dauer and unanimously carried that the minutes of April 1, 1969 be approved as written. 4. TIME RESERVED FOR PERSONS IN THE AUDIENCE WHO WISH TO ADDRESS THE COMMISSION. NONE PUBLIC HEARING 5. ZONE CHANGE NO. 36 - A -1 to P -D - 1409 Walnut Grove Avenue - Narramore Christian Foundation. Planning Director Hersh presented the factual data. Mr. Hersh administered the Oath to those persons wishing to testify. Chairman Larson opened the public hearing at 8 :00 P.M. PROPONENTS 1. Mr. Clyde Narramore, Director of the Foundation, 1409 Walnut Grove, reviewed the functions of the foundation . and stated the foundation wishes to expand these functions and become an asset to the City of Rosemead. The plans and request submitted for a change of zone from A -1 to P -D are in accord with Rosemead's adopted General Plan, and represent the Master Plan of Development for the Narramore Foundation. The proposed Rosemead Graduate School of Psychology should be an asset to the city. OPPONENTS NONE PC April 15, 1969 Page Two Chairman Larson closed the public hearing at 8 :01 P.M. (MO) It was moved by Commissioner Schymos, second by Commissioner Hunter that Zone Change No. 36 and the Master Plan for the Narramore Christian Foundation be approved, and that approval of the zone change and Master Plan be recommended to the City Council. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ROSEMEAD THAT CERTAIN PROPERTY, ZONE CHANGE NO. 36, BE CHANGED FROM A -1 to P -D. Attorney Joehnck presented the resolution by title only. (MO) It was moved by Commissioner Schymos, second by Commissioner Hunter that further reading be waived and Resolution No. 69 -6 be adopted. CONDITIONAL USE PERMIT NO. 27 4715 Rosemead Boulevard - training center for young retarded children - Retarded Children's Association of San Gabriel. Planning Director Hersh reviewed the factual data and pre- sented the suggested revised conditions. Mr. Hersh also presented a letter received from Mr. David V. Craig, President of the Retarded Childrens Association stating that the children in the training centers were merely slow learners and fast forgetters, and not dangerous, harmful:or unruly children. Mr. Hersh administered the Oath to those persons wishing to testify. Chairman Larson opened the public hearing at 8 :15 P.M. PROPONENTS 1. Mr. Drane, volunteer member of the Retarded Childrens Association, addressed the Commission stating the Associa- tion would fulfill all of the revised conditions if imposed, and presented a petition signed by property owners near . the subject property stating they had no objections to the school establishing on this site. Mr. Arthur Artwell, representing the Los Angeles County Superintendent of Schools Office, stated he concurred with the statement that the children were not dangerous. That many of the children were enrolled in the Lincoln, School, and that youngsters pretrained in private schools, such as that proposed, are far better equipped for atten- dance in public schools. 3. Mr. Robert Morrow, 202 South Fifth Avenue, Monrovia, owner of the property to the south of a similar school in Monrovia stated he had found no hazards or disturbances in the Monrovia facility and that existence of the school had had no derogatory effect on the value of his property. 4. Mary Finkle, 140 South Fifth Avenue, school teacher in the Monrovia facility presented pictures of the Monrovia school and surrounding properties and a letter from K. C. Wilson, City Clerk, City of Monrovia, stating that the school had been established in Monrovia for approximately seven years and that there had been no evidence of problems with the school. OPPONENTS 1. Mr. John Doherty - 4705 Rosemead Boulevard, addressed the Commission concerning troubles he has had with the patients from the neuropsychiatric hospital and how the value of his property would certainly decrease if the school were premitted to establish on the requested location. 2. Mrs. John Doherty - 4705 Rosemead Boulevard, addressed the Commission concerning the effect the school would have on the surrounding neighborhood and the necessity to keep her small daughter playing in the house to pro- tect her from patients of the neuropsychiatric hospital and children from the proposed school. Chairman Larson closed the public hearing at 8 :32 P.M. Discussion by the Commission included amount of money to be put into the establishment of the school by the Association, the number of children from Rosemead to be served by the school, the amount of money to be put into the school over a five year period, and the potential financial loss to the school founders when the project is closed down in five years. Commissioner Schymos stated the applicant would be harmed the least if the permit were denied since they would not have to take the risk of losing the invested money after five years, and that the existing residents of Rosemead should be the City's first consideration. (MO) It was moved by Commissioner Schymos,, second by Commissioner Hunter, that Conditional Use Permit No. 27 be denied on the basis that it would be detrimental to the surrounding neighborhood. Chairman Larson reopened the public hearing at 8:57 P.M. and continued the public hearing to the next regular meeting on May 6, 1 .969. Chairman Larson declared a recess at 8:58 P.M. Chairman Larson reconvened the meeting at 9 :15 P.M. NEW BUSINESS 7. TENTATIVE TRACT NO. 29296 - 10 unit subdivision - NortW side of Marshall Street between Rosemead Boulevard and Ivar Avenue - J. B. Weber Development Company. Planning Director Hersh presented the factual data. Mr. Jack Weber was present to answer any questions from the Commission. Discussion by the Commission included underground utilities to be required throughout the tract as the condition was not listed, and possible modification of some setbacks. Mr. Hersh pointed out that after final approval of the tract, the Commission would receive a plot plan of houses on the tract for consideration and approval. (MO) It was moved by Commissioner Dauer, second by Commissioner Schymos, that Tentative Tract be approved and a recommendation for approval be made to the City Council subject to the following conditions: 1. The approval expires 18 months from the date of approval by the City of Rosemead. DESIGN 2. Provide sufficient area for all lots to conform with the requirements of the R -1 - 6000 zone. 0 PC April 15, 1969 Page Five TENTATIVE TRACT NO. 29296 (Continued) 3. Provide at least 35 feet of frontage at the property line and approximately radial lot lines for all lots fronting on the knuckles and cul -de -sacs, except those lots shown as being served by access strips. 4. Provide street trees, lights, and sidewalks throughout the tract in accordance with the requirements of the Sub- division Ordinance. 5. Provide a forty (40) foot right -of -way for street purposes with thirty (30) feet between curbs in the cul -de -sac street and a five (5) foot planting and utility easement adjacent to the right -of -way, said easement not to be construed to reduce the area of the lots. 6. Place the curbs on Marshall Street twenty (20) feet from centerline. 7. Underground utilities are required throughout the tract. ROAD DEPARTMENT 8. a. Comply with the Road Department's requirements regarding street and drainage improvements and easements needed for street drainage. b. Easements shall not be granted or recorded within rights -of -way proposed to be deeded or dedicated for public streets, until after the tract is recorded, unless such easements are subordinated to the road easement by certification on the title sheet of the final map. CITY ENGINEER - DESIGN DIVISION 9. The property is subject to sheet overflow. Approval pertaining to local drainage is subject to the following requirements: 1. Provide for contributory drainage from adjoining properties. 2. Eliminate the sheet overflow or elevate the floors of tie buildings with no openings in the foundation walls to at least 12 inches above the finished pad grade. CITY ENGINEER.- SANITATION DIVISION 10. Approval of this tract is contingent upon the installation and dedication of local main line sewers to serve each lot of the subdivision. Easements are tentatively required., subject to review by the City Engineer to determine the final locations and requirements. The subdivider shall consult the Sanitation Division of the Department of City Engineer to determine the sewer design requirements, 0 PC April 15, 1969 Page Six TENTATIVE TRACT NO. 29296 (Continued) 9 CITY ENGINEER - WATERWORKS & UTILITIES DIVISION 11. 1, All lots shall be served by an adequate size water system. The water system shall include fire hydrants of the size and type and location as determined by the Fire Chief. 2. The water mains shall be of sufficient size to accomo- date the total domestic and fire flows required for the tract. Domestic flows required are to be deter- mined by the City Engineer. Fire flows required are to be determined by the Fire Chief. 3. At the time the final tract map is submitted for checking, plans and specifications for the water mains shall be submitted to the City Engineer for checking and approval, and shall comply with the City Engineer's standards. 4. Approval for recordation of this tract is contingent upon approval of plans and specifications mentioned above, and the subdivider submitting to the City Engineer, either (a) and Agreement and a Faithful Performance Bond in the amount estimated by the City Engineer guaranteeing the installation of the water system, or (b) an agreement and other evidence satis- factory to the City Engineer, indicating that the subdivider has entered into a contract with the serving water utility to construct the water system as required, and has deposited with such water utility security quaranteeing payment for the installation of the water system. CITY ENGINEER - BUILDING AND SAFETY DIVISION 12. Prior to recordation, submit a soils engineer's report on the expansive properties of soils on all building sites in the proposed subdivision. Such report shall be sup- ported by sufficient test data to justify the findings. If expansive soils are found to exist at locations and depths likely to affect future structures, the report shall include specific recommendations for resisting the effects of differential movement of soils supporting structures. Soils compacted to minimum of 90% of the optimum density and exhibiting a swell of more than 3% from air dry to saturation under a surcharge loading'of 60 pounds per square foot shall be considered expansive soils. DEPARTMENT OF PARKS AND RECREATION 13. All existing trees, if any, to be removed from street rights - of -way to de dedicated or dedicated rights -of -way. FLOOD CONTROL DISTRICT 14. The subdivision is reasonably free of flood hazard from major channels and streams under the Flood Control District's jurisdiction, Refer to the flood hazard report from the office of the City Engineer, Design Division.. 0 0 HEALTH DEPARTMENT 15. Approved on the condition that sanitary sewers be installed and used as the method of sewage disposal. The owner's statement indicates that domestic water will be supplied by California American Water Company. Planning Director Hersh presented the factual data. Mr. Ron Johnson, Euclid Land and Construction Company, was present to answer any questions from the Commission. Discussion by the Commission included the purposes of dividing the property as proposed, potential hazards of the existing dwelling sitting across a property line, and the various regula- tions and controls preventing improper usage of the property. It was moved by Commissioner Schymos, second by Commissioner Hunter, that Plot Plan No. 413 be approved subject to the following conditions: 1. Subject property shall be divided and developed sub- stantially as indicated on the plot plan marked "Exhibit A ". 2. The applicant shall secure the necessary permits and install curbs, gutters, sidewalks, driveway approaches and two (2) street trees to City standards on the Sullivan Avenue frontage (Pink Crepe Myrtle), and four (4) trees on the Whitmore Avenue frontage (Brazilian Pepper Tree). The City holds a refundable deposit to guarantee irst-illation of the required improvements. 3. The applicant shall submit a Parcel Map of the approved division for processing, final approval and recordation in accord with the requirements of the State Subdivision Map Act; no building permit to be issued before recordation of the Parcel Map. The applicant shall also submit a check in the sum of $41.00 (made out to the Los Angeles County Engineer) to cover processing and recordation fees. 4. Subject property shall otherwise be developed in accord with applicable standards and policies of the Planning Commission and the regulations of the City Zoning Ordinance. 5. Mr. Moreland, representing the church, read the letter from the church board submitted to the Commission requesting she time extension. Mr. Hersh suggested that if the time extension were granted the expiration day be set at April 15, 1970 as the staff had held up the request for one meeting. (MO) It was moved by Commissioner Schymos, second by Commissioner Dauer that a time extension be granted for Conditional Use Permit No. 18 for the Hellman Avenue Baptist Church. The time extension to expire on April 1 :5, 1970. ELECTION OF OFFICERS Chairman Larson relinquished his gavel to Administrative Assistant Steve Street and Mr. Street opened the nomina- tions for Planning Commission Chairman. Commissioner Schymos nominated Lyle Larson for Planning Commission Chairman. Commissioner Dauer second the nomination. It wa: rnoved by Cor.:missioner Dauer, second by Commissioner Sc':•aros, and unanimously carried that nominations be c'osed and a unanimous ballot be cast for Mr. Larson. Re- elected as Chairman, Mr. Larson resumed his chair and declared nominations open for Vice - Chairman of the Planning Commission. Commissioner Dauer nominated Commissioner Schymos for Vice Chairman of the Planning Commission. Commissioner Hunter second the nomination. It was moved by Commissioner Hunter, second by Commissioner Dauer and unanimously carrier that the nominations be closed and a unanimous ballot be cast for Commissioner Schymos. Commissioner Schymos nominated Steve Street for Secretary of the Planning Commission. Commissioner Dauer second the nomination. It was moved by Commissioner Dauer, second by Commissioner Schymos and unanimously carried that the nominations be closed and a unanimous ballot be cast for Mr. Street. 10. B. Commissioner Schymos mentioned the possibility of a study session to discuss Committee activities. It was agreed by the Commission that a study session be held Tuesday, April 29, 1969 at 8 :00 P.M. in the Conference Room of the City Hall. There being no further business, Chairman Larson adjourned the meeting at 10:15 P.M.
