PC - 1968 - 08 - Denying a Conditional Use Permit: Case Number 20CITY OF ROSEMEAD RESOLUTION NO. 68 -8 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DENYING A CONDITIONALUSE PERMIT : CASE NUMBER 20. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Arthur C. Bauman, with respect to real property described as follows: That portion of Lot 4 in Block 9 of Rosemead, Sheet No. 2, in the City of Rosemead, County of Los Angeles, State of California, as shown in Book 21, Pages 114 and 115 of Maps, in the office of the County Recorder of said County, described as follows: Beginning at the intersection of the Westerly line of the Easterly 253.00 feet, measured at right angles, of said Lot 4, with the Southerly line of Ramona Boulevard, as relinquished by the State of California, by Relinquishment recorded on June 4,1963 as Instrument No. 4880 in Book R -1570, Page 561 of Official Records, in the office of said Recorder; thence Westerly along said South- erly line of Ramona Boulevard and which is along a curve concave Northerly, having a radius of 8035 feet, through a central angle of 1 29' 54" and an arc distance of 210.12 feet to a line which is parallel with and distant Westerly 210.00 feet, measured at right angles, from said Westerly line, (a radial line to said point has a bearing of North 1 43' 54" East); thence along said last mentioned parallel line, North 0 57' 48" West 190.01 feet; thence North 89 02' 12" East 210.00 feet to said Westerly line; thence along said Westerly line South 0 57' 48" East 197.14 feet to the Point of Beginning as shown on maps filed in the Office of the Recorder of the County of Los Angeles, and otherwise described as the southeast corner of the Rosemead Square Shopping Center in the City of Rosemead; requesting a Conditional Use Permit, on property in the C -3 (Medium Commercial) Zone to permit: the establishment of a "Super Slide" amusement and recreational facility on an approximately 205 feet by 157 feet area in the southeasterly corner of the property abutting Hart Avenue and the San Bernardino Freeway; that a public hearing was duly set for Tuesday, April 30, 1968, at 7:30 P.M. at the City Hall, 8838 Valley Boulevard, Rosemead, California, and a of the time, date, place and purpose of aforesaid hearing was duly given; that a hearing was duly held at the aforementioned time and place. • 68 -8 Page Two 11 Section 2. The Planning Commission further finds and determines that facts do not exist as required by Section 9124 and 9126 et seq. of the Ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit. Section 3. The Planning Commission further finds: 1. That the proposed development would not be in accord with existing and proposed uses in the shopping center and the neighborhood; 2. That the proposed development would detrimentally affect the area; 3. That the proposed development would not be appropriate to the general welfare of the citizens of the area. Section 4. Based on the aforementioned findings the Commission hereby denies a Permit with respect to that property described in Section 1 of this resolution. Section 5. This action shall become final and effective after ten (10) days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary shall certify to the adoption of this resolution and shall transmit copies of same to the appli- cant and the Rosemead City Clerk.
