RESOLUTION NO. 68 -6
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROSEMEAD GRANTING A ZONE VARIANCE:
CASE NUMBER 53.
THE PLANNING COMMISSION OF THE CITY OFIROSEMEAD DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission doe s hereby find
and determine that an application was duly filed by Bluetone
Mufflers, with respect to real property described as follows:
That portion of Lot 3, Tract No. 830, M.B. 16 -117,
described as follows: Beginning at the intersec-
tion of the W'ly. line of said Lot 3 with the S'ly
line of Garvey Avenue (100 ft. wide); thence E'ly
along the S'ly line of Garvey Avenue a distance of 120
feet to the True Point of Beginning; then con-
tinuing E'ly on the S'ly line of Garvey Avenue a
distance of 165 feet more or less; thence S. 44
41' 4 " W. 40 feet more or less; thence S'ly along
• curved line concave to the southeast 'and having
• radius of 1460 feet a distance of 160 feet more
or less; thence NW'ly along a line to a point
bearing S. 0 15' E. 93.5 feet from the. True Point
of Beginning; thence N. 0 15' W. 93.5 feet to
the True Point of Beginning
requesting a Zone Variance, on property in the M -1 (Light Manu-
facturing and Industrial) Zone to permit:
an existing muffler manufacturing and installation
business to maintain and operate said business
with a portion of the existing building located
within the required five foot setback area at the
front of the property on Garvey Avenue, and to
permit outdoor muffler installation on automobiles
and trucks on two existing open, uncovered fixed
hoists, with parking provided as required;
that a public hearing was duly set for Tuesday, March 19, 1968 at
7:30 P.M. at the City Hall, 3018 North Charlotte Avenue, Rosemead,
California, and a notice of the time, date, place and purpose of
aforesaid hearing was-duly given; that a hearing was duly held at
the aforementioned time and place.
Section 2. The Planning Commission further finds and
determines that facts exist as required by Section 9124 and 9126
et. seq, of the Ordinances of the City of Rosemead justifying a
granting of the Zone Variance.
Section 3. The Planning Commission further finds:
1. that to deny this variance would create a hardship
for the applicant as he acted in good.-faith upon
the building permit erronously issued to him.
2, that the granting of this variance would not adversely
affect the General Plan

Section 4. Based on the aforementioned findings the
Commission her a —ants a variance with respect to that property
described in Section 1 of this resolution, subject to the conditions
attached hereto.
Section 5. This action shall become final and effective
after ten 0 ays after this decision by the Planning Commission
unless within such time a written appeal is filed with the City
Clerk, for consideration by the Rosemead City Council as provided
in the Zoning Ordinance.
Section 6. The Secretary shall certify to the adoption
of this resolution and shall transmit copies of same to the appli-
cant and the Rosnead City Clerk.
