RE: Second Extension of Conditional Use Permit 11 -10
On March 5, 2012, the Planning Commission approved Conditional Use Permit 11 -10 to convert an
existing 7,547 square foot restaurant located at 8752 Valley Boulevard in the C -31D (Medium
Commercial with a Design Overlay) zone into a meditation temple.
On August 20, 2012, the Planning Commission granted a one (1) year extension of Conditional
Use Permit 11 -10. At that time, the restaurant tenant was unable to move out of the building due to
economic hardship and length of time. The applicant (property owner) also did not want to evict his
tenant, since they voluntarily agreed to move out. For those reasons, he requested a one (1) year
extension.
On July 18, 2013, the applicant submitted a letter (attached as "Exhibit A "), requesting a second
extension to Conditional Use Permit 11 -10. The applicant has indicated that due to his health, he
was unable to gather material necessary for the conversion of his temple, most of which has to
come from India. For these reasons, the applicant is requesting that the Planning Commission
extend Conditional Use Permit 11 -10 for a period of one (1) year.
Recommended Action
It is recommended that the Planning Commission grant the one (1) year extension and direct the
Planning Division to take any actions necessary and execute any documents required to effectuate
the extension.
