RESOLUTION NO. 67 -11
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROSEMEAD GRANTING A ZONE VARIANCE: CASE
NUMBER 45 - REVISED (2)
THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission does hereby find
and determine that an application was duly filed by Antique Auto
Parts, Mr. Gene Scott, with respect to real property described as
follows:
Those portions of Lot 12, E. J. Baldwin's First
Subdivision in the Rancho Potrero Grande, City
of Rosemead, County of Los Angeles, State of
California, as shown on map recorded in Book 66,
page 94 of Miscellaneous Records, and Book 34,
page 6 of Records of Survey, filed in the office
of the County Recorder of said County, described
as follows:
Lot commencing at the intersection of East line
of Lot 12 with North line of Garvey Avenue; thence
West on said North line 150 feet with a uniform
depth of 110 feet North 0 14' West. Part of Lot
12.
AND
Beginning at a point on the East line of said
Lot 12 distant northerly North 0 14' West 130.00
feet from the North line of Garvey Avenue 100
feet wide; thence northerly along said East line
of Lot 12, North 0 14' West 110.22 feet; thence
South 89 46' West 150.00 feet; thence South 0
14' East 110.22 feet; thence North 89 46' East
150.00 feet to the point of beginning; otherwise
described as 9103 to 9113 Garvey Avenue, and
property to the rear of 3016 Sullivan Avenue
requesting a Zone Variance, on property in the R -1 (Single Family
Residential) and M -1 (Light Manufacturing and Industrial) Zones to
permit:
the expansion of an existing wholesale and retail automobile parts
business, to include the construction and use of additional storage
facilities, including parking on a parcel of land divided by an
alley;
that a public hearing was duly set for Tuesday, August 1, 1967
at 7:30 P.M. at the City Hall, 3018 North Charlotte Avenue, Rose -
meao, California, and a notice of the time, date, place and purpose
of aforesaid hearing was duly given; that a hearing was duly held at
the aforementioned time and place.
Section 2. The Planning Commission further finds and
determines that facts exist as required by Section 9124 and 9126 et
seq. of the Ordinances of the City of Rosemead justifying a granting
of the Zone Variance.
Section 3. The Planning Commission further finds.
1. Subject to the conditions applied this variance
will not constitute a grant of special privileges
inconsistent with limitations on surrounding.
properties.
2. That the grant of this variance will not be
materially detrimental to the public health,
welfare of injurious to property or improvements
in the surrounding area.
3. That due to the special circumstances with
regard to the location of access'to the subject
property strict adherence of the provision of
.the Zoning Ordinance would deprive the subject
property of privileges accorded other properties
in the vicinity.
4. The granting of this variance is in conformity
with-the proposed comprehensive General Plan.
Section 4. Based on the aforementioned findings the
Commission hereby grants a variance with respect to that property
described in Section 1 of this resolution, subject -to the conditions
attached hereto.
Section 5. This action shall become final and effective
after ten (10 days after this decision by the Planning Commission
unless within such time a written appeal is filed with the City
Clerk, for consideration by the Rosemead City Council as provided
in the Zoning Ordinance.
Section 6. The .Secretary shall certify to_the adoption
of this reso ut� ion and shall transmit copies of same to the appli-
cant and the Rosemead City Clerk.
