PC - 1967 - 13 - Denying a Zone Variance: Case Number 50P RESOLUTION NO. 67 -13 • A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DENYING A ZONE VARIANCE: CASE NUMBER 50. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1'. The *Planning Commission does hereby find and determine that an application was duly filed by.Louis and Jeanne Schreckler, with respectto real property described as follows: The Easterly 112.25' of Lots 26,E 27 Tract #5189 as shown on a Map Recorded in Book 90 Pages 23 to 30 of Maps, in the Office of the County of Los Angeles , requesting a Zone Variance, on property in the R -1 (Single Family Residential) Zone to permit: . a zone variance on property in the R -"1 Zone having an area of 10,331.5 square feet to be divided into two lots, each with less than the required minimum,area; the existing dwelling to be re- moved and each lot to be developed with anew single family dwelling, the attached garage on the south lot to penetrate two feet into the required side yard; that a public hearing was duly set for Tuesday, August 15, 1967., at 7:30 P.M. at the City Hall, 3018 North Charlotte, Rosemead, California, and a notice of the time, date, place and purpose of aforesaid hearing was duly given; that a hearing was duly held at the aforementioned time and place. Section 2. The Planning Commission further finds and determines that facts do not exist as required by Section 9124 and 9126 et seq, of the Ordinances of the City of Rosemead justifying a granting of the Zone Variance. Section 3. The Planning Commission further finds: 1. that the requested development is not in accord with the proposals of the General Plan adopted by the Planning Commission. 2. that the applicants have not submitted any evidence of existing hardship to justify the proposed variance. Section 4. Based on the aforementioned findings the Commission hereFy denies a variance with respect to that property described in Section 1 of this resolution. Section 5. This action shall become final and effective after ten (10 ays after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 6. The Secretary shall certify to the adoption of this reso uttion and shall transmit copies of same to the appli- cant and the Rosemead City Clerk.
