RE: Withdrawal of Modification 13 -04
On October 7, 2013, Wal -Mart Stores, Inc. requested to modify the conditions of approval for
Development Agreement 04 -01, Tentative Parcel Map 26827, and Conditional Use Permits 02 -882
and 03 -939 to eliminate Condition of Approval Number 59, which currently requires the annual
Planning Commission review of Wal- Mart's compliance with the conditions of approval. After
hearing all testimonies, the Planning Commission denied Modification 13 -04 and recommended
that staff bring back a resolution of denial to the Planning Commission meeting on October 21St.
On October 16, 2013, Wal -Mart Stores Inc. submitted a letter (attached as Exhibit "A ") to the
Planning Division, requesting to withdraw Modification 13 -04. Due to Wal -Mart Store Inc.'s
withdrawal of the Modification application, no further action will come to the Planning Commission
on this matter.
Recommended Action
It is recommended that the Planning Commission receive and file the memorandum.
